If you are only cutting the trees and driving in the poles then the overhead line crossings will not require a permit from the Corps. We plan to cut, but not clear the R/W encompassing all of the utility lines. I've attached correspondence, between SE1, Hart & Hickman, and Kyle Barnes regarding this identical situation at Aulander Holloman and Knee Branch(near Ahoskie). On this other site, in which a forested wetland was cut to install utility lines, we were told that, as long as we didn't stump, or grind stumps below ground level, that the activity would not be considered permanent impacts. In fact, because we were installing wooden utility poles(as we are doing at Albemarle Beach), we did not have to document this activity. Regardless, I have my engineer working on creating a map showing the utility line for your reference. I will have it over to you today. The idea is that once these areas are cut, and the line is installed, that the community of organisms will be able to remain and flourish, since there is minimum to no maintenance required on the lines after installation. Only in cases of emergency will any access be necessary. Any permanent conversion of forested wetlands will need to be accounted for and potentially mitigated for (see below). Please provide more information regarding the overhead line crossings. If there are impacts associated with the overhead lines then we would need to evaluate/authorize this project under NWP-12 and NWP-14. NWP-12 Regional Condition 4.1.10 Any permanently maintained corridor along the utility right of way within forested wetlands shall be considered a permanent impact. A compensatory mitigation plan will be required for all such impacts associated with the requested activity if the activity requires PCN and the cumulative total of permanent forested wetland impacts exceeds 1/10-acre, unless the District Engineer determines in writing that either some other form of mitigation would be more environmentally appropriate or the adverse effects of the proposed activity are minimal. For permanent forested wetland impacts of 1/10-acre or less, the District Engineer may determine, on a case -by -case basis, that compensatory mitigation is required to ensure that the activity results in minimal adverse effects on the aquatic environment.
