Upon review of your request for 401 Water Quality
Certification to place fill material in 0.05 acres of wetlands or
waters which are tributary to Wagner Branch for road improvement
located at SR 1720 in Buncombe County, we have determined that
the proposed fill can be covered by General Water Quality
Certification No. 2732 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 14.

MEMORANDUM

DATE: November 9, 1992
SUBJECT: A review of an application by Mr. Larry J. Cordell of
the NCDOT to replace twin pipes in an unnamed tributary
to Reems Creek (below trout water designation) on SR
1720 near Asheville, Buncombe County.
Mr. Larry J. Cordell of the North Carolina Department of
Transportation (NCDOT) is requesting a letter of concurrence from
the North Carolina Wildlife Resources Commission (NCWRC) in order
to obtain a 404 permit from the U.S. Army Corps of Engineers.
Staff field biologists of the NCWRC have reviewed the information
provided by the applicant, and an onsite investigation was
conducted on November 6, 1992, for the purpose of assessing
potential construction impacts on wildlife and fisheries
resources. These comments are provided in accordance with
provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et.
seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d).
Based on the information provided by the applicant and our
information on the range of trout in the project area, we do not
believe this project will cause significant effects to waters
supporting trout. However, construction must be accomplished so
that wet concrete does not contact stream water. This will
lessen the chance of altering the stream's water chemistry and
causing a fish kill.
