Fullwood, Executive Director Dn I JAIL 2 2 ma January 11, 1993 Mr. Robert Johnson, Office Manager U.S. Army Corps of Engineers Regulatory Branch Room 75, Grove Arcade Building Asheville, North Carolina 28801 SUBJECT: A review of an application by Mr. Danny Tolar to upgrade SR 2816 and replace an extend culverts on an unnamed tributary to Garren Creek, Fairview, Buncombe County. The N.C. Wildlife Resources Commission (NCWRC) has reviewed the information provided by Mr. Tolar and we are familiar with habitat values of the project area. An onsite investigation was conducted on January 8, 1993 to further assesses potential construction impacts on wildlife and fisheries resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to upgrade SR 2816. In order to upgrade this road DOT must extend and replace several culverts along the road. Garren Creek is not a Designated Public Mountain Trout Water (DPMTW); however, it does support a wild trout population. This stream offers habitat for trout and supports a small wild trout population as well as populations of other fish species. No federal or state listed threatened or endangered species are known to be present at this site. The NCWRC is concerned over potential adverse impacts to aquatic resources in this drainage. The NCWRC will not object to the issuance of the permit provided the following conditions are met by the applicant: 1) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. t- 1 Permanent vegetation in these same areas should be established within 15 days of project completion to provide long term erosion control. 2) Erosion control measures should be installed prior to the start of construction and maintained until the project site has been stabilized. 3) Culverts should be placed at the same slope as the stream bottom and should be buried 1 foot unless bencountered. This may reduce the capacity of the culvert so the culvert size should be assessed given this condition. 4) The road grade approaching the bridge over Garren Creek should be sloped so that water runs off the road well before reaching the creek. Unless the water is turned off the road, the long slopes approaching this bridge will cause a great deal of runoff to directly enter the creek without allowing suspended material to settle.
