The N.C. Wildlife Resources Commission (NCWRC) has reviewed the information provided by Mr. Tolar and we are familiar with habitat values of the project area. An onsite investigation was conducted on January 8, 1993 to further assesses potential construction impacts on wildlife and fisheries resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to upgrade SR 2114. In order to upgrade this road, DOT must extend and replace several culverts along the road. Reems Creek is a Designated Public Mountain Trout Water (DPMTW) and is managed as a Hatchery Supported stream. This stream offers habitat for trout and supports a small wild trout population as well as populations of other fish species. The unnamed tributary is to small and degraded to support trout. This tributary is less than 1 meter wide and primarily has a sand substrate. No federal or state listed threatened or endangered species are known to be present at this site. The NCWRC is concerned over potential adverse impacts to aquatic resources in this drainage. The NCWRC will not object to the issuance of the permit provided the following conditions are met by the applicant: 1) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of project completion to provide long term erosion control. 2) Erosion control measures should be installed prior to the start of construction and maintained until the project site has been stabilized. 3) Culverts should be placed at the same slope as the stream bottom and should be buried 1 foot unless bedrock is encountered. This may reduce the capacity of the culvert so the culvert size should be assessed given this condition. 4) A series of sediment traps should be constructed at the lower culvert crossing. These traps should remain in place and be maintained during the life of the project. They should reduce sedimentation of Reems Creek. Due to the proximity of a trout stream and replacement of pipes, we are requesting a 404 Nationwide Permit. I am sending a straight line sketch with the proposed erosion control, stream, stream bank, and construction limits. ATV ,..-- Dear Mr. Tolar: Reference your application of December 18, 1992, for Department of the Army authorization to widen and pave S.R. 2114, Sugar Cove Road, in Weaverville, * combe County North Carolina. The project will involve culvert replacements and extensions and an approximate 100 linear foot channel change to an unnamed tributary to Reems Creek. Approximately 0.04 acre of waters of the United States will be impacted by the roadway construction. Reems Creek is a Designated Public Mountain Trout Water. The project has been reviewed by the N.C. Wildlife Resources Commission (WRC). For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (ivWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions, and those outlined in the attached January 11, 1993 WRC letter. This NWP does not relieve you of the -2- responsibility to obtain any required State or local approval. Informaticn regarding issuance of a Section 401 Water Quality Certification may oe obtained through John Dorney, Division of Environmental Management, at (919) 733-1786. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
