On April 15, 2020, the Division received your application requesting a 401 Water Quality Certification for the subject
project. The Division has determined that your application is incomplete and cannot be processed. The application is on
hold until all of the following information is received:
1. Please provide the Division a copy of your responses to the North Carolina Wildlife Resources Commission email
dated April 30, 2020. The Division is particularly interested in the elevation of the ordinary high water
mark (OHWM) and details of the proposed coffer dam. [15A NCAC 02H .0506(b)(2) and (c)(2)]
2. Please provide the Division a copy of your responses to the US Army Corps of Engineers email dated May 11,
2020. [15A NCAC 02H .0502]
3. Has any consideration been given to a push in place concrete slab for the end of the ramp? The use of wet
concrete below the OHWM, even with a coffer dam, leaves the river highly vulnerable to accidental discharges
of wet concrete, which can significantly affect pH and be toxic to aquatic life. [15A NCAC 02B .0200]
4. Will the proposed boardwalk be constructed without any temporary impacts to the existing wetland, particularly
with regard to construction equipment and access? [15A NCAC 02H .0502]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received, the Division will be unable to
approve the application and it will be denied as incomplete.
