We wanted to address the outstanding comments from your last email prior to our conference call yesterday, and also Andrew's final comment re: sum totals of lengths - I have copied your and his comments below and we have replied to the comments in RED; corresponding pdfs are attached. Andrew (DWR): Thanks for the call today. There's one more item I need to finalize the 401. The proposed coffer dam is a temporary impact and is considered a separate impact for accounting purposes from the boulder toe and boat ramp. What is the length of the proposed coffer dam impact? I assume it is slightly longer than the total impacts for the boulder toe and boat ramp (241 feet), but need a number from you. The total temporary impact from the coffer will be 247 LF. This impact will be done in phases. First the coffer will be used for the boat ramp and the boulder toe on the south/east of the boat ramp, then it will be shifted to the long section of boulder toe on the north/west side. Amanda (USACE): -Please show all impacts on the L04 Wetland Impacts map to include call outs for temporary versus permanent impacts for the boulder toe, versus boat ramp, versus coffer dams (in addition to wetland impacts). This map should correspond to an updated impact table from the PCN. Please see updated Sheet L04, attached. Updated PCN table also attached -Please clarify why the boulder toe is needed/proposed and include a detail/plan sheet The boulder toe(s) are necessary to maintain and enhance bank stability and prevent upstream and downstream erosional issues once the boat ramp is in place. For detail see 1/1-16.3 in the plan set we provided. - After reading through Byron's/USFWS letter they did not request that a survey for Elktoe be conducted however that may change once he realizes the coffer dams are in the river. We can talk more about what this would mean coordination and timing wise but it would have some implications on the project if a survey was required and mussels were found. With that said, I think it would be beneficial to also address why a coffer dam / in river work is needed in the first place. I have permitted boat ramps before and they were able to be constructed from high ground so not sure what the difference is with this one. Again if a survey is required and mussels are located then those are some more detailed discussions that will be needed. A coffer dam is needed to satisfy 401 permit requirements; when construction work is proposed below the Ordinary High Water Mark (OHWM), DWR requires the use of 'work -in -the -dry' techniques to reduce or avoid sedimentation impacts to the resource. Because we are proposing to install boulder toes below the OHWM both upstream and downstream of the boat ramp, which are necessary to maintain bank stability and prevent erosional issues once the ramp is in place, DWR is requiring the use of coffer dams, which we have situated partly in the river based on site conditions. Per yesterday's discussions, USFWS and NCWRC will soon be coordinating to evaluate the river bed impact areas for Suitable Habitat for elktoe mussels; if mussels are located within the impact area, streamlined consultation will occur with those agencies in order to collect and relocate the mussels prior to in -stream work. -Byron's/USFWS letter recommends surveying for active eagle nesting in the vicinity. This would be a condition of our permit so a heads up there to go ahead and start coordinating that to determine if an active nest is present and if that would affect your construction timeframe. Upon desktop review of available geospatial data, including the NCNHP Element Occurrences layer containing rare species locations, no known bald eagle nesting sites were found to be located within a meaningful proximity (<4.0 linear miles) of the site. Furthermore, extensive onsite evaluation of the site as part of the design and planning process yielded a detailed sealed survey of the site that includes callouts of trees larger than 12" in diameter; these trees are scattered sporadically across the site and while some occur on the berm, most occupy the margins of the site boundary or low points along the shoreline of the French Broad River (see attached survey). A simple visual assessment of the existing trees onsite yielded no observations of bald eagle nests; furthermore, it is our opinion that the species of trees present onsite, including mainly boxelder and sycamore, are not typically used by bald eagles for nesting purposes (evergreens extending into the superstory are generally favored). Based on the above evidence, it is our opinion that there are no bald eagles onsite or nearby, and that proposed project activities are not likely to affect nesting or foraging grounds for the species. Furthermore, we are looking forward to Byron and Andrea's coordination and hope that they can complete the Suitable Habitat survey sooner than later! Regardless of what they find I am excited to be going through this regulatory and permitting phase of the project, it's new to me and I am learning a lot from the process.
