Director Division of Water Quality DWQ EXP# 06-1592 Vance County Subject Property: NOTICE OF VIOLATION AND NOTICE OF INTENT TO ENFORCE Cameron & Associates Tract Parcel ID: 040902002 (Tract 1 A) Removal of Use Dear Mr. Keeter: On March 15, 2007, Lia Myott, Cynthia Van Der Wiele, and Karen Higgins from the Division of Water Quality (DWQ) visited the subject property located south of Highway 158, approximately''/z mile west of Poplar Creek Road in Vance County, North Carolina. During the site inspection, the investigators observed and noted impacts to an unnamed tributary to Poplar Creek, Class C, NSW Waters in the Tar-Pamlico River Basin. Sediment accumulations of 3 inches to 4 feet deep were observed in the stream for approximately 900 linear feet from the power line easement near the Corporate Express stormwater pond to the power line easement on the west side of the Catholic Church property. Immediately upstream from the former equipment crossing, the sediment accumulation is greater than 4 feet. Downstream from the former equipment crossing to the Catholic Church property boundary, the sediment accumulation ranges from 5 inches to 2 feet. On the Catholic Church property, the sediment accumulation ranges from 3 to 8 inches. Based on review of DWQ files, we have not identified any Pre-Construction Notification or any authorization, permit, or 401 Water Quality Certification from the Division of Water Quality. As a result of the site inspection and file review, the following violations are noted: (1) Other Waste (In-stream Sediment) The deposition of sediment in the stream represent violations of North Carolina stream standard Title 15A NCAC 02B .0211 (3)(f), which states that oils; deleterious substances; colored or other wastes: only such amounts as shall not render the waters injurious to public health, secondary recreation or to aquatic life and wildlife or adversely affect the palatability of fish, aesthetic quality or impair the waters for any designated uses; Requested Response You are directed to respond in writing within 20 days of receipt of this Notice.
