DANIEL SMITH Director NORTH CAROLINA Environmental Quality June 10, 2020 DWR # 2020-0602 v1 Hyde County Williams Landing Enterprises, LLC ATTN: Lee and Madge Williams 275 Landing Road Swan Quarter, North Carolina 27885 Subject: REQUEST FOR ADDITIONAL INFORMATION Williams Landing — CAMA Major application Dear Mr. and Mrs. Williams: On May 06, 2020, the Division of Water Resources (Division) received a copy of your CAMA Major application with additional information received dated May 27, 2020, requesting a 401 Water Quality Certification and Tar -Pamlico River Basin Riparian Buffer Authorization from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Avoidance and Minimization of Impacts to the Tar -Pamlico River Basin Buffer a) The plans show Slips 1-4 located on the peninsula near an upland area. It is not clear if vegetation removal is necessary for the establishment of these slips, particularly Slips 1 and 2. Consideration should be given to removal of the end slip(s) to insure impacts to the riparian buffer do not occur initially and that encroachment does not occur into the buffers or wetlands over time. b) It is not clear from the application if you are requesting any sort of authorization or variance from the Tar -Pamlico Riparian Buffer Rules for the proposed impervious surfaces associated with the wash -down pad that would be placed in the relocated buffer, but if so, then please provide justification for how these impacts cannot practically be avoided or minimized, as well as a table with the proposed square footages of impact within the buffer. These impacts may require mitigation, if approvable. As part of the requirement for the relocation of the riparian buffer upon creation of the upland basin, it is expected that you will re-establish Zone 1 and Zone 2 as described in 15A NCAC 02B .0259 (4), and the relocation of the riparian buffer. Wastewater Management System for Onsite Boat Wash and Maintenance Facility: Please provide plans for the project that outline what permitted wastewater disposal options will be utilized for boat wash wastewater management to complies with permitting requirements of 15A NCAC 02T .1003(a)(3). In addition, a more detailed Operation and Maintenance plans for the proposed facility will need to specifically address how all overspray water generated during wash down will be contained (via curtains to enclose the boats or within a building). Also, the plan will need to provide specific details regarding the removal of excess residual of the wash down pad to ensure stormwater discharge does not become a wastewater discharge. [15A NCAC 02H .0506(b)(3)] Information within the permit application states that wastewater generated from the facility would be sent to the Swan Quarter Sanitary District. The acceptance of this waste should not be reason for Swan Quarter Sanitary District to request in the future an expansion of their facility nor should it change or compromise their ability to stay compliant with their permit requirements. 3. NCG190000 for Marina Plan: Based on a review of your application, the Division will require documentation that a NCG190000 application has been submitted to the Division of Energy, Mining, and Land Resources [15A NCAC 02H .0506(b)(3)]. An Operations and Maintenance (O&M) Plan for the facility may be required and should be submitted to DWR for review. Pursuant to 15A NCAC 2H. 0506 (6)(f) and Title 15A NCAC 02H .0506 (6)(g), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending three copies of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. Please be aware that you have no authorization under the Neuse Riparian Buffer Rules for this activity and any work done within riparian buffers or waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
