I o) E5 fc EjV/ice ?ry DENR • WATER QUALITY WETLANDS AND 5 TOR4 Yl.4TER SPANCH Mr. Forest Turner 1904 Eastwood Road, Suite 212 Wilmington, North Carolina 28403 Dear Mr. Turner: On September 21, 2009, you applied for Department of the Army (DA) authorization to discharge approximately 0.02 acres of fill material into Section 404 jurisdictional wetlands to facilitate the development of a single family residential dwelling within an existing subdivision known as Treybrooke. The 0.46 acre project area is located at 216 Sand Hills Drive East, on the west side of Masonboro Loop Road, in wetlands adjacent to the Hewlett's Creek, Wilmington, New Hanover County, North Carolina. The file number assigned to your application is Action ID SAW-2009-01004. Please refer to this number in all future correspondence. The attached letters have been received from state and federal agencies, private citizens and private organizations: On November 24, 2009, this office received a letter from the North Carolina Department of Environment and Natural Resources (NCDENR) Division of Coastal Management (DCM) stating that your proposed project "requires consistency review from DCM before the project may be implemented". The NCDENR Division of Water Quality (DWQ), by letter dated November 25, 2009, requested additional information to address a mitigation proposal for the 1.54 acres of total cumulative impacts for the Treybrooke development. In addition to this, DWQ recommended avoiding impacts by constructing a "slightly smaller house footprint or proposing to construct a two-story house". Our Office received your response to the later comment in a letter dated 12/17/09. On December 3, 2009, a letter was received from the United States Fish and Wildlife Service (USFWS) offering no objections to the project. January 7, 2010 Ms. Loretta E. Thomas, adjacent landowner, submitted comments received by this office on December 17, 2009. Concerns listed include flooding and drainage, future permitting and restrictions on land use and value. -2- Mr. and Mrs. James Brothers, also adjacent landowners, voiced their concerns regarding flooding and drainage in a letter dated December 15, 2009. Finally, in an email dated 12/21/09, Mr. Eason Bryan, Vice President of the Treybrooke Homeowners Association, submitted a list of concerns also with regards to flooding and drainage.
