Dear Mr. Mathews,
On behalf of the Wake County Facilities Design & Construction Department, Hazen and
Sawyer is providing notification that the County intends to perform maintenance and repairs to
portions of the restored stream at the above referenced facility. As observed during our field
visit on January 5, 2010, portions of the stream banks on the floodplain reaches of the restored
stream have experienced scour and erosion due to extremely high stream flows which occurred
shortly after the stream was constructed, but before affected areas could be properly stabilized.
In addition, concentrated return flow from the newly constructed floodplain has further eroded
some stream banks. These repair areas were described in the Annual Monitoring Report Year 1
(2009) prepared by Axiom Environmental, Inc. and submitted to the USAGE on November 18,
2009.
Due to the hydraulic characteristics of the watershed of the restored stream, the need for
such repairs was anticipated, especially in the first one to two years after completion. For this
reason, we believe, and the USACE and DWQ concur, that the required repairs will be
authorized under a Corps of Engineers enforcement action and would therefore not require a
404/401 permit modification.
Repairs will include re-contouring eroded stream banks, reshaping point bars,
construction of a series of log vanes in banks, and constructing floodplain interceptors to assure
non-erosive return of concentrated overland flow. A site plan with the proposed repairs is
attached as well as details for the log vanes and floodplain interceptors. Any areas disturbed
during repairs will be stabilized by matting as appropriate and seeding. The work will be
monitored on site by representatives of Axiom Environmental, Inc. and Hazen and Sawyer.

As we discussed during the January 5 site visit, the County intends to contract with Land
Mechanics Design, the contractor for the original stream restoration, to complete the repairs and
to stabilize disturbed areas as the repairs are completed. This work is scheduled to begin in the
next two weeks and is expected to take about four weeks to complete, weather permitting. We
will notify your office once the repairs are completed and new structures such as log vanes will
be included on the Record Drawings.
Hazen and Sawyer appreciates USACE's interest and cooperation in this matter.
Representatives of Wake County, Hazen and Sawyer and Axiom Environmental are available to
