Subject: Cripple Creek Stream and Wetland Mitigation Bank; Final Mitigation Banking
Instrument and Signature Page

Enclosed is a final copy of the Mitigation Banking Instrument (MBI) and final Mitigation Plan for
the proposed Cripple Creek Mitigation Bank., This bank proposes to generate up to 4,518 stream
mitigation credits and 7.85 wetland mitigatiori credits:to be offered for sale for compensatory
mitigation for stream and wetland impacts in Cape Fear 02.
As a member of the Interagency Review Team (IRT) DWQ personnel visited the site on March
23, 2007. Comments on the site visit were provided to USACE in a letter dated April 11, 2007.
A Draft Prospectus and MBI were circulated in June 2008. Comments on the Prospectus/MBI
were provided to USACE in a letter dated July 25, 2008.
Based on additional information received, DWQ provided additional comments to USACE in a
letter dated July 10, 2009.
All of the issues raised by IRT members have been addressed, and the chair of the IRT (USACE)
intends to approve the MBI. Enclosed is a copy of the signature page from the MBI for your
signature. If you do not have any comments or concerns, please sign the signature page and
return the package to me. I will forward the signature page to USACE.
