Subject: Pretreatment Review of Industrial User Pretreatment Permit (IUP)

The PERCS Unit of the Division of Water Resources has reviewed the IUP renewal submitted by the City of
Kings Mountain for the following Significant Industrial User (SIU). The IUP was initially received by the
Division on May 14, 2020, followed by revisions received on June 3, 2020.

The review, with the observation and comments below, indicates that the IUP is adequate and the
minimum requirements of 15A NCAC 02H .0905 and .0916 and 40 CFR 403.8(f)(1)(iii) are met. Please
submit the additional or revised information, per the comments below, within 30 days of receiving the
letter.
1. Please submit a copy of the most recent industrial user on -site inspection, per 15A NCAC 02H
.0917, as it appears to be missing with the submission.
2. Please submit updated copy of allocation table (AT) as required by 15A NCAC 02H .0916. AT shall
be revised by control authority to reflect updated permit effective and expiration dates, IUP
limits, as well as any relevant information as IUPs are issued, renewed and or modified.
3. Control authority shall submit the basis, or rationale for pretreatment limitations, including
documentation of categorical determination, explanation of monitoring only parameters (BOD,
ammonia, and total phosphorus). Please refer to "Permit Writing Guidance" page on PERCS
website for some example of model IUP and synopsis, and submit updated IUP synopsis.
4. On the IUP limits page, there appears to be a typographical error, as it states 40 CFR type 3471
as opposed to 433.
5. Please remove the expired limits page as it appears to be appended at end of the IUP.
6. It appears that KMI used older version of the permit application. Newer version of permit
application is available on PERCS website, which was updated April 2012. In future, please ensure
industrial users complete the newer version of application.

Federal and State pretreatment regulations require the local delegated pretreatment program to
effectively control and document the discharge of wastewater from Significant/Categorical Industrial
Users to the POTW. It is the POTW's responsibility to ensure that these objectives are consistently met.
