USACE Comment 1) Because of this project's location within the Henderson Scott Farm District, an environmental review through the NC Department of Cultural Resources has been initiated (email sent April 2, 2020). We cannot verify your project's use of Nationwide Permit 39 without their concurrence. Applicant Response: The applicant acknowledges. USACE Comment 2) The road crossing that would impact the stream on -site is proposed with 3:1 side slopes. Please discuss why steeper slopes (e.g. 2:1) and the use of retaining walls are not feasible to further reduce impacts. Applicant Response: The 3:1 side slope up -gradient of the proposed building will be graded to tie into final building grading, which is anticipated to be near the top elevation of the road. The 3:1 side slope up -gradient of the culvert was shown to document that stream impacts were a result of the road crossing. The down -gradient portion of the culvert was designed with a 3:1 side slope to reduce safety concerns and will require less maintenance than a 2:1 side slope. The applicant considered the use of retaining walls on the down -gradient portion of the stream to further minimize slope impact to the stream. However, the cost of the retaining walls compared to the relative little amount of reduction of stream impact is not practical or a cost effective technique to further avoid impact to waters compared to other avoidance and minimization techniques utilize during preliminary design of the proposed facility that result in greater avoidance of stream impact. The applicant significantly reduced the square footage of the building and the overall disturbance limits of the proposed facility which has minimized impacts to avoid Section 404/401 Individual Permit. The applicant further reduced and minimized impact to the stream by lowering the elevation of the road and aligning the proposed road crossing as close to the building as possible. In doing so, the applicant further reduced the number of tractor docks and court spaces to align the proposed road as close to the building as possible while maintaining safe and appropriate turn radius, width, grade, etc. for safe tractor trailer accessibility. This design technique reduced the area of stream impact by at least an additional approximate 20 linear feet. The road alignment cannot be shifted closer to the building that proposed because of safety concerns associated with tractor accessibility and building structural design. USACE Comment 3) As shown on sheet C-101, proposed grading on the upstream side of the crossing appears to be designed to key into existing grades. Would the upper limits of this feature be preserved? Applicant Response: Please see applicant response 2. USACE Comment 4) If the answer to # 3, above, is no, there appears to be 60 or more feet between the proposed road crossing and facility's footprint. Please discuss why moving the road closer to the facility is not feasible. Applicant Response: Please see applicant response 2. USACE Comment 5) Please provide stormwater control plans for our review of potential dewatering impacts to receiving streams. Mitigation for dewatered stream length may be required. Applicant Response: The applicant has designed a stormwater BMP to discharge proximate to the most down -gradient limits of stream fill to supplement surface drainage area (attached). Based on preliminary calculations, it appears that approximately 30% or more of the existing intermittent stream drainage area will discharge proximate to un-impacted portions of the intermittent stream down -gradient of the proposed impact limits. Therefore, it is our opinion that de - watering of the remainder of the un-impacted streams on the site is not likely to occur. Sincerely, Bradley S.
