Dean with Croatan Surf Club, LLC, has requested the attached application be processed underthe
Express Permit Review Program, for the construction of a 36-unit condominium building underthe
name of the Croatan Surf Club.
The property is located at 1319 North Virginia Dare Trail in the Town of Kill Devil Hills, on NC
Highway 12 adjacent the Atlantic Ocean in Dare County, North Carolina. The proposed project site
comprises ±2.8 acres and is the old Quagmires Restaurant and Lounge site. The project site is
within the Ocean Hazard Area of Environmental Concern (AEC) as identified in North Carolina
Administrative Code 15A NCAC 07H.0304. All development within this area is subject to
authorization by the Division of Coastal Management.
The property is 1200' wide by 1610' deep. The old restaurant and lounge have been
removed with ±11,794 ft2 of concrete and gravel parking area and a section of retaining wall in the
area of the old restaurant remaining. The only other structure on the site is a chain link fence along
the road frontage, property lines and at the landward toe of the primary dune to prevent access to
the site. The majority of the site was cleared when the building was removed and most of this area
is void of vegetation. Some upland grass is present adjacent NC 12 and several yucca and cactus
plants are located along the north property line at the west end of the site near NC 12. The land
disturbance on the site ends at the 145'-AEC line. As you move east towards the ocean, a t70' wide
area is undisturbed up to the landward toe of the dune. This area is vegetated sporadically with
upland grass and Spartina patens. The dune has a base width of t90', top width of t45', is t26'
high and is considered a primary dune. It is vegetated with American beachgrass and S. patens.
The waterward side of the dune has a t3' cut face and this is also the first line of natural stable
vegetation as delineated by Lynn Mathis of DCM on 19 January 2007. The beach is ±30' to the
normal high water mark at this location.
The project site is bordered on the north (upstream) side by the Sea Oats condominium
complex. A wooden privacy fence runs the length of this adjoining property along the property line.
The project site is bordered on the south (downstream) side by a relatively new 12 bedroom single-
family residence that was constructed well landward of the existing setback for this area. A PVC
privacy fence runs the length of this adjoining property along the property line. Both adjoining
properties have wooden walks over the dune to access the beach area.
The Atlantic Ocean is classified as SB by the Environmental Management Commission and
is open to shell fishing.
Project description
The applicant proposes to construct a 36-unit (30,766 ftz) condominium building on the site.
Seven of the units will be 2 bedroom and the remaining 29 units will be 3 bedroom. The structure
will be four stories tall including the ground floor concrete parking level. The proposed structure will
be located immediately landward of the large structure setback line which is 120' at this location.
The building will be constructed in a J shape with the bottom of the J facing the ocean. A covered
pool is proposed in the open interior area of the building. Two asphalt driveways will give access to
the uncovered asphalt parking areas as well as to the concrete parking area under the building and
create a circular or looped traffic pattern on the site.

In the 60' wide small structure setback area between the proposed building and the
landward toe of the primary dune, the applicant proposes to construct a recreation area divided into
three sections. Amain outdoor pool with an t8' wide concrete apron section will take up most of the
area with a kiddie wading pool area with an t5' wide concrete apron on the north end and a spa with
an t5' wide concrete apron on the south end. Freestanding bathrooms are proposed adjacent the
kiddie pool and the spa areas. The three sections will be separated by vegetated landscaped areas
that are 4' to 5' wide. The three pool areas described above will impact 17,226 ftZ of area including
the decks and access ramps.
Access to the beach will be via two 4' wide wooden ramps that will originate at either end of
the main pool area and connect along the landward crest of the dune. Two - 5' wide by 25' long
wooden decks are proposed adjacent the walkway along the landward crest of the dune. A single 4'
wide wooden walkway will project perpendicular to the crest of the dune with steps to access the
beach. A gazebo (1170 ft2) is proposed adjacent the beach access walkway on the waterward crest
of the dune. The total impact of the wooden walkways with decks and gazebo is 11,273 ft2 and will
be elevated above the existing vegetation.
The applicaht proposes to install a Stormtech Infiltration Trench System for stormwater
control. The bulk of this system will be installed under the proposed building beneath asphalt
parking, with a portion being install under the proposed asphalt parking area between the new
building and NC 12. A L.L.P. wastewater system including Advantex treatment units is proposed to
handle wastewater.
Anticipated impacts
The project as proposed will result in the disturbance of ±92,000 ft2 of uplands as a result of
the development activities. The project as proposed will result in construction of 18,594 ft2 (29.7%)
of impervious surface within the Ocean Hazard AEC associated with the construction of a portion of
the condominium, as well as the outside pools with concrete aprons. The construction of the beach
access will impact 11,273 ft2 of dune structure. The structure as proposed will create a negative
visual impact for the existing structure on the southern side.

This letter is with reference to the enclosed Express CAMA Major Permit Application and
plats for Croatan Surf Club, LLC c/o Mr. Clarence "Bud" Dean proposing to construct a
36 unit (101 bedroom) condominium complex "Croatan Surf Ctub" adjacent to the
Atlantic Ocean in Kill Devil Hills, Dare County, North Carolina.
Proposed project includes the construction of a 36 unit condominium complex including
three pools, decks, walkway and gazebo. This project also includes an on site LPP
wastewater system and underground utilities. This project has been approved by the
Town of Kill Devil Hilts Planning Department. This project has previously been reviewed
by Lynn Mathis N.C. Division of Coastal Management Elizabeth City since August 17,
2006. Since the project has been held up from town review since August 2006, the
property owner would like to obtain an Express Permit to meet the towns requirements,
as quickly as possible. Ms. Mathis has visited this site with our staff on several
occasions; one of which was to restake the First Line of Stable Natural Vegetation
(FLSNV) on January 30, 2007, after the most recent winter storm.

Introduction and.Historv of Proiect
The proposed multi-family units project is located on 2.8 acres (4 lots) at 1323 N.Virginia
Dare Trail, in Kill Devil Hills, Dare County on the Atlantic Ocean. The proposed project
includes the construction of a condominium complex "Croatan Surf Club" (101 bedroom
complex) with onsite L.P.P. septic system, parking and utility. This site was the former
site of Quagmires Restaurant and Lounge. The former structures have been removed
from this site excluding concrete and gravel parking, and concrete retaining wall. This
project has been approved by the Town of Kill Devil Hills Planning Department.
N.C. Division of Coastal Management, Lynn Mathis established the first line of stable
natural vegetation (FLSNV) at this site on 1!30/07. The annual erosion rate for this area
is two feet per year. The proposed project was designed to be consistent with
07H.0306(a)(3). The site is currently zoned Ocean Impact Residential. This site is
currently located in NFIP Flood zone VE (EL. 12', NAVD 88 DATUM).
Existing Conditions:
Site was previously developed with a restaurant, concrete and gravel parking. There are
currently no existing structures at this time. Existing impervious areas include the
existing concrete and gravel parking area (11,794 s.f}. The existing grade is 14.5 feet at
the large structure setback. The existing grade at the small structure setback is 14.2
feet. The existing Primary dune elevation is 26'. First line of Stable Natural Vegetation
(FLSNV} is currently at the top of the dune and was restaked by Lynn Mathis of N.C.
Division of Coastal Management on 1-19-07, after a Fall storm. The 145' CAMA AEC
line is 25' west of the 120' large structure setback. Existing vegetation consists of
American beach grass, wire grass, dune grasses and flowers. Adjacent riparian
properties are Sea Oats Condominium Complex (north) and a 14 bedroom dwelling
(south).
Proposed Proiect _and Construction Methods:
The proposed project includes the construction of a three story condominium complex
"Croatan Surf Club" consisting of 7two-bedroom units and 29 three-bedroom units with
underneath parking. A covered pool is proposed in the center of the building with a pool
fence around the piling supported roofed perimeter. Amain outdoor pool, wading pool
and spa with concrete decking (7,226 s.f.) are proposed east of the proposed building.
Open landscaped areas are located outside the pool bibs. East of the pool area are two
four foot wide (north and south) ramp walkways to access two decks, a gazebo, walkway
and stairs to access the beach (1,273 s.f. decking including 170 s.f. gazebo). Open
asphalt parking/curbing, and one concrete dumpster pad {15,412 s.f.) is proposed for the
condo-complex (excluding underneath parking}. An on site L.P.P. wastewater system is
proposed with a repair area, west of the proposed condo-complex to include Advantex
treatment units (607 s.f.).

The structure proposed is a three story wood frame structure (30,766 s.f.) on a concrete
piling foundation with ground level parking (entrance and parking 14,878 s.f). Ground
level concrete parking area includes 101 parking spaces (includes 10 space reserve). A
detached outdoor main pool, spa, and wading pool with concrete deck (7,226 s.f.) is
proposed eight (8') feet from the structure accessed by a detached handicap ramp and
walkway (330 s.f.). Two four foot elevated walkways accessing two decks (125 s.f.
each), a gazebo (170 s.f.) with one four foot walkway and stairs to access the beach. An
on site L.P.P. wastewater system will be installed to service the 36 unit (101 bedrooms)
complex. The proposed L.P.P. wastewater system and repair area will be located west
of the proposed structure. A concrete pad for one dumpster is proposed on the west
side of the complex (285 s.f.). Stormwater will be handled using subsurface "Stormtech"
infiltration trench system {223 "Stormtech" chambers to be placed under concrete
parking areas).
The existing grade is 14.5 feet at the large structure setback. The existing Primary dune
elevation is 26'. The existing grade at the small structure setback is 14.2 feet (also toe
of Primary dune). Site (excluding dunes) will be graded and smoothed with a frontend
loader with a box blade to a final grade of 14.5 feet at the east end of the building, and to
a final grade of 10.5 feet at the west end of building, and to a final grade of 7.0 feet
towards Highway 12 (Virginia Dare Trail). Concrete will be trucked in from a commercial
source to pour the concrete slab for the proposed building. The remaining portion of the
vegetated frontal dune will be left undisturbed; excluding the construction of a gazebo
(170 s.f.) elevated walkways, decks (2) and walkway to access the beach {1,103 s.f.).
Total square footage of wood walkway and decking with shower 1,073 s.f. (excluding
gazebo (170 s.f. impervious due to roofing)). Dune top wood walks, shower, decks and
gazebo will be elevated above existing vegetation and shall not alter dune elevation. A
crane, and other heavy equipment will be utilized to construct the condominium complex,
which will be stored on site while construction takes place. The proposed condominium
complex structure will be constructed at the large structure setback. Site is currently
located in NFIP Flood Zone VE (EI. 12', NAVD 88 DATUM). Existing Primary dune
elevation is 26'. Site zoning is Ocean Impact Residential. Utilities serving this site will
be placed underground. Decking, gazebo and wooden walkways will be constructed
using hand tools.

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as feet landward in a major storm.~V~ z~YZe)
The flood waters in a major storm are predicted to be about
feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.
Without the proper signature, the application will not be
complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for development in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tantthat you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.
