Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
This final permit contains no significant changes from the draft you were sent on January 30, 2008.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act of any other
Federal or Local governmental permit that may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of
this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
Tuckaseigee Water and Sewer Authority is hereby authorized to:
1. Continue to operate an existing 1.5-MGD wastewater treatment plant consisting of the
following unit processes:
• Aerated grit removal
• Flow equalization
• Activated sludge with secondary clarification
• Chlorination
• Dechlorination
The above facilities are located at the TWSA WWTP # 1 on River Road (NCSR 1359), south
of Sylva in Jackson County.
2. Discharge from said treatment works at the location specified on the attached map into
the Tuckasegee River, which is classified C-Trout waters in the Little Tennessee River
Basin.

1. The monthly average effluent BODs and Total Suspended Solids (TSS) concentrations shall not exceed 15
percent of the respective influent value (85 percent removal).
2. Toxicant sampling should be conducted on the same date that chronic toxicity testing is performed.
3. Whole Effluent Toxicity shall be measured by chronic toxicity (P/F, 1.4%) during the months of February,
May, August and November. See Part A. (2.) for details.

A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodapfuria
dubia at an effluent concentration of 1.4%. -
The permit holder shall perform at a minimum, ung rterly monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina
Phase 11 Chronic Whole Effluent Toxicity Test Procedure' (Revised -February 1998) or subsequent versions. The tests will be
performed during the months of February, May, August and November. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit,
then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described
in "North Carolina Phase 11 Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration
having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable
impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes,
and further statistical methods are specified in the "North Carolina Phase 11 Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring
Form (MR-1) for the months in which tests were performed. If reporting pass/fail results using the parameter code TGP3B,
DWQ Form AT-1 (original) is sent to the below address. if reporting Chronic Value results using the parameter code
THP3B, DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30.days after
the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total
residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name,
permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment
area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required
during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality
indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate
monitoring requirements or limits.
If the Permittee monitors anc prdlutant more frequently then required by this permit, the results of such monitoring Shall be
included in the cak:ulation Z reporting of the data submitted on the DMR K all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival,
minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the month of the
initial monitoring.
A. (3.) SPECIAL CONDITION FOR SEWER LINE CONNECTIONS Permit NC0039578
Sewer lines serving more than one building, crossing property under separate ownership, or crossing rights of
way, shall not be made tributary to the collection system serving this facility unless a permit for the construction
and operation of the tributary line has been issued by the Division of Water Quality.

Biologists with the North Carolina Wildlife Resources Commission (Commission) reviewed the
information regarding the proposed NPDES permit renewal for the Tuckaseigee Water & Sewer
Authority W WTP. The permit allows the discharge of 1.5 MGD of treated waste to the Tuckaseegee
River in Jackson County. Comments from the Commission are provided under provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General
Statutes (G.S. 113-131 et seq.), and the North Carolina Administrative Code 15A NCAC 101.0102.
The Tuckaseegee River is designated an Aquatic Significant Natural Heritage Area of national
significance because of numerous rare aquatic species. It supports the federally endangered Appalachian
elktoe mussel (Alasmidonta raveneliana) and olive darter (Percina squamata, FSC, NC -SC). Because of
this, compliance with discharge limits and instream water quality standards (1 SA NCAC 02B .0211) is
particularly important with this facility.

I. Proposed Changes Incorporated into Permit Renewal
• Remove cyanide and cadmium monitoring requirements due to lack of reasonable potential
for these parameters to cause exceedances of applicable water quality standards.
• Reduce silver monitoring to quarterly to coincide with WET test.
II. Summary
Two segments of the Tuckasegee River are newly listed on the draft 2008 303(d) list for fecal
coliform. According to the 2007 Little Tennessee River Basin Plan, fecal coliform levels
throughout two reaches of the Tuckasegee River are elevated. Although there are several
W WTPs in the area, levels are higher than effluent levels from the W WTPs would indicate, which
"suggests that sources other than the treatment plants are contributing to the impairment".
A 2002 speculative limits request recalculated streamflows resulting in slightly lower values than
what has been used in permit renewals. The streamflow estimates will remain the same for this
renewal, however they should be modified if the facility should apply for expansion.
In September 2006, TWSA entered into a Special Order by Consent (SOC) with the Division
allowing slightly increased BOD, TSS, and fecal coliform limits until July 2011. During the course
of the SOC, TWSA is required to meet milestones pertaining to the planning, design, and
construction of upgrades to its aging WWTP. As of the time this fact sheet was written, DWQ
had received several comments on an SOC amendment and TWSA indicates that an
Environmental Assessment (for a proposed expansion) is forthcoming. Any potential issues
arising from the SOC and/or possible expansion will be handled separate from the permit
renewal.

DMR Data Review
DMRs were reviewed for the period of November 2005-October 2007. A summary of monthly
average values is summarized below in Table 1. The facility is currently at a monthly average of
61%, capacity with a maximum monthly average at 75%capacity. TWSA had problems meeting
BOD, TSS, fecal coliform, and occasionally pH limits over the course of the permit, resulting in an
agreement to enter into a SOC.

The facility is not required to perform instream monitoring due to its low industrial contribution
and the relatively high streamflow (1.4% IWC).
RPA Analysis
RPAs were performed for the toxicants cadmium, cyanide, copper, zinc and silver.
For cadmium and cyanide, the maximum predicted concentrations did not show reasonable
potential to cause exceedances of water quality standards, therefore monitoring will be removed
from the permit. Levels of copper, silver, and zinc did show reasonable potential to cause
exceedances of acute action level criteria therefore quarterly monitoring will remain. Quarterly
monitoring will be required to correspond with WET testing.
WET Test Results
TWSA Plant #1 has a chronic WET testing requirement at 1.4%effluent concentration. The
facility has passed 18/19 quarterly tests administered since February 2004. The single failure was
in November 2004 and the facility passed the two consecutive tests following that failure.
Correspondence File Revieto/Conipliance History
TWSA has accumulated $19,750 in penalty assessments since 2005 based on numerous violations
of its BOD, TSS, pH, and fecal coliform limits. According to several Technical Assistance Visits
conducted by the Asheville Regional Office, Plant #1 is an aging, out of date system that offers
little treatment flexibility. In addition the collection system experiences high 1/1 which has
resulted in very high flows during wet weather. During the Technical Assistance Visits, the
regional office recommended upgrades to the collection system, clarifier, equalization basins, and
digester. The facility is currently under a SOC with specific construction milestones in order to
upgrade its aging treatment process.
IV. Proposed Schedule for Permit Issuance
Draft Permit to Public Notice: January 30, 2008
Correspondence Review
12-22-05 — Receipt of signed Special Order by Consent.
12-20-05 — Notice of Violation and Assessment of Civil Penalty. $2100 penalty for 9/05 limit
violations (two weekly average TSS violations).
10-31-05 — Technical Assistance Inspection. The inspection notes that the 30 yr old plant is in
need of upgrades. The plant is being run reasonable well considering the lack of
operational flexibility that other facilities have.
9-30-05 — Compliance Evaluation Inspection. The facility was found to be in compliance with
their NDES permit.
9-6-05 — Notice of Violation for exceedance of the monthly average BOD limit.
8-30-05 — Notice of Violation and Assessment of Civil Penalty. $5,600 penalty for 4/05 violations
of 3 weekly average BOD limits, monthly average BOD limit, 2 weekly average fecal

Facts on TWASA # 1 (they have other plants - but this is the one we believe Mr. Cline is
concerned about):
TWASA is currently permitted at 1.5 MGD. TWASA's average flow during the past 12
months has been 0.901 MGD (please keep in mind our drought year, which would
inherently show lower annual flow values).
TWASA is under a Special Order by Consent (issued 12/6/06) - the SOC allowed 0.25
MGD of additional flow while under the Order (the SOC "relaxed" limits for BODS, TSS,
and Fecal coliform while TWASA refurbishes and/or expands the wastewater treatment
plant; TWASA had been out of compliance with these permitted pollutant limits so
DWQ offered TWASA the option of an SOC). TWASA must obtain compliance with its
NPDES permit by 4/2011 (and certain milestones must be met during that time period).
Under the SOC - TWASA needs to either make improvements to be able to treat the flow
it is receiving (this is what we thought originally) or apply for an expansion to the plant
to add more flow if the county is growing quickly (which is what they realized they
needed to do).
On 10/ 12/2007 - the NPDES program received a request for an amendment to the
SOC. This involved an increase in flow allocation of 0.35 MGD (as stated above -
TWASA previously requested 0.25 MGD of additional flow). As TWASA requested an
increase to flow added under the Order, by statute/rule DWQ is required to ensure that
the receiving stream is protected and water quality standards are met under the Order.
As of 10/25/2007 - the NPDES program asked for additional information from TWASA's
consultant to justify the flow increase while under the Order. Their consultant
responded 10/26 and plans to get us that information by 10/31/2007. As stated
previously - a water quality model must be run for this increase - which likely will be
completed in 30 days (and we're proceeding forward with it already). However - the
amendment must go back out to public notice (45 day notice period) - this is a state
rule requirement. Barring public comment - the NPDES program anticipates the
amendment being completed within 90 days. Other than review of the water quality
model - there is no way to decrease the time of this process. The public process
excludes flexibility with both SOCs and NPDES permits (due to rule requirements).
NPDES West gave TWASA speculative limits for various flow increases (up to 4 MGD) on
3/ 1 /2006. TWASA requested an expansion at the same time that they requested their
NPDES permit renewal - but we had to return the expansion request (5/30/2007)
because no Environmental Assessment (EA) had been performed. If they request an
increase in flow above 0.5 MGD - TWASA is required to go through the EA process,
which can be quite arduous as it involves inputs from multiple agencies including
USF&WS, NC Wildlife Resources, Natural Heritage, etc. [this is a state rule
requirement]; the NPDES program believes this is the most time consuming part of the
process for TWASA; in some cases this process can take up to two years.
If they request loan monies - they need to go through Construction, Grants, and Loans
Section (CG&L) of DWQ for the EA. Since the NPDES program has completed
speculative limits for increase in flow - once the EA is finalized to the satisfaction of the
various agencies (and the EA includes a proper Environmental Alternatives Analysis
(EAA) outlining alternatives to discharge) - the NPDES program can place the expansion
permit to public notice [also a state rule requirement which takes at minimum 45 days].

At this time - TWASA has not submitted any EA information to CG&L or the Planning
Section of DWQ. This is unexpected as TWASA was told of this matter in May of this
year via letter.
Unless there is outstanding public comment - the NPDES process for expansion should
go quickly (likely 2-3 months); for the most part, the NPDES program has issues with
incomplete EAA's - but in this case, that should be resolved with the Environmental
Assessment (which should be a benefit to TWASA).
Once the NPDES permit is drafted - an Authorization to Construct permit can be issued
by Construction, Grants and Loans (at risk to the permittee, depending on public
comments - but many POTWs take this risk - they just cannot award a contract until
after issuance on the NPDES permit).
Their NPDES permit renewal is in-house, under review (this has no effect on current
actions). If TWASA believes this does have an effect on the current process - that's a
misconception the NPDES program needs to resolve.

Sludge Management Plan
The Tuckaseigee Water and Sewer Authority in Jackson County currently treats residuals
generated by the three facilities currently owned by the Authority, plus the residuals
hauled from septic tanks located in Jackson County. Residuals generated by temporary
facilities required by the County Health Dept. to be available at new home construction
sites (porta-johns) are also accepted by the TWSA for treatment.
In calendar year 2006 these residuals were totaled as follows:

Septage and Porta-John trucks dumped directly into the digestor and totals were not
available for 2006, however with the addition of a septage receiving station in late 2006,
these totals will now be monitored.
Sludge from all sources is mixed and digested in an aerobic digestor with 285,000 gals of
capacity. After digestion, the waste sludge is pumped to the belt press for dewatering.
This is accomplished with a piston pump manufactured by Komline- Sanderson. The
pump is capable of pumping 100gpm of digested sludge to the belt press.
The 1.2 meter belt press is manufactured by Komline-Sanderson and produces dewatered
sludge with an average % solids concentration of 18%. Dewatered sludge cake is then
augered out of the press building to a lime pastuerization process manufactured by RDP
Company.
In this process, dewatered sludge is mixed with quick lime (CaO+) at approximately 1.5/1
lime to sludge ratio to generate enough heat and ph values to meet pathogen and vector
reduction levels specified by EPA 503 regulations. The sludge and ;ime are mixed and the
resulting mixture and temperatures are contained in a pastuerization vessel for a minimum
of 30 minutes to stabilize the residuals for beneficial reuse. After a 24 hour curing time to
make sure residuals retain the ph values for suppression of vector attraction the residuals
are made available to local farmers for use as a liming agent on pastures or crops.
Because the residuals meet the requirements for a Class A "high quality" sludge there are
few restrictions on the use of the residuals. These restrictions are outlined on the form
given to all users of the product. This form also makes recommendations for application
rates and gives an analysis of the product.

The Division of Water Quality (DWQ) is returning a portion of your permit application for the
Tuckaseigee Water & Sewer Authority (-fWSA) Plant #1 NC0039578. The permit application (EPA
Form 2A) has been retained in order to proceed with the renewal for TWSA Plant #1 (as this permit
expires October 31, 2007).
However, the Western NPDES Program cannot retain and process TWSA's request for expansion to
3.5 MGD. A proposed increase of 0.5 MGD or more of wastewater flow for a municipal facility
triggers the State Environmental Policy Act (SEPA) review in the form of an Environmental
Assessment (EA) or Environmental Impact Statement. The NPDES Program cannot accept an
application for expansion until Departmental review of the SEPA document is complete and a Finding
of No Significant Impact (FONSI) has been submitted to the State Clearinghouse for circulation.
