HomeMy WebLinkAboutNC0003425_SOC (issuance)_20180101NORTH CAROLINA ENVIRONMENTAL MAIAGE.MENT CO:itISSION COUNTY OF PERSON IN THE MATTER OF NORTH CAROLINA NPDES PERMIT No. NCO003425 HELD BY CAROLINA POWER b LIGHT COMPANY ROXBORO STEAM ELECTRIC PLANT SPECIAL ORDER BY CONSENT EMC uQ NO. 86-11 Pursuant to provisions of North Carolina General Statute 143--215.2, by and between Carolina Power 5 Light Company, hereinafter referred to as CP4L, and the North Carolina Environmental YanaRement Commission, an agency in the State of torch Carolina, hereinafter referred to as the Commission; 1. The Company hereby stipulates the following facts: (a) CP&L holds North Carolina NPDES Permit No. NC0003425, for operation of an existing treatment works and making an outlet to Ayco Lake, waters of this State; (b) On November 8, 1984, the Commission adopted Regulation 15 NCAC 2B .021I, fresh surface water classifications and standards, which reduced the water quality standard for selenium in ponds, lakes, and reservoirs from 10 ug/l to 5 ugh effective on January 1, i985; (c) CPbL is now discharging wastewater, hue based on historical data, is not able to comply with the revised selenium water quality standard in Hyco Lake and will not be able to comply with the selenium effluent limitation to protect this standard when the NPDES Permit No. NCO003425 is reissued. (d) Until such time as CPbL can comply with adopted water quality standards, CP6L may cause and contribute to pollution of the named waters; (a) The Company is subject to N. C. General Statute 143-215.1, and is within the jurisdiction of the Commission as sat forth in Chapter 143, Article 21 of the North Carolina General Statutes; (f) The Company hereby waives its right to a hearing on the terms of this Special Order by Consent pursuant to procedural requirements of the N. C. General Statute 143-215.4 and Commission rules In, 15 NCAC 2I and also hereby naives the right to appeal this Special. Order by Consent in accordance with N. C. General Statute 143-215.5. r.�__ A.4! -. n^AV-n 1 -rl '1f %AI r%--..._.....a nn or r71-A -141ne 1-1'7 n--- n -4 -z- {g) CP&L owns and operates the Roxboro Steam Slectric Plant located in Person County near the Town of Roxboro, North Carolina. Fyco lake is an integral part of this steam electric generating facility. (h) CP&L has requested that the 'qoxboro Plant NPDES Permit 0a . NC0003425) be renewed and anticipates that the renewed Permit gill contain an effluent limitation for selenium which will be designed to protect the revised water quality standard of 5 ug/l.. 2. CP&L, desiring to comply with water quality standards and with the conditions of the NPDES permit to be reissued, does hereby agree to do and perform all of the following: (a) :feet and comply with all terms and conditions of the permit except those effluent limitations identified in paragraph 1(c) above. (b) During the time in which this Special Order by Consent is effective, comply with interim effluent limitations for outfall serial numbers .001 and .002 contained in Attachments A and B. Limits and monitoring frequencies for all other outfalls remain as in NPDES Permit lo. NCO003425. The following reflects only the rr_ limitations that have been modified from NPDES requirements by this Order. Effluent Characteristics Discharge Limitations kg/dav_ (lbe/day) Daily Avg. Selenium 15.89 (35) (c) Upon execution of this Order, undertake the following activities in accordance with the indicated time schedule: i. Initiate fly ash landfill design by August 15, 1986. ii. Issue purchase order for the ash conveying system by October 15, 1986. iii. Initiate major mechanical and electrical system design by �r November 15, 1986. iv. Complete construction of modifications to the west ash basin by March 1, L987. V. Issue purchase orders for engineering procured material, review vendor proposals, prepare approved -for -construction drawings and specifications and issue contracting inquiry package by December 15, 1987. vi. Complete major contracting and procurement activities by June 15, 1988. viii. Provide the Director, Division of Environmental `tanagament, with a schedule of when each of the Roxboro Plant units will begin operation with the new dry fly ash handling system by September 15, 1988. ix. Complete construction and comply with final NPOES permit limitations on or before January 15, 1990. 3. CP&L shall submit interim progress reports to the Director, Division of Environmental Management, describing steps taken to achieve compliance with the requirements of this Order no later than 14 days after the deadline for completing each increment required in Section 2(c). Z. the Roxboro Steam Electric Plant must continue to comply with all conditions of 15 yCAC 29 .0211 with the exception of the selenium water quality standard. CPSL will comply with the previous selenium water quality standard of 10 ug/l until such time as modifications to the ash handling system as required in this Special Order are completed and in operation. The Commission recognizes that some time will be needed after CP&L complies with the required permit limitations before the crater quality of Hyco Lake reaches a selenium level in compliance with the new water quality standard. If CPQ complies with all the conditions of this SOC, they may request an extension of this Special Order regarding compliance with eater quality standards to allow the receiving waters time to recover after selenium discharges from the Roxboro Steam Plant have been significantly reduced. 5. As an interim measure to minimize selenium discharges until the fly ash handling system modifications as described under Section 2(c), CP&L shall enhance the existing ash pond by increasing retention time and improving ash sluice water circulation patterns. 6. Nothing contained herein shall prevent the Commission from assessing civil penalties pursuant to North Carolina General Statute 143-215.6 for violating any term or condition of this order. 7. CPfiL agrees that this Special Order shall pertain only to that equipment or source described in Section 1(a) of this Order. 8. Failure of CPfiL to comply with all provisions contained herein, shall subject CP&L to all sanctions provided by North Carolina General Statutes 143-215.6. 9. CP&L hereby agrees to waive any rights it may have to seek judicial review to challenge this Order or to seek a stay of enforcement of this Order.
