Dunn, Coastal Coordinator Habitat Conservation Division DATE: May 15, 2020 SUBJECT: CAMA Dredge/Fill Permit Application for Carteret Community College, Carteret County, North Carolina Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 3505 Arendell Street in Morehead City along the shore of and within Bogue Sound. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 1 i3A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a walking trail, two observation piers, docking facility with kayak launch, riprap refurbishment, and offshore sill with planting. Upland development includes walkways and accesses that will incorporate designs that take into consideration existing stormwater management and permits. The docking facility and kayak launch appear to have water depths around -3' NWL for the kayak launch and -6'for the slip as interpreted from the plans, though depths were not provided in the application or field report. The 1,125' sill is proposed to be 30' waterward NWL in some locations, measuring 12' wide and 4' high. The planting of Spartina alterniflora is referenced in the proposal. A NCDEQ meeting for this project was conducted on December 20, 2019. The Bogue Sound at this location is classified SA HQW by the Environmental Management Commission and is open to shellfish harvesting. The NCWRC has reviewed the permit application_ Staff attended the preapplication meeting and commented on the proposal at that time. Below are comments stated at the meeting and are reemphasized below: Mailing Address: Habitat Conservation • 1721 Mail Service Center • Raleigh, NC 27699-1721 Telephone: (919) 707-0220 • Fax: (919) 707-0028 • The NCWRC prefers no fill be placed in the water landward the sill to facilitate the planting of coastal wetlands. Coastal wetland species can be planted as appropriate for their success in existing conditions. Neither the permit application nor field report discussed proposed fill placement. The plans, however, did indicate fill. Often sediment accretion occurs in time. The planting of coastal wetlands can occur once the structure and site has equilibrated without the placement of fill in shallow water habitats. These shallow water areas provide important habitat areas for numerous aquatic species and should not be filled. • A submerged aquatic vegetation (SAV) survey should be conducted for the site. The plans indicate SAV is observed in the area, per NCDMF staff. Due to the amount of material placed in the water and concerns expressed by NCDMF, the NCWRC supports their request for a SAV survey. Structures should not be placed in SAV areas. • NCWRC supports requests made by NCDMF or Shellfish Sanitation to minimize shellfish impacts. This may include surveys or relocation of shellfish in an impacted area. There are areas of the project that may also affect leased shellfish areas. These interactions should be addressed. • The sill should be designed to have 5' openings for every 100' of sill. • The sill design should have a height of +1' NHW. This was discussed during the meeting but was . difficult to tell from the proposal if this is the current design. • The field report states the sill is 12' wide, but the application and plats indicate a 20' wide sill at the bottom. This width, especially in SAV habitat areas, should be reduced. This can be accomplished with a reduction in sill height, placement of segments behind rather than in front of the openings, or the use of vertical structures in front of sill openings.
