Dear Mayor Hardy:
In accordance with the application for discharge permit received on January 19, 1999, the
Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983.

The following proposed changes in the DRAFT permit have remained in the FINAL
The daily maximum limit for oil and grease was changed to a weekly average.
Addition of monitoring of the influent for BOD5 and total suspended residue, and a
requirement of 85% removal between influent and effluent samples (based on a
monthly average). This is based on a requirement for municipal dischargers.
The permit expiration date was changed to December 31, 2003.
In addition, the following changes has been added to the FINAL permit:
• Delete the instream (U,D) monitoring requirement for fecal coliform and
conductivity, base on the updated NPDES instream monitoring policy.
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed

27611-7447. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of
Water Quality. Part II, EA. addresses the requirements to be followed in case of change in
ownership or control of this discharge. The Division of Water Quality may require modification
or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality, the Division of Land Resources, the Coastal Area
Management Act, or any other federal or local governmental permit.

RESPONSE:
This agency has reviewed the draft permit and determined that the proposed
discharge will not be sufficiently close to any existing or know proposed
public water supply intake so as to create an adverse effect on water quality.
We concur with the issuance of this permit provided the facility is operated
and maintained properly, the stated effluent limits are met prior to discharge,
and the discharge does not contravene the designated water quality standards.

Facility located in subbasin above High Rock Lake; however, quarterly nutrient monitoring for
TN/TP already exists.
• DMRs. Limited data over past 2 years. Facility appeared to be closed from May 1997-Oct. 1998,
and—re'started 11/2/98 with same ORC. For the 6 active discharge months in 1997-98, facility
generally met permit limits. There was one BOD and one TSS exceedance (both monthly/weekly
avg). Ranges for monthly averages are: flow (0.005-0.001 MGD); BOD (6-35 mg/1); TSS (16-40
mg/1); NH3 (1-12 mg/1); fecal (2-5 orgs/I00ml); O&G (3-5 mg/1). TN concentrations ranged from
11-34 mg/I; TP concentrations ranged from 5-5.3 mg/l. Though not a limited parameter, monthly
max TRC concentrations have exceeded 5 mg/I several times, compared to a calculated safe
concentration of 0.072 mg/l. There was no consistent trend in upstream/downstream monitoring data.

Dear Mr. Weaver:
The Town of East Bend is formally requesting a renewal of the
permit for East Bend Industrial park (0064726).
The enclosed application has been completed. A check is enclosed
for permit fee.
We did not receive the application until 12/21/98. This was
probably caused by the permit being transferred from Yadkin
County to the Town of East Bend.
Our facility is pumped on a yearly basis by Lentz Septic Service
NCS #00147. This takes care of any sludge generated by this
system.
