Permit NC0020451' A (2) QUARTERLY CHRONIC TOXICITY PERMIT LIMIT (0.50 MGD) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 56.4%. The permit holder shall perform at a minimum, guarterl monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase I I Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP313 for the pass/fail results and THP38 for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NC0020451. A (3) EFFLUENT POLLUTANT SCAN The Permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table. The analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples shall represent seasonal variations. Unless otherwise indicated, metals shall be analyzed as "total recoverable." It discharges into a UT to Little Buffalo Creek, which is tributary to the New River. It was expanded to 0.50 MGD from 0.369 MGD in 2003. The West Jefferson WWTP has a modified pretreatment program through the Division of Water Quality's Pretreatment Unit. The only significant industrial user is Ashe County Cheese, which contributes 6800 gallons per day. Little Buffalo Creek, from the source to Buffalo Creek (4.4 miles) is impaired for ecological/biological integrity on the 2010 303(d) list. The stream has a fair bioclassification, which shows an improvement over its previous poor bioclassification rating. Other than this discharge, potential sources for the impairment include urban area runoff and storm sewers. The unnamed tributary of Little Buffalo Creek has a stream classification of C Trout +. The plus (+) symbol identifies the receiving stream as being subject to a special management strategy to protect downstream waters designated as ORW (outstanding resources water). West Jefferson's WWTP is located upstream of a segment of the New River that has been classified ORW. As a result, water quality standards will be halved (50%) for use in the reasonable potential analysis. COMPLIANCE SUMMARY: According to RIMS, violations of permit limits were noted for six exceedances of the weekly average for cadmium. The only other exceedance was an ammonia -nitrogen monthly average exceedance (4.94 mg/L vs. a limit of 4.0 mg/L), which resulted in an enforcement case. Additionally, there have been no failures of the toxicity test during the period from 2007 until the present. The facility samples 50 feet upstream and 200 feet downstream of the discharge point. From an analysis of individual data points, there were no documented violations of the instream DO standard of 6 mg/L either upstream or downstream of West Jefferson. In 2010, the DO downstream average was 92% of the upstream average. The results for 2009 were slightly better, with the downstream average 96% of the upstream average. Fecal coliform remained virtually unchanged from upstream to downstream for both years. Since the receiving. stream in not impaired for fecal, it is proposed to discontinue instream sampling for this parameter. Regarding conductivity, the upstream downstream comparison showed an increase of 18% in 2009 and 23% in 2010. See Table 2 below. Table 2. Considering these data and the fact that little Buffalo Creek continues to be 303(d) listed, this permit draft proposes to continue instream monitoring as performed presently, with the exception of discontinuing fecal monitoring. TOXICITY TESTING: This permit draft proposes to continue current quarterly testing of chronic Ceriodaphnia Dubia at the present instream waste concentration of 56.4%. REASONABLE POTENTIAL ANALYSIS: As stated in the summary section, water quality standards were cut by 50% in order to account for the "Trout+" classification. The following parameters of concern were evaluated and found that they had no reasonable potential to cause an exceedance to water quality standards in the receiving stream: Arsenic, total phenolic compounds, cadmium, chromium, molybdenum, lead, mercury, nickel, selenium, and silver. Although no hits were recorded over the last 300 data points for cadmium, it was noted that there was exceedances of the previous limit as recently as February 2009. Because of this, and Town of West Jefferson Fact Sheet NPDES Permit Renewal - NG0020451 the fact that the receiving stream is classified as trout waters which are more sensitive to cadmium, it is recommended that monitoring for cadmium be done at least quarterly. Due to one hit, beryllium was found to have reasonable potential. Since there was a limited dataset of only three samples, no limits will be applied but quarterly monitoring will be proposed. Cyanide was found to have a reasonable potential. It is now proposed to have monthly average and daily maximum limits, with a monthly monitoring frequency. Mercury was shown to have a maximum predicted concentration of 8.6 ng/L, which is below the actual WQ standard of 12 ng/L. Applying the half standard, and taking into account dilution, the limit would be 10.6 ng/L. Since there is no reasonable potential, the mercury limit in the existing permit will be removed. Because the maximum number is greater than 50% of the limit, quarterly monitoring will be proposed. The highest actual sampling value reported during this monitoring period (2007 to the present) was 6.6 ng/L. Copper and zinc both demonstrated reasonable potential. As action level parameters, they will be monitored quarterly, with no limits. As mentioned in the compliance summary, there have been no failures of the toxicity test from 2007 until the present. PROPOSED CHANGES: The following changes were made from the existing permit: • Changed the monitoring frequency for total copper and total zinc from monthly to quarterly. • Deleted the limit for total mercury and changed the monitoring frequency to quarterly. • Added a footnote for TRC, accounting for the Division's policy regarding maximum quantitation levels. • Removed condition A (4) regarding monitoring frequencies. • Due to reasonable potential to cause an exceedance of water quality standards, added limits and monitoring requirements for cyanide. • Deleted cadmium limits and changed monitoring to quarterly. • The requirement for instream fecal monitoring instream will be deleted. Total storage ability is approximately 250,000 gallons. Thorough aeration. and mixing occur within the digesters using coarse air diffusers. Measurement of PH is performed using a Sension 1 PH meter. An activity log is kept documenting dates of land application, PH, and temperature. We are using the 30 Day Bench Scale to satisfy the PSRP and Vector attraction reduction criteria. Samples are analyzed on the sludge per 503 regulations and soil samples are taken on the application sites annually. Once the contents of the digester meet PSRP and Vector attraction criteria, sludge is removed from the unit and land applied by surface method. Sludge can be transferred from any other digester to prepare it for surface application.
