The Instream Assessment Unit has reviewed the Draft SOC, EMC WQ No. 96 - 05 for the City of
Henderson - Nutbush Creek WWTP, NC0020559. The proposed SOC requests the addition of
domestic and industrial wasteflow with the relaxation of limits for lead and MBAS. Our
recommendations are as follows:

As this discharge is to a zero s7Q10 flow stream, any limits above those in the existing permit
would allow for instream violations of the standards. Therefore, rather than recommending
specific limits that would violate the allowable instream concentrations for Lead and MBAS, we
would instead recommend monitoring effluent and instream for these pollutants. lnstream
monitoring should occur approximately 100' above the discharge and approximately 50' below
the discharge. The facility should treat its wastewater to the best achievable levels for these
pollutants.
We also concur with the toxicity recommendations contained in this Draft SOC.

SPECIAL ORDER BY CONSENT
EMC WQ NO. 96-05
Pursuant to provisions of North Carolina General Statutes (G.S.)
143-215.2 and 143-215.67, this Special Order by Consent is
entered into by the City of Henderson, hereinafter referred to as
the City, and the North Carolina Environmental Management
Commission, an agency of the State of North Carolina created by
G.S. 143S-282, and hereinafter referred to as the Commission:
1. The City and the Commission hereby stipulate the following;
(a) That the City holds North Carolina NPDES Permit No.
NCO020559 for operation of an existing wastewater treatment
works and for making an outlet therefrom for treated
wastewater to Nutbush Creek, Class C waters of this State in
the Roanoke Raver Basin, but is unable to consistently
comply with the final effluent limitations for Chronic
Toxicity, lead, and MBAs set forth in the Permit.
Compliance will require the continued implementation of the
Toxicity Reduction Evaluation. This plan should consider
but is not limited to items contained in 2(b)(1). In
addition, the City has reported overflows from the sewer
collection system, especially Redbud pump station, and
elevated flows in the WWTP due to excessive inflow and
infiltration. Compliance will require preparation and
implementation of a plan to identify and reduce inflow and
infiltration into the sewer system.
(b) That, noncompliance with final effluent limitations
and unauthorized discharges of untreated sewage constitutes
causing and contributing to pollution of the waters of this
State named above, and the City is within the jurisdiction
of the Commission as set forth in G.S. Chapter 143, Article
21.
(c) That the City desires to cause or allow the discharge of
327,000 gpd of additional wastewater to the treatment works,
and that the discharge of such additional wastewater will
not result in any significant degradation of the quality of
any waters.

(d) That the City has secured financing for planning and
construction for treatment works which, when constructed and
operated, will be sufficient to adequately treat the
wastewater presently being discharged and the additional
wastewater desired to be discharged, to the extent that the
City will be able to comply with final permit effluent
limitations.
(e) Since this Special order is by Consent, neither party
will file a petition for a contested case or for judicial
review concerning its terms.
2. The City, desiring to comply with. the permit identified in
paragraph 1(a) above, hereby agrees to do the following;
(a) Provide the Raleigh Regional Office of the North
Carolina Division of Environmental Management (DEM), located
at 3800 Barrett'Drive, Raleigh, NC 27609, with a list of all
additions of flow under the City's Special Order, and
update this ,List each time flow is added to the system.
(b) Undertake the following activities in accordance with
the indicated time schedule:
1.) Continue implementation of the Toxicity Reduction
Evaluation. This plan should consider but is not
limited to: effluent characterization/identification of
suspected toxicants, evaluation of point source
contributions to toxicity, industrial flow screenings,
activated sludge treatability studies, pretreatment
program evaluation and review, WWTP evaluation,
toxicity source reduction strategies, chemical
substitution for those compounds determined to
contribute to refractory toxicity, and
development/implementation of a long-term chemical
management plan.
2) Submit quarterly THE progress reports to the
Raleigh Regional office. The reports shall be
submitted in triplicate and are due no later than the
15th day of each February, May, August, and November
for the duration of this Order.
3) Complete inflow/infiltration study by July 1,
1996.
4) Complete sewer rehabilitation drawings by December
31, 1996.
5) Achieve compliance with all final effluent
limitations contained in NPDES Permit No. NC0020559 by
March 1, 1997.

6) Submit quarterly progress reports on I/1 work
indicating work completed and amount of 1/I eliminated.
7) On or before May 31, 1998, complete sewer
rehabilitation construction to eliminate overflows from
the Redbud pump station or upgrade the pump station to
eliminate overflows due to excessive 1/1.
S) On or before June 30, 1998, eliminate overflows
from the Redbud pump station.
(c) Comply with all terms and conditions of the permit
except those effluent limitations identified in paragraph
1(a) above. See Attachment A for all monitoring
requirements and effluent limitations. The permittee may
also be required to monitor for other parameters as deemed
necessary by the Director in future permits or
administrative letters.
(d) During the time in which this Special order by Consent
is effective, comply with the interim effluent limitations
contained in Attachment A. The following reflects only the
limitations that have been modified from NPDES requirements
by this order:

(e) No later than fourteen 14 calendar days after any date
identified for accomplishment of any activity listed in 2(b)
above, submit to the Director of DEM written notice of
compliance or noncom liance therewith. In the case of
noncompliance, the notice shall include a statement of the
reason(s) for noncom liance remedial action(s) taken, and a
statement identifying the extent to which subsequent dates or
times for accomplishment of listed activities may be affected.
(f) Enforce the North Carolina State Building Code as it applies
to Water Conservation (Volume II - Plumbing, Chapter 9, 901
General Requirements - Materials, 901.2 Water Conservation, and
Table 901.2.2 - Maximum Allowable Water Usage For Plumbing
Fixtures).
(g) Use forty percent (40%) of the revenue received by a
municipality from additional one-half percent (1/2%) sales and
use taxes levied during the first five fiscal years in which the
additional taxes are in effect in the municipality and thirty
percent (30%) of the revenue received by a municipality from
these taxes in the second five fiscal years in which the taxes

are in effect in the municipality for water and sewer capital
outlay purposes or to retire any indebtedness incurred by the
municipality for these purposes.
(h) Implement the Long Term Monitoring Plan extra monitoring as
approved by DEM.
3. The City agrees that unless excused under paragraph 4, the City
will pay the Director of DEM, by check payable to the North Carolina
Department of Environment, Health and Natural Resources, stipulated
penalties according to the following schedule for failure to meet the
deadlines set out in paragraphs 2(b) and 2(e), or failure to attain
compliance with the effluent limitations/monitoring requirements
contained in Attachment A.

4. The City and the Commission agree that the stipulated penalties
are not due if the City satisfies the DEM that noncompliance was
caused solely by:
a. An act of God;
b. An act of war;
c. An intentional act or omission of a third party
but this defense shall not be available if the act or
omission is that of an employee or agent of the defendant or
if the act or omission occurs in connection with a
contractual relationship with the permittee;
d. An extraordinary event beyond the permittees control.

Contractor delays or failure to obtain funding will not be
considered as events beyond the permittees control; or
e. Any combination of the above causes.
Failure within thirty (30) days of receipt of written demand to pay
the penalties, or challenge them by a contested case petition pursuant
to G.S. 150E-23, will be grounds for a collection action, which the
Attorney General is hereby authorized to initiate. The only issue in
such an action will be whether the thirty (30) days has elapsed.
5. In accordance with the provisions of G.S. 143-215.67(b) the
Commission allows the Town to accept the additional waste specified
below to its waste disposal system. The allocation of additional flow
tributary to the Redbud pump station will be allowed upon acceptable
demonstration to the Director of the removal of an amount of inflow
and infiltration which is twice the amount of new flow to be
connected. The approval of additional flow will be in the form of a
letter from the Director to the City.

Total Flow allocated = 327,260 gpd. The nature of the additional
flows is such that the waste characteristics do not exceed those
generally associated with domestic waste or are pretreated to domestic
strengths. Waste of greater than normal domestic strength may be
accepted if the parameter(s) that exceed normal domestic strength
wastewater are not those for which interim limitations have been
developed and it can be demonstrated to the satisfaction of the
Director the additional waste will not adversely affect the treatment
efficiency of the treatment system for any modified parameter or
result in the violation of any other permit limitation. All new and
proposed industrial waste tributary to the system must be controlled
using all needed mechanisms including but not limited to adoption and
implementation of industrial waste control and pretreatment
ordinances. No wastewater can be accepted which will add toxic
pollutants in quantities not generally associated with domestic
wastewater characteristics, unless the acceptance of the additional
wastewater can be supported through appropriate analyses acceptable to
the Director.
6. This Special Order by Consent and any terms, conditions and
interim effluent limitations contained herein, hereby supersede any
and all previous Special Orders and Enforcement Compliance Schedule
Letters, terms, conditions, and limitations contained therein issued
in connection with NPDES Permit No. NC0020559.
7. Any violation of terms of this S ecial Order hy Consent,
including 2aragra2U 2(bl And 2(e) above and Attachment A shall
terminate paragraph 5 of this Order and any authorized additional
waste not Rreviouslv connected to the s ststem�shall not thereafter be
connected until the necessary sewerage system im rovements have been
completed and placed^in 2perati.on.
8. Noncompliance with the terms of this Special Order by Consent is
subject to enforcement action in addition to the above stipulated
penalties, including injunctive relief pursuant to G.S. 143-215.6.C.
9. The permittee, upon signature of the Special order by Consent,
will be expected to comply with all schedule dates, terms, and
conditions of this document.
10. This Special Order by Consent shall expire March 1, 1998.

CHRONIC TOXICITY MONITORING (QUARTERLY) Attachment B

The permittee shall conduct chronic toxicity tests using test
procedures outlined in: The North Carolina Phase II Chronic Whole
Effluent Toxicity„ Test, Procedure (December 1995) or subsequent
versions. -_
The effluent concentration defined as the Instream waste Concentration
(IWC) shall be 90%. Suggested effluent serial dilutions for the full
range test are 90%, 67.5%, 45%, 30W, and 151 (these test
concentrations may be modified upon prior approval from the
Environmental Sciences Branch and provided that Phase II test
methodology is adhered to), The chronic value for this analysis will
be determined using the geometric mean of the highest concentration
having no statistically detectable impairment of reproduction or
survival and the lowest concentration that does have a statistically
detectable impairment of reproduction or survival. The presence of 48
hour acute toxicity will be determined using Fisher's Exact Test at 48
hours from test initiation. Collection methods, exposure regimes, and
further statistical methods are described by the .document referenced
above,
The permit holder shall perform at a minimum, quarterly monitoring
using these procedures to establish compliance with the Order
condition, Toxicity monitoring shall be conducted during the months
of March, June, September, and December. Effluent sampling for this
testing shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
All toxicity testing results required as part of this Order condition
shall be entered on the Effluent Discharge Monitoring Form (MR-1) for
the months in which tests were performed, using the parameter code
THPIB for the Chronic value and TGA3B for the 48 hour Acute Toxicity
measure (Pass/Fail). Additionally, DEM Form AT-3 (original) is to be
sent to the following address:

Test data shall be complete and accurate and include all supporting
chemical/physical measurements performed in association with the
toxicity tests, as well as all dose/response data, Total residual
chlorine of the effluent toxicity sample must be measured and reported
if chlorine is employed for disinfection of the waste stream.
Should any test data from this monitoring requirement or tests
performed by the North Carolina Division of Environmental Management
indicate potential impacts to the receiving stream, the NPDES permit
may be re -opened and modified to include alternate monitoring
requirements or limits.
Note: Failure to achieve test conditions as specified in the cited
document, such as minimum control organism survival and appropriate
environmental controls, shall constitute an invalid test and will
require immediate retesting (within 30 days of initial monitoring
event). Failure to submit suitable test results will constitute
noncompliance with monitoring requirements,
