The subject document has been reviewed by this office. The Division of Water Quality (DWQ) is
responsible for the issuance of the Section 401 Water Quality Certification for activities which
impact waters of the state including wetlands. The subject project may impact waters including
wetlands. The following comments are based on the review of the document:
A) DOT may be required to provide stream mitigation if significant stream loss or
degradation occurs.
DOT is reminded that endorsement of a FONSI by DWQ would not preclude the denial of a 401
Certification upon application if wetland and water impacts have not been avoided and minimized
to the maximum extent practicable. Questions regarding the 401 Certification should be directed
to Eric Galamb or Cyndi Bell in DWQ's Environmental Sciences Branch at 733-1786.
