Good afternoon-
In response to Yr. 1 monitoring report for Stone Farm Mitigation Bank (Brunswick Co.) and
some of your comments, it was determined that the s. criteria had been met and the
appropriate credits are to be released. I would like to point out that the report and
credits (non-riverine) relate only to the Carolina Bay, or Phase I, of the Bank (See Table 3a
in the MBI). Phase II, which is riverine, non-riverine, and streams (Tables 3b &c), was
scheduled for completion in March 2009, but has not been constructed due to the economic
downturn. To date, no credits have been debited from this phase. Reference paragraph 19 on
pg. 7 of the MBI (executed on 1/5/09) for when the construction must be completed in order to
comply with the MBI (basically "no later than the first full growing season following initial
debiting of the Bank). I write all of this to inform you that the released credits will be
restricted to Phase I, or the Carolina Bay and will not encompass the entire Bank due to the
absence of work on Phase II. If the Sponsor decides to debit any credits from Phase II in
the future, then they are required to perform all the physical and biological improvements no
later than the first full growing season following the debit event, regardless of the
enability to sell credits. You may have some concerns that the integrity of the Bank might
be compromised if Phase II may be delayed, or in .a worse case scenario, never constructed.
But I can't think of any reason how this would be the case, even if the Carolina Bay becomes
the sole mitigation project-standing on its own. At this,time, it would be my position that
this approach is okay since the success of the 145-acre Carolina Bay is not contingent on the
construction of Phase II.
Let me know if you have any input on this, or if I have totally confused you and you need
clarification. Attached is a letter on behalf of the Sponsor requesting to place Phase II on
hold and a copy of the paragraph 19 and Tables 3 (a,b,&c) with the credit release schedule.
