According to NPDES Program guidance (Coleen Sullins' memo to Permit Writers, 1993), federally regulated seafood -processing industries should adhere to the following limits and monitoring requirements [as may be practicable considering updates to State and Federal 40CFR Regulations (see Renewal Strategy Changes)]: 1. Flow — estimate Monthly, concurrent with monitoring of limited parameters 2. Temperature to WQ standard — No monitoring 3. pH— 6.0 to 9.0 standard units for fresh waters; 6.8 to 8.5 for tidal waters 4. Biocide Special Condition 5. TSS —Limit per guidelines with monthly monitoring 6. D&G — Limit per guidelines with monthly monitoring 7. BMP/dry cleanup requirements CURRENT RENEWAL RATIONALLE — Environment vs. Production Receiving -Stream - The Permittee discharges to an unnamed tributary of South Creek, a waterbody classified SC -NSW. This facility is exempt from the Tar -Pamlico River Basin Nutrient Strategy (2010) because of its relatively low discharge volume as episodic flow estimated by the Permittee at maximum 16,100 gallons per day (sum of all processes discharging). The Permittee generates wastewaters from two sources designated as: • Outfall 001 Mechanized Blue Crab processing §40 CFR 408.32 Outfall 002 Conventional [hand processed] Blue Crab §40 CFR 408.22 Changes in Renewal Strategy — Previous effluents flowing via Outfalls 001 and 002 were combined for reporting. This monitoring process is hereby discontinued because of the considerable differences in waste allocation required by per 40 CFR 408. The following summarizes renewal changes: 1. Limits and monitoring of outfall are hereby separated [see sections A. (1.) and A. (2.)]. 2. Flow limits are revised for Outfall 001 based on revised production to 0. 00 12 MGD monthly average (MA), and for Outfall 002 revised to MA 0.0007 MGD. 3. Temperature (°C) is retained considering continued hot-water processing. 4. Per EPA's monitoring preference for Total Suspended Solids (TSS) over Settleable Solids (SS), DWR has discontinued SS monitoring in the permit. 5. The Permittee is hereby required to report monthly any outfall not in use as "no flow" or "no discharge" in accord with the eDMR Program. In the absence of a DWR-approved Reporting Waiver, failure to report is a permit violation. The changes between this permit and the previous permit include the following: • Added updates to facility map and parameter codes. • Updated limits for Total Suspended Solids (TSS) and Oil and Grease. Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). Permit Special Condition - Total Suspended Solids and Oil & Grease Reporting Requirement Outfalls 001 and 002 shall both be independently sampled and monitored monthly for oil & grease and Total Suspended Solids (TSS). The value reported on the discharge monitoring report for Outfall 001 shall be the sum of mass loading from both Outfalls 001 and 002. i. i.e. Value reported on Discharge Monitoring Report for Outfall 001. 2. Oil & Grease = lb/day for Outfall 001 + lb/day for Outfall 002 3. TSS = lb/day for Outfall 001 + lb/day for Outfall 002 A. (4.) Permit Special Condition - Best Management Practices (BMPs) BMPs must be employed to ensure that excessive pollutants are not discharged to the surface water of the state. These practices should include as a minimum the following: i. No discharge of fish or crab parts, floating solids, foam visible in other than trace amount. 2. The permittee shall direct employees and provide resources to follow, at a minimum, the following practices such that wastewater volume and wastewater constituents are reduced: a. All hoses used to provide on demand water delivery shall be equipped with automatic shut-off nozzles. b. Personnel shall be instructed to eliminate flows through idle equipment. c. All process and washdown equipment shall be fitted with high pressure/low volume nozzles. d. Dry cleanup shall be preformed prior to washdown of the facility A. (5.) Permit Special Condition - Dry Cleanup Requirements - Dry Cleanup shall emphasize the following techniques, as applicable: a. Seafood process solids shall be squeegeed off the floor prior to wet cleanup. b. Cooking or plucking residuals shall be containerized for proper disposal. c. Discharge to surface waters of cooking or plucking residuals shall not be allowed. d. Trays shall be placed under machines and conveyor belts, where practical, to catch cooking or plucking residuals, breading or other process food products. A. (6.) Permit Special Condition - Temperature Condition The temperature of the effluent shall not cause the temperature of the receiving stream to increase by more than 0.8 °C above the natural water temperature during the months of June, July, and August nor more than 2.2°C during any other month and in no case to exceed a maximum of 32°C. A (7.) Permit Special Condition - Biocide Condition There shall be no chromium, zinc or copper added to the treatment system except as pre -approved additives to biocidal compounds. The Permittee shall obtain approval from the Division of Water Resources Aquatic Toxicology Unit (ATU) prior to the addition of any biocidal compound to the water discharged from outfall(s) 001. Approval for use of new compounds (not previously approved) must be submitted to the ATU at least 90 days in advance of any planned use of those compounds. ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and is beginning implementation in late 2013. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) • Section D. (2.) • Section D. (6.) • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)1 Beginning no later than 270 days from the effective date of this permit, the permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / DWR / Information Processing Unit ATTENTION: Central Files / eDMR 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary waiver by the Division. Signatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B. (11.) (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (I 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. Any person submitting an electronic DMR using the state's eDMR system shall make the following certification [40 CFR 122.22]. Records Retention [Supplements Section D. (6.)] The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions. These records or copies shall be maintained for a period of at least 3 years from the date of the report. This period may be extended by request of the Director at any time [40 CFR 122.41].
