On October 6, 2009, the Division of Water Quality (DWQ) received your application dated February 10,
2009 with additional information received from you on.February 27, 2009, to fill or otherwise impact
0.02 acres of 404/wetland, 80 linear feet of intermittent stream, 0.95 acres of open water (pond), and
3,701 square feet (ft) of Zone 1 protected riparian buffers and 2,380 square feet (ftz) of Zone 2 protected
riparian buffers to construct the proposed residential development on the site. On November 5, 2009, the
DWQ sent a Request For More Information letter to you regarding stormwater information and requiring
a response from you within 30 calendar days. As of today the DWQ has not received the requested
information or any further correspondence from you. For this reason your application is hereby
considered returned. Once you have redesigned yourproject to address the problems and inadequacies
with your application as it was submitted, you will need to reapply for DWQ approval. This includes
submitting a complete application package.
Please be aware that you have no 401 certification or authorization under the Neuse Buffer Rules for this
activity and any work done within waters of the state would be a violation of North Carolina General
