Ms. Wilson:
This is our written response to your request for more information letter dated
November 10, 2009 for Highland Forest (DWQ Project # 09-0577) in Haywood County,
NC. WNR was granted an extension for this response until January 14, 2010. WNR has
compiled the following information and maps to address the requested information by
DWQ and concerns raised by the Wildlife Resources Commission.
1. Structure at Culvert #1
A cross vane with step is proposed to rectify the historic improper placement of culvert
#1. This cross vane will back water into the pipe and allow for aquatic life passage
using the same specifications used for Culverts #16 and #17. Details are provided in
this packet for Culvert #1 in Additional Information Requested #1. There is a
typical plan view, longitudinal profile, typical cross section, and existing conditions
photos within attachment #1. In order to minimize impact to the stable stream reach
downstream of the proposed structure, the pool will need to be shortened from 19.5
feet to 14 feet (see longitudinal profile typical of Culvert #1). Disturbed areas will be
covered with fiber matting and replanted with native vegetation such as rhododendron
to mimic the downstream riparian conditions. The right bank immediately downstream
of the culvert will be matted and replanted to provide stability and address bank
sloughing concerns of the Wildlife Resources Commission.

2. Plans, Specifications, and Sheer Stress Calculations
In the previous submittal, dated September 22, 2009, detailed plan views and
longitudinal profiles showing the proposed specifications for the step pool sequence
were included. Elevation difference between the invert of the structure and the pool
water surface at base flows will be no greater than 1 foot. Minimum pool depth will be
at least 1.5' deep. The previous design illustration did not back water into the culvert;
however, this has been adjusted to address concerns of Wildlife Resources Commission
(See Additional Information Requested #2). There is a longitudinal profile of
culverts #16 and #17, typical boulder step, and typical cross vane with step in
attachment #2. Cross vanes were designed above culverts 16 and 17 in order to
permanently direct base flow through the middle culvert. Shear stress calculations
were used to determine rock size to ensure long term stability of the structures.
Culvert #16. Shear stress was calculated using mean depth. Mean depth = 1.0 feet.
Slope of Culvert #16 = 3.5%. Density of Water = 62.4lbs/ft3. Shear stress at Culvert
#16 = 2.184 Ibs/sq.ft. Using Dave Rosgen's Colorado data and Shield's curve data,
moveable particle size at bankfull, shear stress would be between 176 mm-270 mm.
Culvert #17. Shear stress was calculated using mean depth. Mean depth = 1.0 feet.
Slope of culvert #17 = 10%. Shear stress at culvert #17 = 6.24 Ibs/sq.ft. Using both
curves, moveable particle size at bankfull shear stress would be between 525 mm and
584 mm.
Culvert #1. Shear stress was once again calculated using mean depth. Mean depth =
0.9 feet. (Channel width will be wider here due to less constraints; therefore mean
depth will decrease in order to emulate proper width to depth ratio). Slope of Culvert
#1 = 5.5%. Shear stress at culvert #1 = 3.3 Ibs./sq.ft. Using both curves, moveable
particle size at bankfull shear stress would be between 270 mm and 365 mm.
Rock size will be no smaller than 2.5 feet (762 mm) in diameter at the intermediate
axis. This will ensure the long term stability of the step-pool structure.
3. Monitoring
Monitoring will include an as-built report upon completion of the step pool structures,
along with a 6 month report, 3 year report, and final report at year 5. Additional yearly
inspections will be made and pictures will be submitted to show stability. This
monitoring schedule was presented and discussed during the meeting held July 9, 2009.
However, if DWQ staff determines it is necessary for the developer to provide a report
annually then we will proceed as such.

4. Regarding the Revised 401 Application
Part C.2.a. The wetland impacts have been clearly referenced to the site plan.
Impacts 27 through 30 are the wetland impacts on site including the one temporary
impact that was necessary for utility line construction. Please see Additional
Information Requested #4 (attachment 3) for a revised PCN and site plan maps.
5. Regarding the Revised 401 Application
Impact Table. The table has been modified and notes have been added to more
clearly show the currently proposed impacts. The history of the site, including pre-
existing impacts, a previous permit under a different owner, and avoided impacts are
shown in a separate table in attachment 4 Additional Information Requested #5.
6. Regarding the Revised 401 Application
Part E.3.b. After several phone calls with Kris Boyd, Susan Wilson, and Mike Randall
and published map reviews it was determined that the project's built upon areas do not
occur within a regulated Phase II stormwater area. Included in attachment 5
Additional Information Requested #6 is a site plan showing the location of the
Phase II (MSI) area and No Stormwater Program area within the project, a map of NC
Areas Subject to Phase II Post-Construction & Other Stormwater Program
Requirements, and an email from Mike Randall. A minor trout buffer variance was
obtained for the entrance cottage through Haywood County Erosion and Sediment
Control during the plan approval process for the cottage.
7. Regarding the Revised 401 Application
Part F.2.a. This has been corrected. Please see attachment 3 (Additional
Information Requested #4).
Additional Information / Changes
Impact Changes. As we were reviewing tables and maps, we realized that Site #26
was not a new impact. In the original submittal, this site was labeled as "no new
impact", but 30' of impact was mistakenly added in the impact total. As a result, only
one arch or bridge is required. Site #21 will be a 30' culvert instead of an arch or
bridge.

Notes on Impact Tables:
The first impact table contains only the crossings or impacts that are directly relevant to
the current 401/404 applications. The second impact table labeled "previous/future",
contains information on many additional sites that are either pipe replacements of the
same length, impacts that were considered but avoided, or impacts that were permitted
under a previous owner in 2005 but not installed.
As we were reviewing tables and maps, we realized that Site #26 was not a new impact.
In the original submittal, this site was labeled as "no new impact", but 30' of impact was
mistakenly added in the impact total. As a result, only one arch or bridge is required.
Site #21 will be a 30' culvert instead of an arch or bridge.
Additional Notes on Previous Owner and Permit:
Of the 142' that Indian Ridge was permitted for in 2005, only 55' was actually installed.
This left 87' permitted but not installed. This 2005 permit expired in March 2007 when
the new NW's were approved. This work was "grand-fathered" through March 2008, but
still did not get installed; therefore, WNR included these previously approved but
uninstalled impacts in the new application. Additionally, these previously approved
impacts changed or were eliminated when Highland Forest purchased the project in 2007.

Jennifer,
Pursuant to our discussion and a review of the Highland Forest site plan, it would appear that the
BUA is not within the Phase II stormwater regulated area. As such, the project will not require a
Phase II State stormwater permit. If there are any impacts to streams, buffers or wetlands a
stormwater management plan may be required by the 401 group.
Susan should be able to help with the 401/404 process.

Mike,
Thanks again for your time discussing this project with me the past two days. As we discussed
earlier today, attached is a pdf of DWQ's Phase II stormwater map and a pdf of the site plan for
Highland Forest. I have drawn in approximately where the Phase II and non-Phase II areas occur on
the project and labeled them. As I mentioned you can see that the area (+/- 15
acres) within Phase II stormwater jurisdiction will not be developed or disturbed. As such I
understand from you that this project will therefore not be required to submit a Phase II stormwater
permit to you. Please verify my understanding or correct me once you have time to review the
attached maps. The overall impervious coverage for the project is 5.3%.
