G. No mining shell occur in the Little Tennessee River between May 1 and July 31 to protect fish spawning activities in the mining area. H. As river traffic approaches, dragilne operation in the curve of the river shall stop and all the traffic to safely pass before dipping Is resumed. 6. All affected area boundaries on land(4.12acres)shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. 7. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or;my excavated channels,the erosion of which may cause off-site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erasion. &. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or condulls shall be constructed or installed when required to prevent such conditions. 9. A. No on-site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved raclamation plan. B, Mining refuse defined by G.S. 7449 (14)of The Mining Act of 1971 generated on-site and directly associated with the mining activity may be disposed of In a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. If mining refuse is to be permanently disposed within the mining permit boundary, the following Information must be provided to and approved by the Division of Land Resoumes prior to commencement of such disposal: 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verincation that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundoover will be established. 10. Sufficient buffer shall be maintained between any mining related activities and(other than the centedine of the river)any adjoining property line/permit boundary, right-of-way, bridge abutment or other structure to protect adjacent property. 11. An annual Reclamation Report shall he submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 12. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation,or erosion/sediment control plan contained the approved application for a mining permit or any approved revision to it. Approval to Implement such changes must be obtained from the Department rior to on- site Implementation of the revisions. 13. The security which was pasted pursuant to N.C.G.S. 74-64 in the form of a 8,500.00 Assignment of Savings Account Is sufficient to cover the operation as indicated In the approved application. This security must remain in force for this permit to be valid. This is most easily done by inserting live cuttings during the dormant season (December through February). Cuttings must be freshly cut,have side branches removed, and be kept moist prior to installation. The cuttings should be 0.5 to 2.inches in diameter and 2- 3 feet in length with the base cut at an angle for insertion into the bank and the top cut square for tamping. Tamp the cutting 4/5 of the length into the ground at a right angle to the slope of the bank, starling at the waters edge and working up the bank. It Is important for the cutting to be Installed right side up(i.e.,with the buds oriented upward) and to be angled to downstream. Plans 2-4 cuttings per square yard along the bank In a random fashion. The random arrangement will be more stable than if the cuttings are Inserted in rows. For establishing a riparian buffer adjacent to the bank, a mixture of the following species is recommended: sycamore (Plantanus occidentalis) river birch (Betula nigra) black gum (Nyasa sylvatica) swamp chestnut oak Quemus michauxil) wiliowoak Quamus phallus) These should be planted in an even ratio. All species prefer moist bottomland conditions but are relatively tolerant of a wide range of conditions. Sycamore and river birch will probably be beat for planting directly adjacent to the river/creak. The other species should be randomly mixed In the remainder of the buffer. Tmes should be planted 10-12 foot on center. Once trees are established, it maybe necessary to thin the trees, if survival rates are high,to allow for optimum growth. However, it is probably more cost effective to plant more densely to minimize the need to replant as a result of poor survival rates and a larger spacing. Trees should be planted between December 1 and February 15 to enhance survival rates. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestem and gamma grass. In addition, the penndtee shell consult with a professional wildlife biologist with the N.C.
