is current and the annual fees have been paid).
Signage warning canoeists/kayakers of the dredging operation were reported to be in place upstream
of the facility.
Overall,the facility is in compliance. Stream banks appear stable and settling basin is being cleaned
out on an annual basis.

The Division is returning your request to transfer ownership of Certificate of Coverage (CoC) NCG520095
for the subject facility. NCG520095 was made Inactive by the Division in 2010. We cannot transfer
ownership of an Inactive permit/CoC.
I have enclosed the application for coverage under NCG520000, should you wish to apply for a new CoC for
this discharge. Applicants for new NPDES discharge permits must submit the following documents, at
minimum. NOTE: For all documents, the applicant must submit one original and one additional copy.
1. A completed application form [attached]. This is required by 40 CFR 122.21, NCGS 143-215.1, and

documented in your current permit in Part II.B. 14. Your total annual fees owed,for the two(2)permitted facilities referenced above,is
300.00.Copies of each invoice for each permitted facility previously sent by the Division's Budget Office are attached.
Failure to pay the annual fee is grounds for revocation of your permit,as documented in part 11. B. 13 and II. B. 14. This matter must be
promptly resolved.You will not receive any additional late payment fee request correspondence.
This letter serves as final notice that the Division will refer the fee noted above to the North Carolina Attorney General's Office for
collection through the courts unless payment is received by January 30,2010. Additional actions to revoke your operating permits
will be initiated as well as referral for collection.

occurs. To secure optimum efficiency the flow length of the basin to the basin width should have a
ratio of 2:1
Note: Construction of any wastewater treatment facilities requires submission of three (3) sets of
plans and specifications along with the application. Design of treatment facilities must comply
with requirements of 15A NCAC 2H .0138. If construction applies to this discharge, include
the three sets of plans and specifications with this application.

For new or proposed discharges, the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map (or a photocopied portion thereof) with discharge location
clearly indicated.
b) Site map, if the discharge is not directly to a stream, the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer (or engineering firm), include
documentation from the applicant showing that the engineer (Or firm) submitting the application has
been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a North
Carolina registered Professional Engineer and stamped-"Final Design-Not released for construction"..
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a narrative
description of the treatment system to be constructed.

PART IV - EVALUATION AND RECOMMENDATIONS
This is a sand dredge operation. The operator uses a floating suction dredge to remove sand from
the river. Places it on the stream bank and screens it prior to sale. The water from the wet sand
drains to pits dug on the stream bank and returns to the river by way of the sanding substrate;
there is no discharge point. Stormwater is treated in the same manner.
The regional office recommends the issuance of the permit.

The treatment shall be sufficient to meet with the limits set by the general permits. The trapping
efficiency should be greater than 75%. The surface area should be as large as possible to insure
sedimentation occurs. To secure optimum efficiency the flow length of the basin to the basin
width should have a ratio of 2:1
Note: Construction of any wastewater treatment facilities requires submission of three(3)sets
of plans and specifications along with the application. Design of treatment facilities must
comply with requirements of 15A NCAC 2H .0138. If construction applies to this
discharge, include the three sets of plans and specifications with this application.

outlined in the Division's"Guidance For the Evaluation of Wastewater Disposal Alternatives".
10) Additional Application Requirements:
For new or proposed discharges, the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map(or a photocopied portion thereof)with discharge
location clearly indicated.
b) Site map, if the discharge is not directly to a stream,the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer(or engineering firm), include
documentation from the applicant showing that the engineer(Or firm)submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Professional Engineer and stamped-"Final Design-Not released for
construction".
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a
narrative description of the treatment system to be constructed.

under the National Pollutant Discharge Elimination System(NPDES). Enclosed is an application
for coverage under the general permit issued by the Division of Water Quality. This permit is for
coverage at the location specified on the application. Should you have additional mining/removal
operations you are required to have a separate permit for each location. Please complete this
application making sure all items in the checklist on page 4 are included and mail the completed
application to the address on page 4.
The Division of Land Quality requires a mining permit when the site involves more than 1 acre.
When the total land disturbance area is less than 1 acre the Sedimentation Pollution Control Act
must be followed. Enclosed for your use are copies of the Sedimentation Pollution Control Act, The
Mining Act, and a Mining Permit Application.

Please disregard the letter dated February 6, 2003. The North Carolina General (NCG)Permit number
NGG020000 referenced in the letter is incorrect for your operation. Please fill out the enclosed Notice of Intent for
NCG520000. The information regarding Division of Land Quality requirements is for your use as necessary for your
site.
The Division of Water Quality does require a permit for sand mining/removal from streams under the National
Pollutant Discharge Elimination System (NPDES). Enclosed is an application for coverage under the general permit.
issued by the Division of Water Quality. This permit is for coverage at the location specified on the application.
Should you have additional mining/removal operations you are required to have a separate permit for each location.
Please complete this application making sure all items in the checklist on page 4 are included and mail the completed
application to the address on page 4.
The Division of Land Quality requires a mining permit when the site involves more than 1 acre. When the total
land disturbance area is less than 1 acre the Sedimentation Pollution Control Act must be followed. Enclosed for your
use are copies of the Sedimentation Pollution Control Act, The Mining Act, and a Mining Permit Application.

An investigation by this Office has concluded that you have been operating a sand dredge in
the Second Broad River in Rutherford County, at two (2) sites. The first site is at 136 Harris Lee
F;oad and the second at the Mary Kiser Property on Cherry Mountain Street, both in Forest City.
The following violations have been discovered:
• The unpermitted operation of a sand dredge constitutes a violation of North Carolina General
Statute (NCGS) 143-215.1.
Each violation is enforceable under provisions of NCGS 143-215.6A as administered by this
Agency. Furthermore, a civil penalty of not more than $25,000 may be assessed for each violation.
In order to avoid further regulatory action you are requested to respond in writing within ten
(10) working days of receipt of this letter with information regarding:
• Apply for, receive, and comply with General Permit Number NCG520000. Each site must be
permitted separately and the appropriate Notice of Intent (NOI) is enclosed and may be copied
as needed.

In aoeOrdance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and Incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However,completed performance of the approved Reclamation Plan Is a separable
obligation,secured by the bond or other security on file with the Department, and may survive
the expiration, revocation, or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the Interest of the permittee in the permitted mining operation, by virtue
of a sale, imposed upon him by the conditions of his permit and by the Mining act with
reference to the permitted operation,and transfer the permit to the successor operator,
provided that both operators have complied with the requirements of the Mining Act and that
the successor operator agrees to assume the duties of the permittee with reference to
reclamation of the affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permlttee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is failing
to achieve the purposes and requirements of the Mining Act;the Department may give the
operator written notice of Its Intent to modify, revoke or suspend the permit, or Its intent to
modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a
hearing at the designated time end place on any proposed modification, revocation or
suspension by the Department. Alternatively anrf in addition to the above, the Department
may Institute other enforcement procedures authorized by law.
Deflnitlons
Whenever used or referred to in this permit, unless the context cieady indicates otherwise,
terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 7449.
Modifications
April 6 2004, This permit has been Departmentally modified to change the permit number
rot m Mining Permit Na. 56-29 to Mining Permit No, 57-12.
Expiration Date
This permit shall be effective from the date of Its Issuance until September 8,2009.
Conditions
This permit shall be subjectto the provisions of the Mining Act,N.C.G.S. 74-46,at. seq.,and to
the following conditions and limitations:

OPERATING CONDITIONS,
1. A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.
8, Any stormwatar runoff from the affected areas at the site shall be In accordance
with any applicable permit requirements and regulations promulgated by the
Environmental Protection Agency and enforced by the N.C. Environmental
Management Commission. It shall be the permlttee's responsibility to contact the
Water Quality Section, Division of Water Quality,to secure any necessary
stonnwater permits or other approval documents.
2. A. Any mining process producing air contamination emissions shall be subject to the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission and enforced by the Division of Air Quality.
B. During mining operations,water trucks or other means that may be necessary
shall be utilized to prevent dust from leaving the permitted area.
3, The channel of the waterway shall not be diverted, constricted,or widened.
4. Any mining activity affecting waters of the State,water of the V. S., or wetlands shall be
In accordance with the requirements and regulation promulgated and enforced by the
NC Environmental Management Commission.
5. A. Adequate mechanical barriers including but not limited to diversions, earthen
dikes,check dams, sediment retarding structures, rip rap pits,or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or Into any lake, wetland
or natural watercourse In proximity to the affected land.
B. A two foot high vegetated berm (minimum 2:1 sideslopes)shall be maintained
between the stockpile areas and the top of the riverbank to prevent over waah
and to divert runoff to stabilized rip-rap and gravel filters outlets located at every
natural paint of drainage along said berm along said berm Indicated on the Mine
Map received by the Land Quality Section on May 3, 2004.
C. All riprap and gravel filter outlets shall extend down the riverbank to the normal
water level of the river to prevent scour and erosion of the riverbank at said
outlets.
D. Rlperlan vegetatlon shall be planted immedlateiv and malmalned to stabilize and
prevent continued eroslon of all exposed riverbanks.

E. A minimum 15 fact wide Vegetated buffer shall be established and/or maintained
along the bank except in those minimal areas where access during the operation
Is essential.At such access points, all stablllzing roots and stumps shall not he
removed or otherwise disturbed.
E. No mining related disturbance shall occur beyond the cente llne of the Little
Tennessee River.
F. To ensure safety to boaters and others who may use the section of the river
covered by this mining permit, signs shall be placed on the bank of the river at the
upstream extremity and tha downstream extremity of dipping operations warning
river traffic of said operation.
,.��. G. No mining shell occur in the Little Tennessee River between May 1 and July 31 to
protect fish spawning activities in the mining area.
H. As river traffic approaches, dragilne operation in the curve of the river shall stop
and all the traffic to safely pass before dipping Is resumed.
6. All affected area boundaries on land(4.12acres)shall be permanently marked at the site
on 100-foot intervals unless the line of sight allows for larger spacing intervals.
7. The angle for graded slopes and fills shall be no greater than the angle which can be
retained by vegetative cover or other adequate erosion control measure, structure, or
device. In any event, exposed slopes or;my excavated channels,the erosion of which
may cause off-site damage because of siltation, shall be planted or otherwise provided
with ground cover, devices or structures sufficient to restrain such erasion.
&. The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become, noxious or foul. Necessary structures such as drainage ditches or
condulls shall be constructed or installed when required to prevent such conditions.
9. A. No on-site disposal of refuse or other solid waste that is generated outside of the
mining permit area shall be allowed within the boundaries of the mining permit
area unless authorization to conduct said disposal has first been obtained from
both the Division of Waste Management and the Land Quality Section,
Department of Environment and Natural Resources. The method of disposal
shall be consistent with the approved raclamation plan.
B, Mining refuse defined by G.S. 7449 (14)of The Mining Act of 1971 generated
on-site and directly associated with the mining activity may be disposed of In a
designated refuse area. All other waste products must be disposed of in a
disposal facility approved by the Division of Waste Management. No petroleum
products, aclds, solvents or their storage contalners or any other material that
may be considered hazardous shall be disposed of within the permitted area.

C. For the purposes of this permit, the Division of Land Resources considers the
following materials to be'mining refuse' (in addition to those specifically listed
under G.S. 74-49(14)of the N.C. Mining Act of 1971):
1. on-site generated land clearing debris
2. conveyor bells
3. wire cables
4. v-halts
5. steel reippforced air hoses
6. drill steal
D. If mining refuse is to be permanently disposed within the mining permit boundary,
the following Information must be provided to and approved by the Division of
Land Resoumes prior to commencement of such disposal:
1. the approximate boundaries and size of the refuse disposal area;
2. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the
refuse;
4. verincation that the refuse will be disposed at least 4 feet above the
seasonally high water table; and
5. verification that a permanent vegetative groundoover will be established.
10. Sufficient buffer shall be maintained between any mining related activities and(other
than the centedine of the river)any adjoining property line/permit boundary, right-of-way,
bridge abutment or other structure to protect adjacent property.
11. An annual Reclamation Report shall he submitted on a form supplied by the Department
by February 1 of each year until reclamation is completed and approved.
12. The operator shall notify the Department in writing of the desire to delete, modify or
otherwise change any part of the mining, reclamation,or erosion/sediment control plan
contained the approved application for a mining permit or any approved revision to it.
Approval to Implement such changes must be obtained from the Department rior to on-
site Implementation of the revisions.
13. The security which was pasted pursuant to N.C.G.S. 74-64 in the form of a 8,500.00
Assignment of Savings Account Is sufficient to cover the operation as indicated In the
approved application. This security must remain in force for this permit to be valid. The
total affected land shall not exceed the bonded acreage.

14, A. Authorized representatives of the Division of Archives and History shall be
granted access to the site to determine the presence of significant archaeological
resources,
B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human
Skeletal Remains Protection Act"should the operator or any person in his
employ encounter human skeletal remains, immediate notification shall he
provided to the county medioal examiner and the chief archaeologist, North
Carolina Division of Archives and History.

APPROVED RECLAMATION PLAN
The Mining Permit incorporates this Reclamation Plan,the performance of which Is a condition
on the continuing velidkyof that Mining Permit. Additionally,the Reclamation Plan Is a
separable obligation of the permittee,which continues beyond the terms of the Mining Permit.
The approved plan provides:
Minimum Standards As Pmvlded By G.S. 74-53
t. The final slopes in all excavations in soil, sand, gravel and other unconsolidated
materials shall be at such an angle as to minimize the possibility of slides and be
consistentwith the future use of the land.
2. Provisions for safety to persons and to adjoining property must be provided in all
excavations in rock.
3. All overburden and spoil shall be left In a configuration which is in accordance with
accepted conservation practices and which Is suitable for the proposed subsequent use
of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that are,
or are likely to become noxious, odlous or foul.
5. The reveggetatlon plan shall conform to soceptsd and recommended agronomic and
reforestation practices as established by the North Carolina Agricultural Experiment
Station and the North Carolina Forest Service.
5. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein
Incorporated. These activities shall be conducted according to The time schedule
Included in the plan,which shall to the extent feasible provide reclamation simultaneous
with mining operations and in any event, provide reclamation at the earliest practicable
time after completion or termination of mining on any segment of the permit area and
shall be completed within two years after completion or termination of mining.
RECLAMATION CONDITIONS:
t. Provided further,and subject to the Reclamation schedule,the planned reclamation
shall be to grade and revegetate the disturbed land areas.
2. The specifications for surface gradient restoration to a surface suitable for the planned
future use are as follows:
A, The riverbanks shall be restored to as near the natural condition as possible.

willow(Salix sedcea), tag alder(Alnus senulats), black willow(Salix nlgra),or
Sycamore (Piantanus occidentalis).

Willows and dogwoods should be established on the bank adjacent to the water. This is
most easily done by inserting live cuttings during the dormant season (December
through February). Cuttings must be freshly cut,have side branches removed, and be
kept moist prior to installation. The cuttings should be 0.5 to 2.inches in diameter and 2-
3 feet in length with the base cut at an angle for insertion into the bank and the top cut
square for tamping. Tamp the cutting 4/5 of the length into the ground at a right angle
to the slope of the bank, starling at the waters edge and working up the bank. It Is
important for the cutting to be Installed right side up(i.e.,with the buds oriented upward)
and to be angled to downstream. Plans 2-4 cuttings per square yard along the bank In
a random fashion. The random arrangement will be more stable than if the cuttings are
Inserted in rows. For best results the cuttings should be Installed the same day that
they are prepared. Soil should be compacted around the cuttings so that the cutting Is
secure In the bank.
For establishing a riparian buffer adjacent to the bank, a mixture of the following species
is recommended:
sycamore (Plantanus occidentalis)
river birch (Betula nigra)
black gum (Nyasa sylvatica)
swamp chestnut oak Quemus michauxil)
wiliowoak Quamus phallus)
These should be planted in an even ratio. All species prefer moist bottomland
conditions but are relatively tolerant of a wide range of conditions. Sycamore and river
birch will probably be beat for planting directly adjacent to the river/creak. The other
species should be randomly mixed In the remainder of the buffer. Tmes should be
planted 10-12 foot on center. Once trees are established, it maybe necessary to thin
the trees, if survival rates are high,to allow for optimum growth. However, it is probably
more cost effective to plant more densely to minimize the need to replant as a result of
poor survival rates and a larger spacing. Trees should be planted between December 1
and February 15 to enhance survival rates.
Whenever possible, disturbed areas should be vegetated with native warm season
grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the penndtee shell consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance pust-project wlidllfe habitat at the site.

4. Reclamation Plan:
Reclamation shall be conducted simultaneously with ruining to the extent feasible. In
any event, reclamation shall be initiated as soon as feasible after completion or
termination of mining of any mine segment under permit. Final reclamation, including
revegetailon, shall be completed within two(2)years of completion or termination of
mining.
This permit, Issued to M.J. Henderson and Gregg Connor on September 19, 195B and
renewed November 5, 1998, Is hereby simultaneously transferred in Its entirety to LBM
Industries, Inc. and renewed this a day of September, 2004 pursuant to G.S. 74-51 and
52.

PART IV - EVALUATION AND RECOMMENDATIONS
This is a sand dredge operation. The operator uses a floating suction dredge to remove sand from
the river. Places it on the stream bank and screens it prior to sale. The water from the wet sand
drains to pits dug on the stream bank and returns to the river by way of the sanding substrate;
there is no discharge point. Stormwater is treated in the same manner.
The regional office recommends the issuance of the permit.
