The complaint was not made to my department, but passed on to me. It looks like from the pictures that both the land and river have hazardous materials in/on them. The rig is indeed in the river(image 12) and cables stretch from the Rutherford bank to the Polk bank(image 11). From the Rutherford side the operation appears dormant (imagel8) and this is conformed by the site(image 3) where numerous hydraulic fuel containers (image 7)have contributed to saturating the soil in areas adjacent to the land rig within 4 yards of the river (image 6). Thanks SG Halford Polk County Emergency Services .ounty Subject: Re: Dredge - Polk County Date: Fri, 15 Jul 2005 16:45:12 EDT " From: Howlin4spirit@wmconnect.com To: Larry.Frost@ncmail.net Mr.Frost, the location of the dredge is off Lyles Pond Rd,which comes into Poors Ford Rd., it is the first road on right over the Broad River bridge on Poors Ford Rd. coming from highway 221 in Rutherfordton, go down the road about a mile or so, there will be a dirt road to the right,just past the road there is a yellow posted sign on a tree, you wail[see some of their trucks parked down the dirt road, there is a farm house on the left just across from the dirt road, go down the dirt road to the river and you will see the operation on the bank with discarded hydraulic fluid buckets that have saturated the soil per the photos sent by Kipp Mcintyre, Polk County Director of Economic Development 828 894 3301, he may be glad to help you locate the site. The dredge is sunk upriver from the site on the bank of river, follow the drums and rope along the Polk County side of the river and you will come to it. I live at 3748 Poors Ford Rd. in the winter and you are welcome to park in my drive and walk back in on the Rutherfordton side of river, my neighbors name is Robert Martin, he has a welding business out by the road (we share the same drive) he would be glad to show you the location of the dredge, his number is 828 245 9679. The sand dredge is currently not in operation, due to the sinking of the dredge in June of 2005. The following violations have been discovered: • The unpermitted operation of a sand dredge constitutes a violation of North Carolina General Statute (NCGS) 143-215.1. Failure to report a petroleum spill constitutes a violation of North Carolina General Statue (NCGS) 143-215.83. Failure to remove a prohibited discharge constitutes a violation of North Carolina General Statue (NCGS) 143-215.84. Each violation is enforceable under provisions of NCGS 143-215.6A as administered by this Agency. Furthermore, a civil penalty of not more than $25,000 may be assessed for each violation. The permit is current and the annual fees have been paid. DWR gave Mr. Deck a Change of Ownership form to submit since the permit is still in Douglas Harmon's name. Mr. Harmon recently sold the land to Steve Hardin. Mr. Hardin intends to lease to Mr. Deck for the sand dredge operation. The suction dredge was not in operation during the site visit. According to Mr. Deck,this area was last dredged in April 2016. Streambanks were well vegetated and stable. Zan Price instructed Mr. Deck to install a settling basin for additional treatment of effluent prior to discharge to the Broad River. Mr. Deck agreed to install a basin. The Broad River was turbid upstream and downstream from the dredging operation from a large rain event on June 14, 2016. This includes tracing the pathway of a storm sewer to its discharge point. c) If this application is being submitted by a consulting engineer (or engineering firm), include documentation from the applicant showing that the engineer (Or firm) submitting the application has been designated an authorized Representative of the applicant. d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a North Carolina registered Professional Engineer and stamped-"Final Design-Not released for construction". e) Final specifications for all major treatment components (if applicable). The specifications must be signed and sealed by a North Carolina registered Professional Engineer and shall include a narrative description of the treatment system to be constructed.
