A complaint was made by a neighbor in Rutherford County on this dredging operation in
Polk County off of Poor Ford Road. The complaint was not made to my department, but
passed on to me. It looks like from the pictures that both the land and river have
hazardous materials in/on them.

The rig is indeed in the river(image 12) and cables stretch from the Rutherford bank to
the Polk bank(image 11). From the Rutherford side the operation appears dormant
(imagel8)
and this is conformed by the site(image 3) where numerous hydraulic fuel containers
(image 7)have contributed to saturating the soil in areas adjacent to the land rig within 4
yards
of the river (image 6).

Mr.Frost, the location of the dredge is off Lyles Pond Rd,which comes into Poors Ford Rd., it is the first road on
right over the Broad River bridge on Poors Ford Rd. coming from highway 221 in Rutherfordton, go down the road
about a mile or so, there will be a dirt road to the right,just past the road there is a yellow posted sign on a tree,
you wail[see some of their trucks parked down the dirt road, there is a farm house on the left just across from the
dirt road, go down the dirt road to the river and you will see the operation on the bank with discarded hydraulic fluid
buckets that have saturated the soil per the photos sent by Kipp Mcintyre, Polk County Director of Economic
Development 828 894 3301, he may be glad to help you locate the site. The dredge is sunk upriver from the site
on the bank of river, follow the drums and rope along the Polk County side of the river and you will come to it. I live
at 3748 Poors Ford Rd. in the winter and you are welcome to park in my drive and walk back in on the
Rutherfordton side of river, my neighbors name is Robert Martin, he has a welding business out by the road (we
share the same drive) he would be glad to show you the location of the dredge, his number is 828 245 9679.

An investigation by this Office has concluded that you have been operating a sand dredge in
the Broad River in Polk County, north of the Poors Ford Road Bridge, without a permit. The sand
dredge is currently not in operation, due to the sinking of the dredge in June of 2005.
The following violations have been discovered:
• The unpermitted operation of a sand dredge constitutes a violation of North Carolina General
Statute (NCGS) 143-215.1.
Failure to report a petroleum spill constitutes a violation of North Carolina General Statue
(NCGS) 143-215.83.
Failure to remove a prohibited discharge constitutes a violation of North Carolina General
Statue (NCGS) 143-215.84.
Each violation is enforceable under provisions of NCGS 143-215.6A as administered by this
Agency. Furthermore, a civil penalty of not more than $25,000 may be assessed for each violation.

Zan Price with the Division of Water Resources(DWR) and leasee Jason Deck were present at the
site inspection.
The permit is current and the annual fees have been paid. DWR gave Mr. Deck a Change of
Ownership form to submit since the permit is still in Douglas Harmon's name. Mr. Harmon recently
sold the land to Steve Hardin. Mr. Hardin intends to lease to Mr. Deck for the sand dredge operation.
The suction dredge was not in operation during the site visit. According to Mr. Deck,this area was last
dredged in April 2016.
Streambanks were well vegetated and stable.
Zan Price instructed Mr. Deck to install a settling basin for additional treatment of effluent prior to
discharge to the Broad River. Mr. Deck agreed to install a basin.
The Broad River was turbid upstream and downstream from the dredging operation from a large rain
event on June 14, 2016.

days prior to expiration of the current permit. To satisfy this requirement,the Division must receive a renewal request
postmarked no later than February 1,2007.

PART IV - EVALUATION AND RECOMMENDATIONS
This is a sand dredge operation. The operator will uses a floating suction dredge to remove sand
from the river, runs it through a separator to remove the water, places sand on the stream bank
and returns the water to the river.The water and storm water drains from the wet sand drains back
to the river.
The regional office recommends the issuance of the permit, however the permittee should be
warned not to violate the water quality standards for turbidity, stable/vegetated stream banks must
be maintained, and dredging equipment must be maintained in a manner to prevent petroleum
leaks and spills.

h) How much of the volume discharged is treated (state in percent)?
i) If any box in item (e) above; other than none, was checked, please include design specifics (i.e.,
design volume, retention time, surface area, etc.)with submittal package. Existing treatment facilities
should be described in detail. Design criteria and/operational data (including calculations) should be
provided to ensure that the facility can comply with the requirements of the General Permit. The
treatment shall be sufficient to meet with the limits set by the general permits. The trapping efficiency
should be greater than 75%. The surface area should be as large as possible to insure sedimentation
occurs. To secure optimum efficiency the flow length of the basin to the basin width should have a
ratio of 2:1
Note: Construction of any wastewater treatment facilities requires submission of three (3) sets of
plans and specifications along with the application. Design of treatment facilities must comply
with requirements of 15A NCAC 2H .0138. If construction applies to this discharge, include
the three sets of plans and specifications with this application.

10) Alternatives to Direct Discharge:
Address the feasibility of implementing each of the following non-discharge alternatives
a) Connection to a Regional Sewer Collection System.
b) . Subsurface disposal (including nitrification field, infiltration gallery, injection wells,etc.)
c) Spray irrigation
The alternatives to discharge analysis should include boring logs and/or other information indicating that a
subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as outlined
in the Division's"Guidance For the Evaluation of Wastewater Disposal Alternatives".
11) Additional Application Requirements:
For new or proposed discharges, the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map (or a photocopied portion thereof) with discharge location
clearly indicated.
b) Site map, if the discharge is not directly to a stream, the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer (or engineering firm), include
documentation from the applicant showing that the engineer (Or firm) submitting the application has
been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a North
Carolina registered Professional Engineer and stamped-"Final Design-Not released for construction".
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a narrative
description of the treatment system to be constructed.
