The Division is auditing its Was regarding sand dredging operations covered under General Permit
NCG520000. During our file review it was determined that:
➢ The Division has no record of your having a valid permit for the discharge of wastewater from the
dredging site off Clark Rd near tire Broad River bridge in Rutherford County. This system was
previously covered by Certificate of Coverage (CoC)NCG520096. NCG520096 expired on
7/31/2007.
There are serious compliance issues and violations noted as follows.
Discharging Without a Permit
You are hereby advised that the discharge of wastewater without a permit from the Division constitutes a
violation of North Carolina General Statute (NCGS)§ 143-215.1 [Control of sources of water pollution;
permits required], which states:
(a) Activities for Which Permits Required. -No person shall do my of the following things or carry
out any of the following activities unless that person has received a permit from the Commission and has
complied with all conditions set forth in the permit
(I) Mahe any outlets into the waters of the State.
(2) Construct or operate any sewer system, treatment works, or disposal system within the
State.
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in any manner
intermixed with the waters of the State in violation of the water quality standards
applicable to the assigned classifications or in violation of any effluent standards or
limitations established for any point source, unless allowed as a condition of any permit,
special order or other appropriate instrument issued or entered into by the Commission
under the provisions of this Article.
The enforcement options available to the Division for violations of§ 143-2li .1 are found at NCGS 143.215.6'
A,B,and C, and include civil penalties,criminal penalties,and/or injunctive relief. The civil penalties
for violations such as these may be as high as $26 000 00 per day per violation

PART IV - EVALUATION AND RECOMMENDATIONS
This is a sand dredge operation. The operator uses a dragline to remove sand from the river.
Places it on the stream bank and screens it prior to sale. The water from the wet sand drains to
the sandy substrate stream bank and returns to the river; there is no specific discharge point.
Stormwater is treated in the same manner.
The regional office recommends the issuance of the permit.

Inspection was conducted by Kevin Mitchell and Tim Fox with the Asheville Regional Office. (Permit is
current and the annual fees have been paid). According to Tim Edwards, the site was last dredged in
May 2016.
Steps need to be taken to stabilize the stream banks and maintain the sediment basins. Best
management practices should be used to ensure that the stream banks are stabilized. Signage
warning canoeists of the dredging operation need to be in place a short distance upstream of the
facility.
Kevin Mitchell has been in contact with Mr. Edwards and a site meeting is scheduled to discuss best
management practices for bank stabilization. Site meeting is scheduled for June 30, 2016.

PART IV - EVALUATION AND RECOMMENDATIONS
This is a sand dredge operation. The operator uses a track hoe to remove sand from the river
places it on the stream bank and screens it prior to sale. The water from the wet sand drains back
to the river by way of the sanding substrate; there is no discharge point. Stormwater is treated in
the same manner.
The regional office recommends the issuance of the permit.

facilities should be described in detail. Design criteria and/operational data (including
calculations)should be provided to ensure that the facility can comply with the requirements of the
General Permit.
The treatment shall be sufficient to meet with the limits set by the general permits. The trapping
efficiency should be greater than 75%. The surface area should be as large as possible to insure
sedimentation occurs. To secure optimum efficiency the flow length of the basin to the basin
width should have a ratio of 2:1
Note: Construction of any wastewater treatment facilities requires submission of three (3)sets
of plans and specifications along with the application. Design of treatment facilities must
comply with requirements of 15A NCAC 2H .0138. If construction applies to this
discharge, include the three sets of plans and specifications with this application.

Address the feasibility of implementing each of the following non-discharge alternatives
a) Connection to a Municipal or Regional Sewer Collection System
b) Subsurface disposal (including nitrification field, infiltration gallery, injection wells, etc.)
c) Spray irrigation
The alternatives to discharge analysis should include boring logs and/or other information indicating
that a subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as
outlined in the Division's"Guidance For the Evaluation of Wastewater Disposal Alternatives".
10) Additional Application Requirements:
For new or proposed discharges, the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map (or a photocopied portion thereof)with discharge
location clearly indicated.
b) Site map, if the discharge is not directly to a stream, the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer(or engineering firm), include
documentation from the applicant showing that the engineer(Or firm)submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Professional Engineer and stamped-"Final Design-Not released for
construction".
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a
narrative description of the treatment system to be constructed.

application, record, report, plan or other document filed or required to be maintained under Article 21
or regulations of the Environmental Management Commission implementing that Article, or who
falsifies, tampers with or knowingly renders inaccurate any recording or monitoring device or method
required to be operated or maintained under Article 21 or regulations of the Environmental
Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a
fine not to exceed $25,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C.
Section 1001 provides a punishment by a fine of not more than $25,000 or imprisonment not more
than 5 years, or both, for a similar offense.)
