In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and
the Federal Water Pollution Control Act, as amended, the
Ameri-con Materials, Inc.
is hereby authorized to discharge sand dredging wastewater from the following facility:

Rutherford County
to receiving waters designated as the Second Broad River, currently classified as WS-V
waters in subbasin 03-08-02 of the Broad River Basin, in accordance with the effluent
limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and
IV hereof.
This certificate of coverage shall become effective September 28, 2016.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

PART IV - EVALUATION AND RECOMMENDATIONS
This is a sand dredge operation. The operator uses a track hoe to remove sand from the river
places it on the stream bank and screens it prior to sale. The water from the wet sand drains back
to the river by way of the sanding substrate; there is no discharge point. Stormwater is treated in
the same manner.
The regional office recommends the issuance of the permit.-

The treatment shall be sufficient to meet with the limits set by the general permits. The trapping
efficiency should be greater than 75%. The surface area should be as large as possible to insure
sedimentation occurs. To secure optimum efficiency the flow length of the basin to the basin
width should have a ratio of 2:1
Note: Construction of any wastewater treatment facilities requires submission of three (3)sets
of plans and specifications along with the application. Design of treatment facilities must
comply with requirements of 15A NCAC 2H .0138. If construction applies to this
discharge, include the three sets of plans and specifications with this application.

that a subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as
outlined in the Division's "Guidance For the Evaluation of Wastewater Disposal Alternatives".
10) Additional Application Requirements:
For new or proposed discharges,the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map (or a photocopied portion thereof)with discharge
location clearly indicated.
b) Site map, if the discharge is not directly to a stream, the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer(or engineering firm), include
documentation from the applicant showing that the engineer(Or firm)submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Profes'sinal Engineer and stamped-"Final Design-Not released for
construction".
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a
narrative description of the treatment system to be constructed.

NCG520000. During our file review it was determined that:
➢ The Division has no record of your having a valid permit for the discharge of wastewater from the
dredging site off Harris Lee Drive near Forest City,previously covered by Certificate of Coverage
(CoC)NCG520079,nor the site on Cherry Mountain Street,perviously covered by NCG520080.
NCG520079 and NCG520080 expired on 7/31/2007.
➢ Annual fees for 2010 have not been paid for either site.
There are serious compliance issues and violations noted as follows.
Discharging Without a Permit
You are hereby advised that the discharge of wastewater without a permit from the Division constitutes a
violation of North Carolina General Statute (NCGS)§ 143-215.1 [Control of sources of water pollution;
permits required], which states:
(a) Activities for Which Permits Required. -No person shall do any of the following things or carry
out any of the following activities unless that person has received a permit from the Commission and has
complied with all conditions set forth in the permit:
(1) Make any outlets into the waters of the State.
(2) Construct or operate any sewer system, treatment works, or disposal system within the
State.
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in any manner
intermixed with the waters of the State in violation of the water quality standards
applicable to the assigned classifications or in violation of any effluent standards or
limitations,established for any point,source, unless allowed as a condition of any permit,
special order or other appropriate instrument issued or entered into by the Commission
under the provisions of this Article.

The enforcement-options available to the Division for violations of§ 143-215.1 are found at NCGS 143-215.6
A, B, and C, and include civil penalties,criminal penalties, and/or injunctive relief. The civil penalties
for violations such as these may be as high as$25,000.00 per day per violet}on.

of wastewater from your property.
• Complete the enclosed Renewal Form for each site and return it to Mr. Charles Weaver at the
address indicated on the Form within 10 days of receipt of this notice.
• With the renewal form you should submit payment for the unpaid annual fees, which total$200.00.

• Submit a response letter documenting the date that either dredging operation was shut down. The

The Division is considering the pursuit of punitive sanctions against you. If we do not receive

efficiency should be greater than 75%. The surface area should be as large as possible to insure
sedimentation occurs. To secure optimum efficiency the flow length of the basin to the basin
width should have a ratio of 2:1
Note: Construction of any wastewater treatment facilities requires submission of three (3)sets
of plans and specifications along with the application. Design of treatment facilities must
comply with requirements of 15A NCAC 2H .0138. If construction applies to this

The alternatives to discharge analysis should include boring logs and/or other information indicating
that a subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as
outlined in the Division's"Guidance For the Evaluation of Wastewater Disposal Alternatives".
10) Additional Application Requirements:
For new or proposed discharges, the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map (or a photocopied portion thereof)with discharge
location clearly indicated.
b) Site map, if the discharge is not directly to a stream, the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer(or engineering firm), include
documentation from the applicant showing that the engineer(Or firm)submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Professional Engineer and stamped-"Final Design-Not released for
construction".
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a
narrative description of the treatment system to be constructed.

Inspection was conducted by Kevin Mitchell and Tim Fox with the Asheville Regional Office. (Permit is
current and the annual fees have been paid).
Signage warning canoeists of.the dredging operation need to be in place a short distance upstream of
the facility.
Sediment basin needs to be maintained to provide storage capacity.
