Description of projects area and activity: This verification authorizes Chemours to construct a water treatment facility and an instream structure in the Old Outfall 002 stream of width of 12 feet and 270'. The instream structure would create a small impoundment, and the water in this impoundment would be pumped to the new treatment facility and eventually discharged back into the Cape Fear River. The instream structure would include a small weir that is armored with rip -rap upstream and downstream of the weir to prevent erosion in the stream channel during stormwater flooding and during backwater flooding from the Cape Fear River. Discharges below the ordinary high water mark (OHWM) will primarily be from rip -rap to protect the stream banks and the stream substrate (upstream and downstream) as water crosses the weir during stormwater events. During construction, a new haul road/access road will be constructed to the weir, and a water treatment facility will be constructed in the uplands north of Old Outfall 002 stream. Temporary impacts would include construction of a temporary coffer dam and a small instream excavation upstream from the coffer dam to allow bypass pumping during construction of the instream weir. This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
