Dunn, Coastal Coordinator Habitat Conservation Division DATE: June 1, 2020 SUBJECT: CAMA Dredge/Fill Permit Modification. for Lutheran Retirement Center, Trinity Landing, Permit No. 6-20, New Hanover County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 4915 Masonboro Loop Road adjacent to the AIWW m Wilmington, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S. C. 661 et seq. ). The applicant proposes to modify Permit No. 6-20 to include bridges from an upland development across coastal wetlands and upland hummocks to access a waterfront pavilion and a nine -slip docking facility with lifts and two kayak launch floating docks. The 12' wide bridge would provide golf cart access to a nine -slip facility via landings on two upland hummocks. Elevation of the bridge over wetlands is stated to be 3' above wetland substrate. Extending from the waterfront pavilion to the slips, the 12' bridge would transition to a 6' pier. Floating docks would lead to two kayak launches in water depths approximately -2' NLW. The nine slips with lifts are reported to have -4' NLW depths. To provide amenities to the pavilion, water and sewer lines are proposed to be directionally bored under wetlands_ A Sedimentation and Erosion Control plan is approved for the upland development but has not been modified for this proposal. A stormwater permit has not been approved. The A1WW in this location is classified SA ORW by the Environmental Management Commission, designated a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries (NCDMF) and is open to shellfish harvesting. To address these concerns, we recommend the following be included as permit conditions: • The development should not close or add additional conditions to shellfish harvesting. If a closure were to occur, the project should be redesigned. • The project should have an approved stormwater permit to ensure increased impervious surfaces do not negatively affect adjacent aquatic habitats. Consideration should be given to this portion of the project being viewed on its owner rather than lumped in with the impervious values of the upland development. • Sedimentation and erosion control measures should be installed and maintained throughout project implementation. • To minimize shading impacts to wetlands, consideration should be given to reducing the width of the bridge to 1 0' rather than the proposed 12'. The reduced width should be sufficient for a golf cart to travel to the pavilion. • The project has wetlands in the area that will likely be impacted during construction. Wetlands provide important water quality functions and habitat opportunities to PNAs. To minimize impacts to this resource, an April 1— September 34 in -water moratorium should be placed on the project. This includes construction in open water and wetlands or lands regularly inundated. Matting should be used to minimize the effects of temporary impacts from heavy equipment during construction. • Shoaling is known to historically occur along the western banks of the AIWW within the project vicinity. The placement of permanent structures in this area may increase the amount of sediment accretion at the docking facility. Due to the classification of this area as PNA, any future requests for dredging in the area will be denied. We request the applicant to fully evaluate this issue prior to creating these environmental impacts. 11 • Although the facility is technically not a marina, the surrounding habitats are extremely sensitive. We request a marina management plan be developed that addresses docking, spills, what spill control and clean-up equipment will be available, and minimally identifies whether a trained dock master will monitor the area. This plan should also include the posting of information for boaters including emergency numbers and facility contacts. We appreciate the opportunity to review and comment on this permit application.
