The tailrace discharges to Tuckasegee River. The plant has permitted discharges of generator thrust bearing cooling water and central powerhouse sump. Mr. Keith Haynes and Mr. Larry Frost performed the inspection. The facility appeared to be well maintained and operating properly, There were no un-permitted discharges noted during the inspection. The purpose of the permit is to protect the receiving stream; therefore, the inspectors recommend that Upstream, Effluent and Downstream sampling points be re-evaluated for this facility. The recommended upstream sampling site should be at the dam inlet to the powerhouse, the effluent site from the tailrace and the downstream at a predetermined (safe access) site downstream of the tailrace discharge point to the stream. Possible sites were discussed during the inspection; it is recommended that these sites be established by written policy. Once the sampling sites are established, then the monitoring requirements and monitoring frequency for each site should re-evaluated. The proper reporting of flow from the powerhouse was discussed at length, during the inspection. Region Coordinator Habitat Conservation Program DATE: December 13, 1993 SUBJECT: Recommendations regarding sediment removal from reservoirs of run-of-river hydroelectric projects Biological staff of the North Carolina Wildlife Resources Commission (NCWRC) recently observed aquatic habitat degradation downstream of two hydroelectric projects in western North Carolina following the release of accumulated sediment from dams. As you know, Cascade Power Company and Nantahala Power and Light (NP&L) recently took such action, resulting in severe sedimentation in Little River below the Cascade Hydroelectric Project (Transylvania County) and in Oconaluftee River below the Bryson City Reservoir (Swain County) . Sediment flushing results when an operator opens gates in a dam for maintenance or repair, sending silt-laden water downstream in order to lower the reservoir level for easy access to the work area. This memorandum is in response to your request following a meeting on October 26, 1993 with NCWRC, DEM and NP&L personnel for our concerns and recommendations regarding this practice. Our concerns include the following: 1) The rapid release of water and sediment from behind a dam overwhelms downstream habitat with sudden high flows and deep sediment so that fish may be buried in the sediment or killed outright by the force of the released water. 2) Release of sediment during critical periods of fish spawning and incubation can result in damage to eggs and fry, possibly to the extent that few individuals in that year class will survive to maturity. Mr. Roy Davis Page 2 December 13 , 1993 J 3) Sediment settling downstream of the dam can be extremely deep (3 feet or more) and completely change the substrate of a stream. For instance, the Oconaluftee River downstream of the Bryson City Reservoir provided good habitat for smallmouth bass through boulder cover and gravel substrate for spawning. The onslaught of sediment has changed the substrate so that crevices and gravel are covered, making the river in this area more suited for species tolerant to these conditions. 4) Maintenance and repairs that require the opening of gates are often done during periods of low flow (late summer and fall) . Sediment released during this time will stay in the stream a maximum amount of -time because there are no high flows until later in the spring to moving it downstream. 5) While the reservoir is drawn down for work, the stream flowing through the reservoir basin may continue to carry accumulated sediment downstream. The NCWRC recommends that the following options for minimizing impacts' to aquatic habitat be considered when removal of accumulated sediment from behind a dam becomes necessary: 1) Accumulated sediment could be flushed downstream during periods of high flow to reduce the likelihood of large amounts of sediment settling in the stream reach just below the dam. In addition, operators could flush sediment from behind dams on a regular schedule instead of waiting several years until the reservoir is nearly filled with sediment. Another consideration with this strategy would be to avoid releasing sediment downstream during fish spawning periods to minimize impacts to fish populations. 2) Sediment could be removed from a reservoir by dredging and placing the material on an upland disposal site where it would be stabilized with various erosion and sedimentation measures. This would eliminate the need to flush sediments downstream. 3) One or more sediment catch basins could be constructed at the upstream end of a reservoir where sediment could collect. Sediment would be removed from these basins on a regular basis to avoid accumulation at the dam. Upon further assessment of these options, our preference would be the option having the least impact on aquatic habitat. " As a general rule, the ARO does not require licensees/exemptees to lower their reservoirs for maintenance activities. We do, ' however' allow them to lower reservoirs for_ inspection and maintenance, but-only after they have adequately consulted with appropriate Federal and 'State environ- mental agencies and obtained all necessary permits. Since we do not specifically require that reservoirs be drawn down, we obviously cannot provide you with advance notification of any drawdowns not required by staff. The exception to the general rule discussed above would be the lowering of a reservoir for dam safety reasons. In this exception, the ARO may require a licensee/exemptee to lower its reservoir. However, even with this exception, the owner must still. notify appropriate Federal and State environmental agencies of the drawdown. Lowering of reservoirs for dam safety reasons is usually required immediately after the unsafe situation becomes evident and, as a result, advance notification of other agencies may not be possible. Your letter states: "Repair of the tainter gate seals at a particular facility required dewatering behind the dam, the subsequent`. release of sediments resulted in a violation of North Carolina. Water Quality Standards and a small fish 'kill:"' However, your letter does not specifically state if the facility discussed is under FERC jurisdiction, and if so, to which project you are referring. If the project is under, FERC jurisdiction-, please furnish the following information: Ali Mr. Roy M. Davis -2- �r • The name of the project and FERC project number if known. • Was DEHNR notified by the licensee/exemptee prior to the drawdown? • If DEHNR was notified, did DEHNR respond to that notification? What was DEHNR's response? Was a permit required and issued prior to the drawdown? • If DEHNR was not notified, should it have been notified? • How was the violation of the North Carolina Water Quality Standards documented? • Has a formal complaint been issued to the Secretary, FERC, Washington? If not, does DEHNR intend to issue a formal complaint to the FERC? As of this date, the ARO has not been notified that any FERC licensee/exemptee has dewatered a reservoir to repair Tainter gate seals. If a licensee/exemptee did dewater a FERC-regulated project reservoir to such an extent that it was in violation of Federal or State water quality standards, and the licensee/exemptee did not properly notify the ARO and the various other responsible Federal and State regulatory agencies, and appropriate permits from those agencies were not secured prior to the drawdown, the licensee/ exemptee for that project could have been in violation of its license/exemption and could be subject to the enforcement and penalty actions. While there is no permitting involvement with this process, the release of concentrated sediment usually results in a violation of water quality standards, particularly turbidity, downstream. The Corps of Engineers is occasionally called upon to provide written communications with regards to the proposed drainage of reservoirs . It would be very useful in terms of letting reservoir owners know what might happen as a result of release of sediment if some mention of threat to fish and Water Quality Standards appeared in your letters . We did notify the Department of the Army, Corps of Engineers prior to our recent maintenance and were assured that all concerned regulatory agencies were notified and were advised that our proposed activities would be acceptable and legal. Please accept our position that we felt all bases had been covered and we were in a position to perform maintenance work which had been specified by the Federal Energy Regulatory Commission. Due to this episode, we plan to pursue an acceptable Hydroelectric maintenance schedule and work practice plan that will meet your requirements, along with other regulatory agencies requirements. I will be contacting you the first of 1994 to establish a plan that hopefully will result in us being able to maintain the plants and satisfy any legal requirement. Unless such demand is made,this certificate of coverage shall be final and binding. The Certificate of Coverage for your facility is not transferable except after notice to the Division.
