Thorpe, Ph.D., North Carolina Department of Transportation, Manager From: Polly Lespinasse, NC Division of Water Quality, Mooresville Regional Office Subject: Scoping Comments for the Proposed Widening of NC 24-27 from NC 740 in Albemarle, Stanly County to the Troy Bypass, West of Troy, Montgomery County, TIPs R-2530B, B- 4974, and R-2527, WBS Numbers 34446.1.6, 39922.1.1,.and 35572.1.1 Please reference your correspondence dated January 8, 2007 in which comments were requested for the above referenced project. Preliminary analysis of the project reveals the potential for multiple impacts to jurisdictional streams and wetlands in the project area. More specifically, impacts to: Mountain Creek Yadkin WS-IV 13-5-(0.7) Pee Dee River Yadkin WS-IV, B, CA 13-(1) Rock Creek Yadkin WS-IV, CA 13-8-(0.5) and 13-8-(2) Dumas Creek Yadkin C 13-16-1 Clarks Creek Yadkin C 13-16 Lick Fork Yadkin C 13-16-4 Smith Branch Yadkin C 13-25-30-1 Further investigations at a higher resolution should be undertaken to verify the presence of other streams and/or jurisdictional wetlands in the area. In the event that any jurisdictional areas are identified, the Division of Water Quality requests that the NCDOT consider the following environmental issues for the proposed project: Specific Project Comments: Review of the project reveals the presence of surface waters classified as Water Supply Critical Area in the project study area. Given the potential for impacts to these resources during the project implementation, the DWQ requests that DOT strictly adhere to North Carolina regulations entitled "Design Standards in Sensitive Watersheds" (15A NCAC 0413.0124) throughout design and construction of the project. This would apply for any area that drains to streams having WS CA (Water Supply Critical Area) classifications. For bridge projects located within the Critical Area of a Water Supply, the NCDOT will be required to design, construct, and maintain hazardous spill catch basins in the project area. The number of catch basins installed should be determined by the design of the bridge, so that runoff would enter said basin(s) rather than flowing directly into the stream, and in consultation with the DWQ. The environmental document should provide a detailed and itemized presentation of the proposed impacts to wetlands and streams with corresponding mapping. If mitigation is necessary as required by 15A NCAC 2H.0506(h), it is preferable to present a conceptual (if not finalized) mitigation plan with the environmental documentation. Appropriate mitigation plans will be required prior to issuance of a 401 Water Quality Certification. 3. Environmental assessment alternatives should consider design criteria that reduce the impacts to streams and wetlands from storm water runoff. These alternatives should include road designs that allow for treatment of the storm water runoff through best management practices as detailed in the most recent version of NC DWQ Stormwater Best Management Practices, such as grassed swales, buffer areas, preformed scour holes, retention basins, etc. 4. After the selection of the preferred alternative and prior to an issuance of the 401 Water Quality Certification, the NCDOT is respectfully reminded that they will need to demonstrate the avoidance and minimization of impacts to wetlands (and streams) to the maximum extent practical. In accordance with the Environmental Management Commission's Rules {15A NCAC 2H.0506(h)}, mitigation will be required for impacts of greater than 1 acre to wetlands. In the event that mitigation is required, the mitigation plan should be designed to replace appropriate lost functions and values. The NC Ecosystem Enhancement Program may be available for use as wetland mitigation. 5. In accordance with the Environmental Management Commission's Rules {15A NCAC 2H.0506(h)}, mitigation will be required for impacts of greater than 150 linear feet to any single perennial stream. In the event that mitigation is required, the mitigation plan should be designed to replace appropriate lost functions and values. The NC Ecosystem Enhancement Program may be available for use as stream mitigation. 6. DWQ is very concerned with sediment and erosion impacts that could result from this project. NCDOT should address these concerns by describing the potential impacts that may occur to the aquatic environments and any mitigating factors that would reduce the impacts. 7. If a bridge is being replaced with a hydraulic conveyance other than another bridge, DWQ believes the use of a Nationwide Permit may be required. Please contact the US Army Corp of Engineers to determine the required permit(s). 8. If the old bridge is removed, no discharge of bridge material into surface waters is allowed unless otherwise authorized by the US ACOE. Strict adherence to the Corps of Engineers guidelines for bridge demolition will be a condition of the 401 Water Quality Certification. 9. Bridge supports (bents) should not be placed in the stream when possible. 10. Whenever possible, the DWQ prefers spanning structures. Spanning structures usually do not require work within the stream or grubbing of the streambanks and do not require stream channel realignment. The horizontal and vertical clearances provided by bridges allow for human and wildlife passage beneath the structure, do not block fish passage and do not block navigation by canoeists and boaters. 11. Bridge deck drains should not discharge directly into the stream. Stormwater should be directed across the bridge and pre-treated through site-appropriate means (grassed swales, pre-formed scour holes, vegetated buffers, etc.) before entering the stream. Please refer to the most current version of NC DWQ Stormwater Best Management Practices. Page 3 12. If concrete is used during construction, a dry work area should be maintained to prevent direct contact between curing concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. 13. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction contours and elevations. Disturbed areas should be seeded or mulched to stabilize the soil and appropriate native woody species should be planted. When using temporary structures the area should be cleared but not grubbed. Clearing the area with chain saws, mowers, bush-hogs, or other mechanized equipment and leaving the stumps and root mat intact allows the area to re-vegetate naturally and minimizes soil disturbance. 14. Placement of culverts and other structures in waters, streams, and wetlands shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage.of water and aquatic life. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis- equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium is being maintained if requested in writing by DWQ. If this condition is unable to be met due to bedrock or other limiting features encountered during construction, please, contact DWQ for guidance on how to proceed and to determine whether or not a permit modification will be required. 15. If multiple pipes or barrels are required, they should be designed to mimic natural stream cross section as closely as possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream channel should be avoided. Stream channel widening at the inlet or outlet end of structures typically decreases water velocity causing sediment deposition that requires increased maintenance and disrupts aquatic life passage. 16. If foundation test borings are necessary; it should be noted in the document. Geotechnical work is approved under General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey Activities. 17. Sediment and erosion control measures sufficient to protect water resources must be implemented and maintained in accordance with the most recent version of North Carolina Sediment and Erosion Control Planning and Design Manual and the most recent version of NCS000250. 18. All work in or adjacent to stream waters should be conducted in a dry work area unless otherwise approved by NC DWQ. Approved BMP measures from the most current version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams and other diversion structures should be used to prevent excavation in flowing water. 19. Sediment and erosion control measures should not be placed in wetlands and streams. 20. Borrow/waste areas should avoid wetlands to the maximum extent practical. Impacts to wetlands in borrow/waste areas could precipitate compensatory mitigation. 21. While the use of National Wetland Inventory (NWI) maps and soil survey maps are useful tools, their inherent inaccuracies require that qualified personnel perform onsite wetland delineations prior to permit approval. 22. Heavy equipment should be operated from the bank rather than in stream channels in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into streams. This equipment should be inspected daily and maintained to prevent contamination of surface waters from leaking fuels, lubricants, hydraulic fluids, or other toxic materials. Page 4 23. In most cases, the DWQ prefers the replacement of the existing structure at the same location with road closure. If road closure is not feasible, a temporary detour should be designed and located to avoid wetland impacts, minimize the need for clearing and to avoid destabilizing stream banks. If the structure will be on a new alignment, the old structure should be removed and the approach fills removed from the 100-year floodplain. Approach fills should be removed and restored to the natural ground elevation. The area should be stabilized with grass and planted with native tree species. Tall fescue should not be used in riparian areas. 24. Riprap should not be placed in the active thalweg channel or placed in the streambed in a manner that precludes aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed. Thank you for requesting our input at this time. The NCDOT is reminded that issuance of a 401 Water Quality Certification requires that appropriate measures be instituted to ensure that water quality standards are met and designated uses are not degraded or lost. This section encompasses three different TIP projects - R-2530B, B-4974 and R-2527. The projects are included in the Draft 2007-2013 North Carolina Transportation Improvement Program and are scheduled for right of way and construction as follows: R-2527 - R/W FY 2010, Construction FY 2012; B-4974 - R/W FY 2011, Construction FY 2013; and R-2530B - R/W FY 2013, Construction FY unfunded. Project development studies began several years ago on the separate projects; however, they will now be combined into one study. Attached for your review and comments are the combined scoping information sheets for the proposed projects. Although you have already had an opportunity to comment on the projects individually, we would appreciate any additional information you might have that would be helpful in evaluating potential environmental impacts of the projects. We would appreciate your response by April 5, 2007. It is anticipated that a federally-funded Environmental Assessment will be prepared for these projects. TIP No. R-2530B. North Carolina Department of Transportation (NCDOT) is requesting comments from the North Carolina Wildlife Resources Commission (NCWRC) regarding impacts to fish and wildlife resources resulting from the subject project. Staff biologists have reviewed the information provided on the scoping sheets and have the following preliminary comments. These comments are provided in accordance with the provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to widen NC 24-27 to four lanes from NC 740 to west of the Pee Dee River. It appears the project will impact drainages of the Pee Dee River (Lake Tillery), including Mountain Creek and Jacobs Creek, both classified as WS-IV. The Pee Dee River is classified WS-IV and B CA. The Carolina creekshell (Villosa vaughaniana), Federal Species of Concern and state Endangered, and notched rainbow (V. constricta), state Special Concern, occurs in the Mountain Creek drainage. The eastern lampmussel (Lampsilis radiata), state Threatened, occurs in Jacobs Creek and other tributaries of Lake Tillery. Mussel surveys should be conducted in any directly impacted perennial streams. If state or federally listed species are found, NCDOT should consult with the appropriate resource agencies. Strict sedimentation and erosion control measures will be important for this project. More information will be required on project truck volume, avoidance options, etc. during the merger process and hydraulic design review. ¦ Within the Yadkin-Pee Dee Basin, sedimentation and storm water runoff are major water quality concerns. In order to reduce sedimentation in receiving waters, same day seeding and mulching is strongly encouraged. Storm water runoff from the project should be designed to be directed to grassed swales, buffer areas, preformed scour holes, retention basins or other site-appropriate means of receiving pre-treatment, rather than routed directly into streams. ¦ Sediment and erosion control measures should not be placed in wetlands. Project Description The proposed project will include widening NC 24/27 to a four lane median divided facility from NC 740 to multi-lanes west of the Pee Dee River. The proposed project is approximately 5.5 miles long. Existing Typical Section Existing NC 24/27 is a two to three lane facility with grass shoulders. Proposed Typical Section NC 24/27 is proposed as a four-lane median divided facility. Curb and gutter is proposed within the city limits of Albemarle. Grass shoulder will be constructed outside the city limits. A 23-foot median is proposed within the city limits and a 46-foot median is proposed outside the city limits. The city of Albemarle has requested sidewalks be constructed within the city limits. Project Development and Environmental Analysis Branch Staff (PDEA) will coordinate with the city further to obtain their agreement on sharing in the cost of the sidewalks. Right of Way The existing right of way on NC 24/27 is 60-100 feet. Approximately 150-200 feet of right of way will be required to accommodate the proposed improvements. Intersections There is currently a traffic signal at the intersection of NC 740 and NC 24/27. All other intersections are stop sign controlled. Stoney Gap Road, Valley Drive and Indian Mound Road are locations under consideration for new signals. Access Control Existing NC 24/27 has no control of access. No control of access is proposed within the city limits and partial control of access (one access per parcel) will be obtained outside the city limits. Utilities The utility impact rating for the proposed project is medium. Existing utilities in the project area include telephone, power and water and sewer within the city limits. Adjacent Projects TIP Project R-2527 - This project involves improvements to NC 24/27 from east of the Pee Dee River to the Troy Bypass. The schedule for R-2527 includes right of way acquisition for Section A in Fiscal Year 2008 and construction in FY 2010 and right of way acquisition for Section B in FY 2007 and construction in FY 2009. Proposed Alignment The existing alignment will be the only alignment alternative studied for the widening of NC 24/27. Traffic Volumes The current year (2003) volumes for NC 24/27 range from 9,400 to 14,500 vehicles per day (vpd). Projected 2030 volumes range from 19,000 to 30,000 vpd. Cost The 2004-2010 TIP cost for the proposed project is $17,600,000 which includes $400,000 for right of way acquisition and $17,200,000 for construction. The current estimated cost for the proposed project is $22,700,000 which includes $400,000 for right of way acquisition (TIP) and $22,300,000 for construction. Additional Comments The proposed project meets the FHWA logical termini criteria because it ends at an existing multi-lane section. However, additional discussion regarding logical termini and cumulative effects may be required. Sufficient right of way will be required to accommodate relocating power poles along the proposed project. Approximately 18-22 feet will be required within the proposed right of way limits. The Hydraulics Unit recommends widening NC 24/27 to the north to lessen impacts to parallel streams located along the south side of NC 24/27. Portions of the project are within the water supply watershed critical area, so hazardous spill catch basins will be required at stream crossings within the critical area. Two known populations of the schweinitz's sunflower exist within the project area. Known populations of Georgia aster also exist along the project. Michael Turchy, Office of Natural Environment, will forward maps identifying the locations of these species. Currently, the eastern terminus of this project is west of the Pee Dee River. An existing four-lane median divided section with dual bridges over the river exists in the vicinity of the river. This multi-lane section transitions to two lanes on either side of the river. Bridge No. 51 which carries the westbound lanes of NC 24/27 over the Pee Dee River, is in poor condition and is very narrow. The replacement of this bridge is not currently programmed in the TIP. A question has been raised as to whether this bridge should be replaced as a part of either this project or Project R-2527. After some discussion, it was decided the northern most Pee Dee River bridge will not be replaced as a part of this project. Per the Program Development Branch, federal bridge replacement funds can be used to replace this bridge therefore, it should be a separate project. Division 10 ranks this bridge replacement 5' of 15 in the Division. NC Division of Water Quality has requested the proposed project follow the merger process in a letter dated January 13, 2004. The suggestion was made that PDEA staff meet with the Corps of Engineers representative and FHWA to discuss after wetland and stream delineations are obtained for the project. The Uwharrie National Forest is located east of the Pee Dee River. It is believed this project is outside the National Forest Boundary, but PDEA staff will confirm location of boundary. North Carolina Department of Transportation (NCDOT) is requesting comments from the North Carolina Wildlife Resources Commission (NCWRC) regarding impacts to fish and wildlife resources resulting from the subject project. Staff biologists have reviewed the information provided on the scoping sheets and have the following preliminary comments. These comments are provided in accordance with the provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to widen NC 24-27 to four lanes from NC 740 to west of the Pee Dee River. It appears the project will impact drainages of the Pee Dee River (Lake Tillery), including Mountain Creek and Jacobs Creek, both classified as WS-IV. The Pee Dee River is classified WS-IV and B CA. The Carolina creekshell (Villosa vaughaniana), Federal Species of Concern and state Endangered, and notched rainbow (V. constricta), state Special Concern, occurs in the Mountain Creek drainage. The eastern lampmussel (Lampsilis radiata), state Threatened, occurs in Jacobs Creek and other tributaries of Lake Tillery. Mussel survey should be conducted in any directly impacted perennial streams. If state or federally listed species are found, NCDOT should consult with the appropriate resource agencies. Strict sedimentation and erosion control measures will be important for this project. Wetland identification may be accomplished through coordination with the U. S. Army Corps of Engineers (USACE). If the USACE is not consulted, the person delineating wetlands should be identified and criteria listed. 4. Cover type maps showing acreage of upland wildlife habitat impacted by the proposed project. Potential borrow sites and waste areas should be included. 5. Show the extent to which the project will result in loss, degradation, or fragmentation of wildlife habitat (wetlands or uplands). .?' 6. Include the mitigation plan for avoiding, minimizing or compensating for direct and indirect degradation in habitat quality as well as quantitative losses. 7. Address the overall environmental effects of the project construction and quantify the contribution of this individual project to environmental degradation. Provide a discussion of the probable impacts on natural resources, which will result from secondary development, facilitated by the improved road access. 9. If construction of this facility is to be coordinated with other state, municipal, or private development projects, a description of these projects should be included in the environmental document, and all project sponsors should be identified. In reply to your correspondence dated January 5, 2004 (received January 7, 2004) in which you requested comments for the referenced project, preliminary analysis of the project indicates that the following water resources in Hydrologic Unit 030708 will be impacted: Stream (Index) Water Quali , Classification ¦ UT's to Mountain Creek (13-5) WS-IV ¦ UT's to Jacobs Creek (13-9) WS-1V ¦ Lake Tillery/Pee Dee River and UT's (13-(1)) WS-IV &B Critical Area NC 24-27 is described as a major rural collector. The purpose of the project is to improve safety and traffic carrying capacity. NC Division of Water Quality has the following comments: Environmental Documentation ¦ The environmental document should provide a detailed and itemized presentation of the proposed impacts to wetlands and streams with corresponding mapping. There should be a discussion on mitigation plans for unavoidable impacts. If mitigation is required, it is preferable to present a conceptual (if not finalized) mitigation plan with the environmental documentation. While the NCDWQ realizes that this may not always be practical, it should be noted that for projects requiring mitigation, appropriate mitigation plans will be required prior to issuance of a 401 Water Quality Certification. Planning and Access Control Issues ¦ From 2000 to 2020, the estimated population increase for Stanly is 21 percent. Growth management within the next five years will be imperative, especially along highway corridors, in order to protect or improve water quality in this sub-basin. Growth management can be defined as the application of strategies and practices that help achieve sustainable development in harmony with the conservation of environmental qualities and features of an area. On a local level, growth management often involves planning and development review requirements that are designed to maintain or improve water quality. ¦ The scoping letter was not specific as to the extent of the improvements to NC 24-27 being contemplated (number of lanes, typical sections, etc.). A qualitative analysis of cumulative and secondary impacts anticipated as a result of this project may be required. More information will be required on project truck volume, avoidance options, etc. during the merger process and hydraulic design review. ¦ Within the Yadkin-Pee Dee Basin, sedimentation and storm water runoff are major water quality concerns. In order to reduce sedimentation in receiving waters, same. day seeding and mulching is strongly encouraged. Storm water runoff from the project should be designed to be directed to grassed swales, buffer areas, preformed scour holes, retention basins or other site-appropriate means of receiving pre-treatment, rather than routed directly into streams. ¦ Sediment and erosion control measures should not be placed in wetlands. Sediment should be removed from any water pumped from behind a cofferdam before the water is returned to the stream ¦ Borrow/waste areas should not be located in wetlands. It is likely that compensatory mitigation will be required if wetlands are impacted by waste or borrow as well as utility relocations. ¦ Onsite wetland delineation shall be performed prior to application for §401 Certification. ¦ Wetland and stream impacts should be avoided to the maximum extent practical. If this is not possible, alternatives that minimize wetland impacts should be chosen. In accordance with the NCDWQ Wetlands Rules 115A NCAC 2H.0506(b)(6)), mitigation will be required for impacts of greater than 150 linear feet to any single perennial stream In the event that mitigation becomes required, the mitigation plan should be designed to replace appropriate lost functions and values. In accordance with the NCDWQ Wetlands Rules 115A NCAC 2H.0506 (h)(3)1, the NC Wetland Restoration Program (NCWRP) may be available for use as stream mitigation. The Mountain Creek watershed, including Little Mountain Creek, is one of 55 watersheds in the Yadkin-Pee Dee River basin that has been identified by the NCWRP as an area with the greatest need and opportunity for stream and wetland restoration efforts. This watershed will be given higher priority than a non-targeted watershed for the implementation of NCWRP restoration, projects. Please contact NCWRP or the NC Division of Ecological Enhancement for more information if this project requires mitigation. ¦ DWQ prefers replacement of bridges with bridges. When practical, the DWQ requests that bridges be replaced on the existing location with road closure. Thank you for requesting our input at this time.
