This correspondence is in reference to the Forrest Creek Mitigation Bank located
approximately seven miles northeast of Hillsborough and six miles northeast of Durham in
northeastern Orange County, North Carolina. The purpose of this letter is to confirm the Year 2
credit release as requested in your letter of October 20th, 2009.
As shown in your amended Mitigation Banking Instrument the credit release schedule allows
for a 10% release of credits from the total of 7,072 restoration and enhancement credits. In
addition, because you have experienced two bankfull events in separate monitoring years you are
subject to an additional 15% credit release. This allows for a total release of 1,767 restoration
and enhancement credits for the second year of monitoring. By copy of this correspondence, we
confirm that you have satisfied the above requirements and that a total of 1,767 credits are now
available for sale.
