On August 8, 2015, Jenifer Carter of the Winston-Salem Regional Office conducted a Compliance
Evaluation Inspection at Bill's Truck Stop's wastewater treatment facilities. Mr. Luther Leonard, ORC, was
present during the inspection.
The following is a summary of findings during the inspection:.
A) You have an agreement with Mr. Leonard that you will mow, and rake the sand filter bed. As
noted during the last inspection, it is recommended that a written record of any maintenance you
perform be maintained for review should problems arise. Mr. Leonard should also maintain a
written record of maintenance he performs (i.e. when he adds dechlorination tablets to the
system).
B) The Grease traps and septic tank are pumped out regularly.
C) Mr. Leonard should calibrate his field meters daily, and check them against standards as required
by his field parameter certification.
D) Overall, the treatment system appears to be well maintained and operated.

On July 24, 2014, Jenifer Carter of the Winston-Salem Regional Office conducted a Compliance
Evaluation Inspection at Bill's Truck Stop's wastewater treatment facilities. Mr. Luther Leonard, ORC,
was present during the inspection. The following is a summary of items during the inspection that
require attention:
A) Mr. Leonard does not maintain a written record of maintenance that you personally perform and/or
hire out (i.e. raking the sand bed or having the septic tanks pumped out). Please make sure that you
maintain a written record of your activities as related to maintenance of the system.
B) The subject permit expired on May 31, 2014. Federal [40 CFR 122] and state (15A NCAC
2H.0105 (e)) regulations require that an application for permit renewal be filed at least 180 days prior to
expiration of the current permit. To satisfy this requirement, your renewal package should have been
sent to the Division postmarked no later than December 2, 2013.
As of this date, the Division has not received your renewal application. This is a violation of Part II. B.
10. of your permit, which states "Any permittee that has not requested renewal at least 180 days prior
to expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6
and 33 USC 1251 et. seq.". Your facility is operating without a valid NPDES permit. To prevent an
assessment of civil penalties you must submit a completed permit application (see enclosed
forms) no later than August 8, 2014.
Use the enclosed checklist to complete your renewal package. The checklist identifies the items you
must submit with the permit renewal application. If all wastewater discharge from your facility has

On August 15, 2013, Jenifer Carter of the Winston-Salem Regional Office conducted a Compliance Evaluation
Inspection at Bill's Truck Stop wastewater treatment facilities. Mr. Luther Leonard, ORC, was present during the
inspection. The inspection consisted of two parts: an on -site inspection of the treatment facility and a review of
facility files and self -monitoring data.
A review of the submitted self -monitoring data for previous year revealed one minor limit violations. The violation
has been addressed separately through the Division's monthly enforcement program.
The following is a summary of findings during the inspection:.
A) You have an agreement with Mr. Leonard that you will mow, and rake the sand filter bed. It is
recommended that such an agreement be put in writing, and that a written record of any maintenance you
perform be maintained. Mr. Leonard will also maintain a written record of maintenance he performs (i.e.
when he adds chlorine or dechlorination tablets to the system).
B) The Grease traps and septic tank are pumped out regularly.
C) Mr. Leonard should calibrate his field meters daily, and check them against standards as required by his field
parameter certification.
D) Overall, the treatment system appears to be well maintained and operated.

On November 1, 2011, Jenifer Carter of the Winston-Salem Regional Office conducted a Compliance
Evaluation Inspection at Bill's Truck Stop wastewater treatment facilities. Mr. Luther Leonard, ORC, was
present during the inspection. The inspection consisted of two parts: an on -site inspection of the treatment
facility and a review of facility files and self -monitoring data.
A review of the submitted self -monitoring data for the period of August 2010 through July 2011 revealed a
couple of minor limits violations. The violation has been addressed separately through the Division's monthly
enforcement program.
With respect to the administrative portion of the facility's self -monitoring program, no deficiencies were
noted. The following is a summary of findings during the inspection.
A) Facility records were well organized and current.
B) The Grease traps and septic tank are pumped out regularly.
C) Copies of the permit are kept on site and with the operator.
D) The treatment system appears to be well maintained and operated.

We feel that this activity will meet the intent of 15A NCAC 02T .0303 (a), (4) as this outfall is being placed in a DOT right-
of-way and will not require any review or approval documents from this agency. As noted earlier the discharge point
will not be changed, the design will be compliant with minimum design criteria and final plans of the new section of
outfall will be provided to Bills Truck Stop.

GEORGE-1 have discussed this with Corey Basinger, Water Quality Regional Supervisor and since the discharge location
will not change, the outfall will be totally on DOT right-of-way and is being relocated with their concurrence, we consider
it to be acceptable to proceed with the project. You should provide Bill's with plans showing the location of their new
forcemain and outfall. The outfall must be designed to meet minimum design criteria. Should you have any questions,
please advise.

The .mapped locations of our outfall.s were historically determined. by either Central. Office or Regional. Office
personnel. A transparent grid was laid over the relevant section of a USGS Quad map (1:24,000 scale); the staff
member calculated the outfall lat/long by eyeballing the map.
The outfall location at NCO040045 was done long before anyone in the Division had access to GPS data or a means
to collect it.
We have not, and ZLL NOT, issue an NOV (or an enforcement) against this permittee for outfall lat/long data,
because:
1. The Division, not the permittee, generates the outfall lat/long data in the permit.
2. The permit modification[s] that granted the outfall relocation[s] did not require a specific latitude/longitude
for the outfall. They did provide a receiving stream and location, but no lat/long data.
3. Regional Office personnel are regularly checking and updating lat/long data with handheld GPS devices.
Bill's Truck Stop is among many sites that need corrected data.

Bill's Truck Stop in Davidson County was under an SOC (SOC 90-53) requiring them to relocate their outfall by July 1,
1993. Would you have enough info in your files to show where the outfall was, both before and after it was relocated?
If you care, the issue is coming up due to a new DOT project in the area of the existing outfall, which the contractors
claim is not where the permit says it's supposed to be. If they received permission to put it where it is, the contractors
get to pay the added expense of relocating it. If it's in an unapproved location, the owner of Bill's may have to pay to
relocate it (so the contractor thinks). Of course, there are other layers of complication that I will not bore you with.
I thought, if I had said details about the SOC, I might be able to end the numerous phone calls asking why we won't
make them move their outfall 100' up the same tributary since 'it wasn't where it was supposed to be'.

Jenifer - there's no mention of the 1983 letter in the old files here.
In 1990, Robert Walser requested an outfall relocationfrom his original discharge point to the
mainstem o outbh Potts Creek. His 60GO �PD--recircu i g sandfilter system was installed in 1989
and couldn't meet the zero -flow limits for ammonia & BOD.
Mike Mickey sent a memo to the Central Office on 8/1/1990 which stated:
"Evaluations by the Davidson County Health Department have determined that suitable soil does not
exist on site or in the area surrounding the facility. Prior to August 1989 all wastewater... had been
routed to a nitirfication line system. However, due to serious failures and pressure from the Health
Department, Mr. Walser was forced to reactivate his NPDES permit and replace the abandoned
sandfilter. It should also be noted that the nearest Lexington sewer line is more than five miles
away."
The mod was approved.
Problems arose when the outfall line was being installed, forcing another modification of the permit
to a 2nd location. e continuing noncompliance led Walser to apply for and receive SOC 90-53,
which required him to complete outfall relocation by 7/1/1993.
I don't have anything in the files from the 1994-2004 period. Not happy about that, but BIMS shows
the facility discharging to South Potts Creek by 1999.
So, the Health Department apparently hounded Walser into installing the 6000 GPD system. Now
they want to Inow why he's discharging at all.
If he has a non -discharging system, when was it installed?
Who approved it?

Please read the attached letter dated June 13, 1983 from WSRO to Bill's Truck Stop. I know it is hard to read, especially
the last paragraph that states, 'If these are not accomplished before permit reissuance then similar conditions could be
included in the renewed permit according to Title 15, Chapter 2H .0112(b) (1). In either event the applicant must be
advised that should the connection to filter system be activated and wastewater again discharges in violation of permit
limits that there is a potential for enforcement action. Obviously they would also have to monitor any discharges.'
This letter was new to me until this morning, when I got a call from the County Health Department asking why they were
still discharging from the sand filter. I didn't even know they had a conventional septic system until I got that call and
did some digging (in Steve Mauney's office). Apparently they are sending flow to both systems now, the sand filter and
their non -discharge system. Do you have anything that will shed light on the current situation? My files show nothing
further back than 5 years.
I have a message in to the owner of the system, so will let you know if I learn anything new.
