The Division has reviewed your request to suspend submission of monthly Discharge Monitoring
Reports (DMRs), based on the facility's destruction by fire on August 12, 2016. After considering
the recommendations of the staff in the Winston-Salem Regional Office, I have agreed to waive
the requirement to submit monthly DMRs for the subject facility, effective August 2016. The
DMRs up through (and including) July 2016 should be submitted as usual.
Be advised that if any wastewater discharge occurs, the discharge must be monitored as per the
terms of the NPDES permit and other applicable rules or statutes. Please keep the Winston-
Salem Regional Office apprised of any pertinent developments that arise regarding this facility,
especially if the discharge is re -activated.
While requirements for operator visitation, monitoring and reporting are being waived, you are
still required to pay the Annual Administering and Compliance Monitoring Fee that is associated
with this and all NPDES permits.

As you may be aware, on August 12, 2016, Valle Landing experienced a structure fire
that resulted in the building being a total loss. Following that event, there has been no
flow to the plant and there will be no flow for the foreseeable future.
To that end, we are formally requesting an inactive permit status and relief from
monitoring and daily visits until such time as there is no flow to the plant.

Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and
specify that, if a state does not establish a system to receive such submittals, then permittees must submit
DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these
regulations will be adopted and is beginning implementation in late 2013.
The regulations also provide that an NPDES-permitted facility may be granted a temporary waiver from
the NPDES electronic reporting requirements if the reporting facility:
1. Is physically located in a geographic area (i.e., zip code or census tract) that is identified as under -
served for broadband internet access in the most recent National Broadband Map from the
Federal Communications Commission (FCC); or
2. Demonstrates that such electronic reporting of the discharge monitoring data would pose an
unreasonable burden or expense to the NPDES-permitted facility.
Temporary waivers from electronic reporting are limited to one year in duration. However, an NPDES
facility may re -apply for a new temporary waiver if the conditions above are met. Re -application should
be submitted to the Division no later than sixty (60) days prior to the temporary waiver's expiration.
Upon the temporary waiver's expiration, if the NPDES-regulated facility did not re -apply for and receive
a new temporary waiver, then the NPDES facility must report the required NPDES discharge monitoring
data electronically using the NC DWR's eDMR system.
Temporary waivers are waivers from electronic reporting only. An NPDES-regulated facility receiving a
temporary waiver must provide the required discharge monitoring data on paper DMR forms (MRl 1 1
2, 3) or alternative forms approved by the Director. Failure to report is an enforceable violation of the
NPDES permit.

E-DMR STATEMENT
The Operator in Responsible Charge's parent company, which is a small, locally -owned
business, is responsible for an excess of thirty (30) wastewater systems. For our
approximately thirty (30) systems that we own or oversee operations of, under e-DMR
requirements, each operator must separately log in with an individual identification to
each system, rather than each operator having his or her own account for the multiple
systems they are responsible for. In addition, anyone who logs in sample data (i.e. our
laboratory manager conducting tests for compliance), must then also have the same
separate identification and login information for each individual account. Then, the
signatory who is required to certify the report must have the same individual login
requirements for each system. For at least three (3) individuals, more time-consuming
work is required in an already demanding field that requires the entirety of the work day,
and even time on call, to properly attend to operations, maintenance and testing duties.
After the individuals above have completed their respective duties and an electronic copy
of the report has been submitted, the operations company must still submit the paper
copies to the North Carolina DEQ that it always has.
In addition, W.Q. Labs is an equal -opportunity employer that does not discriminate
against its staff on the basis of age; employed with the company are several individuals
over the age of 65 who are operators or backup operators and who are unfamiliar with
current technology required to operate the e(DMR) system, as opposed to the current
system they are already accustomed to.
E-DMRs would be overly burdensome in addition to the already necessary
documentation for each location, and we respectfully request a waiver for the reasons
listed above.

The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports.

Sixty Days' Notice of Minor Modification of the Subject NPDES Permit
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process outlined in your existing permit. To
bring your permit up-to-date with the new reporting requirements, this letter serves to notify you that in
sixty days your NPDES permit will be modified to incorporate the new electronic reporting requirements.
The modification will require electronic reporting in place of paper -based reporting. Electronic reporting
will be required beginning as indicated above for Phases 1 and 2 reporting. Please attach the enclosed
NPDES Permit Standard Conditions PartIll —Addendum to your permit. This permit modification becomes
effective on August 1, 2016.
All other terms and conditions in the original permit remain unchanged and in full effect. This
modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated October 15, 2007.
If any parts contained in this modification are unacceptable to you, then you have the right to file a
petition for a contested case with the Office of Administrative Hearings within thirty (30) days following
receipt of this letter. This petition must conform to the requirements of Chapter 150B of the North
Carolina General Statutes. Petitions must be timely filed with the Office of Administrative Hearings, Post
Office Drawer 11666, Raleigh, North Carolina 27604. If you do not file a petition within the required time,
the agency decision shall be final and binding. If you have questions concerning this permit modification,

On August 5, 2015 George Smith performed a Compliance Evaluation Inspection Mr. Jadd Brewer, Grade III and Mr.
Christian Montgomery, Grade I, Back-up ORC were present for the inspection. The inspection is comprised of an overall
evaluation in order to document compliance and noncompliance of: facilities equipment, capability to meet effluent limits,
and terms & conditions with the NPDES permit.

The influent wet well red light and audio alarms are in working condition. There does not appear to be any overflows.
The aeration basin had a good rolling action, there was no foam. The color was brown. There was no odor. There is one
blower motor and it is operating.
The clarifier effluent was clear and no solids were present.
Chlorination was performed by adding Chlor-Away tablets in the clarifier weir trough.
De -chlorination was performed after the discharge of the effluent weir.
The facility grounds are not fenced. The plant is located in a remote area of the property. The electrical panels were in
good condition.

Flow Measurement
A 22.5° v-notch weir is present. The instantaneous effluent flow is measured by timing the flow into a 2 gallon bucket.
Laboratory
Field certification for pH, total residual chlorine, dissolved oxygen, and temperature is considered part of the full
certification issued to Water Quality Lab, Inc. (lab #544).
Mr. Montgomery performs pH as required per the permit; and this test is recorded on the daily monitoring report.
Effluent/Receiving Waters
The effluent discharges into an unnamed tributary to Dutch Creek, Class B; Trout waters.
The effluent was clear with no solids, no color, and no odor. The stream had some medium size fish up and downstream
of the discharge pipe 001.
Operations & Maintenance
Mr. Brandon Hughes, Grade U is the current ORC. The back-up operator is Mr. Christian Montgomery, Grade I.
The aeration basin is cycled 30 minutes off and 30 minutes on.
In the event the UV system is not working a back-up system is required until the UV system is repaired, if tablet
disinfection is used, then TRC monitoring is required.
Self -Monitoring Program
A review of the monthly self -monitoring reports from August 2014 through April 2015 revealed no violations.

On July 30, 2014 George Smith performed a Compliance Evaluation Inspection. Mr. Brandon Hughs,
ORC, Grade II and Mr. Jadd Brewer, Back-up ORC, Grade III were present for the inspection. The
inspection is comprised of an overall evaluation in order to document compliance and noncompliance of:
facilities equipment, capability to meet effluent limits, and terms & conditions with the. NPDES permit.

Flow Measurement
The instantaneous flow is measured by timing the flow into a 5-gallon bucket.
A 22.5° v-notch weir is present; however, flow cannot be accurately measured less than 0.006 MGD.
Therefore, this method is not available unless you can obtain a smaller v-notch weir.
Laboratory
Field certification for pH, total residual chlorine, dissolved oxygen, and temperature is considered part of
the full certification issued to Water Quality Lab, Inc. (lab #544).
Mr. Hughes performs pH, Temperature, Dissolved Oxygen, and Total Residual Chlorine as required per
the permit; and these tests are recorded on the daily monitoring report.
The total residual chlorine is performed with a Hach DR2400 spectrophotometer using the DPD
colorimetric method. The annual 5-point calibration was performed on April 18, 2014. A gel standard of
183 f 10% is used each day to verify the curve.
An YSI, Model 100 pH meter is used. A two point calibration with 4 and 10 buffers is performed and a
check at 7.0 SU. The calibration records are documented.
The temperature is measured with the pH meter and Dissolved Oxygen meter and is NIST traceable.

The field lab monitoring and documentation is considered to be very good.

We are pleased to present to you this year's Annual Wastewater Treatment Plant Report.
This report is designed to inform you about the quality of the wastewater we discharge to
the receiving waters every day. Our constant goal is to protect the environmental waters
of North Carolina. We want you to understand the efforts we make to continually
improve the wastewater treatment process and protect our water resources. We are
committed to ensuring the quality of the receiving waters that we discharge to.
If you have any questions about this report or concerning your wastewater utility, please
contact Paul Isenhour at (828) 898-6277. We want our valued customers to be informed
about their wastewater utility.
Let us first take this opportunity to give you a brief description of a Wastewater
Treatment Plant. The waters that go down the drain, follow many different pipes, and
ends up at the treatment plant. The wastewater goes through a bar screen that stops large
particles that are present (i.e., rags and papers). The water then goes to an aeration basin
where air is pumped into the water. This air supplies oxygen to bacteria that feed on the
solids that are in the water. The water then goes to the clarifier where the solids settle out.
The solids are pumped back to the aeration basin to give the bacteria a second chance to
feed. When there are too many solids in the plant, some of the solids are pumped to a
digester tank. In the digester, the bacteria have more time to feed on and reduce the
solids' volume. When the digester gets full, the solids are pumped from the tank and
taken to a larger facility. The clear water from the clarifier then goes to a tank for
disinfection. The two most prominent ways to disinfect the wastewater are chlorine and
ultraviolet light. Chlorine can be used as a gas or in solid tablet form. When chlorine is
used, there is generally a dechlorinating agent use to remove any excess chlorine from the
wastewater before it goes to the receiving water. When ultraviolet light (UV) is used, the
wastewater flows around the UV bulbs. Bacteria can not live when exposed to UV light,
so as the water passes the UV bulbs, the water in disinfected. Finally, after disinfection,
the treated wastewater goes into the receiving waters.
PERFORMANCE
The treatment plant did very well last year. We are very pleased to report that there were
no violations with effluent limits for the entire year. All of the samples that were taken
for the plant were under the limits set be the State Division of Water Quality.
NOTIFICATION
This annual report has been sent to the North Carolina Division of Water Quality and to
the owner of the wastewater system. The wastewater system owner has also been given a
letter that they can easily distribute to all their customers. The letter will inform the
customers that the annual report is available upon request to the owner of the system.
CERTIFICATION
I certify under penalty of law that this report is complete and accurate to the best of my
knowledge. I further certify that this report has been made available to the users or
customers of the named system and that those users have been notified of its availability

SUBJECT: Compliance Evaluation Inspection Valle Landing Shopping Center WWTP
NPDES Permit Number NC0035149, Watauga County
Dear Mr. Driscoll:
On November 24, 2009, Sue White of this office met with Denver Eggers, Operator for WQ
Labs and Operations to perform a Compliance Evaluation Inspection on the wastewater treatment
system servicing Valle Landing Shopping Center. This type of inspection consists of two basic
parts: an in office file review and an on -site inspection of the treatment facility. The following are
the findings from the subject inspection:
I. Permit
The NPDES permit expires on September 30, 2012. A permit renewal application must be
submitted to DWQ six months prior to expiration, or before March 31, 2012. Permit was on site in
accordance with permit regulations.
II. Self -Monitoring Program
The monthly self -monitoring reports (DMR's) were reviewed for the period of August 2008 through
July 2009. No reporting or limits violations occurred during this period.
III. Flow Measurement
Flows are estimated at this site.
IV. Sludge Handling and Disposal
Solids hauled by licensed septage hauler on as needed basis.
V. Operations and Maintenance
There were no apparent operations or maintenance issues at the time of the inspection.
VI. Facility Site Review
The 0.0035 MGD WWTP consists of the following components: Influent wet well and ultraviolet
disinfection.

We are pleased to present to you this year's Annual Wastewater Treatment Plant Report.
This report is designed to inform you about the quality of the wastewater we discharge to
the receiving waters every day. Our constant goal is to protect the environmental waters
of North Carolina. We want you to understand the efforts we make to continually
improve the wastewater treatment process and protect our water resources. We are
committed to ensuring the quality of the receiving waters that we discharge to.
If you have any questions about this report or concerning your wastewater utility, please

about their wastewater utility.
Let us first take this opportunity to give you a brief description of a Wastewater
Treatment Plant. The waters that go down the drain, follow many different pipes, and
ends up at the treatment plant. The wastewater goes through a bar screen that stops large
particles that are present (i.e., rags and papers). The water then goes to an aeration basin
where air is pumped into the water. This air supplies oxygen to bacteria that feed on the
solids that are in the water. The water then goes to the clarifier where the solids settle out.
The solids are pumped back to the aeration basin to give the bacteria a second chance to
feed. When there are too many solids in the plant, some of the solids are pumped to a
digester tank. In the digester, the bacteria have more time to feed on and reduce the
solids' volume. When the digester gets full, the solids are pumped from the tank and
taken to a larger facility. The clear water from the clarifier then goes to a tank for
disinfection. The two most prominent ways to disinfect the wastewater are chlorine and
ultraviolet light. Chlorine can be used as a gas or in solid tablet form. When chlorine is
used, there is generally a dechlorinating agent use to remove any excess chlorine from the
wastewater before it goes to the receiving water. When ultraviolet light (UV) is used, the
wastewater flows around the UV bulbs. Bacteria can not live when exposed to UV light,
so as the water passes the UV bulbs, the water in disinfected. Finally, after disinfection,
the treated wastewater goes into the receiving waters.
PERFORMANCE
The treatment plant did very well last year. We are very pleased to report that there were
no violations with effluent limits for the entire year. All of the samples that were taken
for the plant were under the limits set be the State Division of Water Quality.
NOTIFICATION
This annual report has been sent to the North Carolina Division of Water Quality and to
the owner of the wastewater system. The wastewater system owner has also been given a
letter that they can easily distribute to all their customers. The letter will inform the
customers that the annual report is available upon request to the owner of the system.
CERTIFICATION
I certify under penalty of law that this report is complete and accurate to the best of my
knowledge. I further certify that this report has been made available to the users or
customers of the named system and that those users have been notified of its availability
as per the NOTIFICATION section above.
