Dear Mr. Fatland:
A review has been conducted of the self -reported Bypass 5-Day Report submitted on February 27, 2019. The
Division's Asheville Regional Office (ARO) concludes that the City of Brevard violated Permit Condition Part
II.C.4.c.1: Bypass from the treatment facility is prohibited and the Permit Issuing Authority may take enforcement
action against a Permittee for bypass.
Specific incident cited in the violation includes the following:
An approximately 1,000-gallon unauthorized bypass downstream of the Rotating Biological
Contactors on February 22, 2019 to The French Broad River due to heavy rain and the pumping
capacity of a newly installed pump station.
This Notice of Violation (NOV) is being issued for the noted violation of North Carolina General Statute (G.S.) 143-
215.1 and the facility's NPDES Permit. Remedial actions, if not already implemented, should be taken to correct the
above noncompliance and to prevent future noncompliance.
