Box 14005 Research Triangle Park" NC 27709 Subject Property: Water Garden Property - 8500 Glenwood Ave. (PIN: 0777861245) On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B .0233)) Dear Mr. Yates: On January 8, 2010, at your request Eric Kulz of the DWQ 401 Oversight and Express Permitting Unit and John Donley with the DWQ Policy and Program Development unit conducted an on-site determination to review a stream feature located on the subject property for applicability to tile NeLISC Buffer Rules (15A NCAC 2B .0233). The feature is labeled as "A" on the attached maps initialed by Eric Kulz on January I I" 2010. The Division of Water Quality (DWQ) has determined the following: Feature "A" is subject to the Neuse Buffer Rule throughout the property. The ponds depicted in the maps have been drained. The Neuse riparian buffer remains along the pond margins until a new, buffer as described in 15A NCAC 02B .0233(4) is established along the stream channel. Zone 1 must be planted with at least two native hardwood species at a density sufficient to provide 320 trees per acre at maturity. Zone 2 must be stable and vegetated, but may consist of maintained areas (grassed lawn). This on-site determination shall expire live (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ that a surf-ace water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o C'yndi Karoly. DWQ 401 Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Raleigh. NC 27604-2260. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision.
