of North Carolina General Statue 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection agency dated October 15, 2007 [or as subsequently amended].
If any parts,measurement frequencies or sampling requirements contained in this General Permit
are unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made,the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.

a) 7.5 minute series USGS topographic map(or a photocopied portion thereof)with discharge
location clearly indicated.
b) Site map, if the discharge is not directly to a stream,the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of astorm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer(or engineering firm), include
documentation from the applicant showing that the engineer(or firm)submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Professional Engineer and stamped-"Final Design-Not released for
construction".

The Marshall Plant consists of 2 turbines, one of which is curreently in a state of repair. The plant is run
remotely by the Walters Plant in Haywood County and is inspected at least once per week by members of
the Walters staff. I am informed that unit#1 will be operational in FY 2007.
The Plant has one discharge point(001). The discharge is combined streams of generator thrust bearing
cooling water and powerhouse sumps that is collected in a holding tend and discharged automatically. The
holding tank is equiped with an oil monitor, level alarms, pump�controls and sump pump.
The plant is very well maintained. The records are in excellent condition.

Your facility is currently covered for wastewater discharge under General Permit NCG500000. This permit expires
on July 31,2002. Division of Water Quality(DWQ)staff is in the process of rewriting this permit with a
scheduled reissue in the summer of 2002. Once the permit is reissued,your facility would be eligible for continued
coverage under the reissued permit.
In order to assure your continued coverage under the general permit,you must apply to the DWQ for renewal of
your permit coverage. To make this renewal process easier,we are informing you in advance that your permit
coverage will be expiring. Enclosed you will find a general permit coverage renewal application form. This
will serve as your application for renewal of your permit coverage. The application must be completed and
returned with the required information by February 01,2002 in order to assure continued coverage under the
general permit.There is no renewal fee associated with this process. Your facility will be invoiced for the annual
permit fee at a later date.
Failure to request renewal within this time period may result in a civil assessment of at least$250.00, Larger
penalties may be assessed depending on the delinquency of the request. Discharge of wastewater from your facility
without coverage under a valid wastewater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to$10,000 per day.

On February 24, 2006, our office received your letter dated February 23,2006,reporting that the
quarterly monitoring of discharges for pH had not been performed at the Marshall Hydroelectric Plant as
required in Part I, Section A(3) of the General Permit NCG500000 that became effective on August 1,
2002. It was also stated in your letter that while some pH data existed, it was collected from in-stream
monitoring points instead of the normal sample point and only performed on a semi-annual basis. As
you are aware,both the frequency and the location of the existing pH data is in direct violation of the
General Permit. Based on this information,the Division of Water Quality issues this Notice of
Deficiency for noncompliance with the General Permit.
Since your letter details the identification of this deficiency and offers corrective actions that
have already been taken to comply with the permit, we are not requesting a Plan of Action at this time.
Please insure that these measures are followed and that all permit requirements are met to avoid any
future deficiencies.

Dean Mr. Edwards:
Discharges from Walters and Marshall Hydroelectric Plants (as well as Blewett and
Tillery Hydroelectric Plants administered by the Fayetteville Regional Office) are
covered under NPDES permit—NCG500000. The most recent permit which was
effective August 1, 2002 contain quarterly pH monitoring requirements for discharges of
sumps and drains from the facility sampled in the tailrace. The previous NPDES permit
for these facilities did not contain a monitoring frequency for pH. During a recent in-
house self-assessment of the NPDES program for all Progress Energy hydroelectric
plants, it was found that pH was being sampled on a semi-annual basis instead of the
permit-required frequency of quarterly. For Walters, no pH data was recorded for the 1st
and 3" quarters in 2003 through 2005. For Marshall, no pH data was recorded for the 3r°
quarter of 2002 and the I" and 3 quarters of 2003 through 2005. During this same time
period of 2002 to 2005 flow and Oil and Grease were monitored at the permit-required
frequency of quarterly.
Following identification of this deficiency, procedures and data sheets were immediately
changed to reflect the correct monitoring frequency for pH and appropriate personnel
were notified of the quarterly monitoring requirement. Plant records for the time period
in question were reviewed and no operational activities had been undertaken or were
ongoing that would have adversely affected the pH of the sumps and drains at these
facilities. No chemicals are stored on site in such quantities that, if spilled, would alter
the pH of the discharge. No adverse impacts downstream of the discharge of either
Walters or Marshall were observed between August of 2002 and the beginning of the 41"
quarter of 2005.

The facility listed above is covered under NPDES General Permit NCG500000. NCG500000 expires
on July 31,2007. Federal(40 CFR 122.41)and North Carolina(15A NCAC 2H.0105(e))regulations require
that permit renewal applications must be filed at least 180 days prior to expiration of the current permit. If
you have already mailed a renewal request,you may disregard this notice.
To satisfy this requirement,the Division must receive a renewal request postmarked no later than

PART IV - EVALUATION AND RECOMMENDATIONS
1 . Carolina Power and Light Company has requested renewal of
NPDES Permit No. NC00027545 for the Marshall Hydroelectric
Plant. The wastewater consists of the following discharges :
(- � 001 - Oil and Water Separator - A sump and pump are located
J on the bottom floor of the powerhouse and collect water and
oil from the turbine area and switch yard area. The oil and
water are pumped to ground level to an oil and water
separator and oil storage tank. The discharge is to the
French Broad River. Since this system rarely discharges, an
alarm device was installed to allow the operator to know
when there is a discharge, so samples can be collected.
002 - Draft Tube Drain Pumps - The draft tube drain pumps
dewater the draft tube extension below the wicket gates,
when work is to be performed in that area. These pumps are
only operated during maintenance activities and pump water
from the draft tubes into the tail race area.
003 Cooling Water Drains - The two cooling water drains
discharge river water from the lube oil unit and speed
increaser oil coolers into the tailrace area. The cooling
water system operates on a continuous basis with a maximum
flow of approximately 75 gpm through each drain when each
unit is operating.
2.. Note: I recommend the removal of the following statement
in the 003 limits page of the current permit. "The pH shall
not be less than 6 . 0 standard units nor greater thatn 9 . 0
standard units. " The pH of the river water used to cooling
( cannot be controlled by the permittee. This river water is

Pursuant to North Carolina General Statute ("NCGS") §105-275(8), Progress Energy Carolinas,
Inc. is requesting tax exemption certification for qualifying water pollution control equipment
currently installed at the Marshall Hyrdroelectric Plant (the"Plant"), located in Marshall,
Madison County, North Carolina. The qualifying water pollution control equipment, operating
in accordance with the terms and conditions of National Pollutant Discharge Elimination System
Permit No.NCG500591,is detailed in the attached Exhibit 1.
In accordance with NCGS §105-275(8), Exhibit I details the Plant's water pollution control
devices and appurtenances, which are "[RIM and personal property that is used... exclusively
for ... waste disposal or to abate,reduce or prevent the pollution of... water ...".

• Cooling Water is withdrawn from the penstock and used to cool machinery and
lubricating oil in the plant by use of heat exchangers (non-contact cooling). There
is one discharge for each of the two generating units.
Although the cooling water discharged is warmer than ambient water temperature,
the impact on the French Broad River is negligible due to low discharge flow and
temperature differential. The cooling water flows,which are less than one-half cubic
foot per second (cfs) are insignificant compared to the flow of the river, which
averages approximately 2500 cfs at the plant. Previous monitoring of temperature
has demonstrated that the heat input to the river does not result in a violation of
water quality thermal standards.
• Water from floor drains and oil contaminated water from the switchyard area catch
j basin area are routed through an oil/water separator prior to discharge to the river.
• Water from the draft tube extension area is essentially only river water that is
pumped out to dewater the turbine area for infrequent maintenance or repairs.
Turbine shaft seal leakage is also discharged at this location.
• A small quantity of intake filter backwash water is discharged to the river.

Dear Mr. Goodrich:
Carolina Power and Light Company's Marshall Hydroelectric Plant currently discharges
wastewater in accordance with an individual NPDES permit (NCO027545). CP&L is
interested in modifying Marshall Plant such that it is similar in its operation as the other
C hydroelectric plants owned by CP&L. These hydroelectric plants— Blewett, Tillery, and
Walters—are covered under general permit NGC500000. To allow Marshall Plant to be
eligible for general permit NGC500000, CP&L would modify the plant to reroute all
potentially contaminated wastewater to the sumps of the plant. The discharge of the
sumps would be routed to the internal side of the intake screens for both units. An
oil/water detector would be installed in the sump to secure the discharge in the event of
an oil spill. The current oil/water separator will be removed from service. In the event of
an oil spill, the oily waste will be pumped to holding tanks to await disposal by
appropriate means. In a meeting with Tom Belnick of your office it was stated that an
ATC for the proposed modifications would not be needed.
A Notice of Intent (NOI) has been enclosed for the general permit NCG500000. CP&L
formerly requests that the individual NPDES permit (NCO027545) be rescinded after the
Marshall Plant is covered under the general permit.
Flow schematics of the existing and proposed piping flow are attached to the NOI.

systems. The rating scale for classification of Biological Water Pollution Control Treatment
Systems, found at 15A NCAC 8G .0302, was adopted by the Commission to classify water
pollution control systems. The classification of a facility is determined by the permitted flow
and the requirement to achieve biological nutrient reduction.
Due to the fact that the Marshall Hydroelectric Facility's NPDES permit (NC0027545) has been
rescinded, the Water Pollution Control System Operators Certification Commission rule
requirement for certified operators is not longer applicable. Please be aware that this facility
may be subject to future requirements.

NC00027545 was rescinded in January 2001 and replaced with
General Permit NCG50091 on January 19, 2001.
As a result, you are no longer required to make weekly ORC (operator in
responsible charge) visitsto the Marshall facility. You are not
required to submit monthly monitoring reports. You are not required to
sample in accordance with the old NCO027545 permit. requirements.
To confirm this, I will fax you a copy of the General Permit's first and
second. pages showing the issuance date.
I understand that you have a copy of the new permit's monitoring
requirements and that you are sampling quarterly for oil & grease.

I think this would be great!
Go ahead and issue this as a general permit (as CP&L has had done at other
facilities) , instead of an NPDES oil & water separator.
I have already discussed this with the folks at CP&L and they are anxiously
waiting for this change. They went ahead and relocated the operator (ORC)
100 miles away, but he is still making weekly visits to this facility (as
required) .
He will be very glad when we get this fixed and he no longer has to drive
back up here from the Rockingham area for these weekly visits.

This letter is intended to inform you of planned activities at the Marshall Hydroelectric Plant. These
activities have been discussed between Ms.Wanda Frazier of your staff and Mr. Ricky Miller of CP&L.
As you are aware the Marshall Plant's NPDES Permit has an outfall identified as 001. Outfall 001
collects stormwater and wastewater from different locations at the Marshall Plant. The wastewater
consists of water collected from various seals and packing where river water enters the plant.
CIt is CP&L's intention to take the water collected in this system and evaporate it. Outfall 001 will still be
retained as a discharge point and any discharge will be monitored,as required by the permit.7t should be'noted that this system has not discharged in over a'year:'Enclosed for yourinformation is a pamphlet that t.
describes the equipment for the planned installation. ._
By evaporating the water in the system and carefully monitoring the system,it will lessen,the chance of

Dear Mr. Davis:
This letter is intended to inform you of planned activities at the Marshall Hydroelectric Plant. These
activities have been discussed between Ms.Wanda Frazier of your staff and Mr. Ricky Miller of CP&L.
As you are aware the Marshall Plant's NPDES Permit has an outfall identified as 001. Outfall 001
collects stormwater and wastewater from different locations at the Marshall Plant. The wastewater
consists of water collected from various seals and packing where river water enters the plant.
C� It is CP&L's intention to take the water collected in this system and evaporate it. Outfall 001 will still be
retained as a discharge point and any discharge will be monitored, as required by the permit. It should be
noted that this system has not discharged in over a year. Enclosed for your information is a pamphlet that
describes the equipment for the planned installation.
By evaporating the water in the system and carefully monitoring the system, it will lessen the chance of
any pollutant entering the river. If you have any questions concerning the planned installation please call

r 3-5-97 Talked to Ricky Miller (from Raleigh) . He reported that
`- at 3 : 35 AM this morning a bearing oil seal ruptured due to high
temperatures. Repairs were made and one pint of oil was used to
replace what was lost . They also reported it to Fink Biner of
the National Response Center since it entered the waters of the
US. (Unrelated note: 3000 CP&L employees had been laid off,
there were 6000 left . )
7-11-97 Talked to Ricky Miller. He asked that we correct our
mailing list .

7-11-97 (con't) We discussed eliminating the oil and water
C separator discharge by the installation of an evaporator that
would evaporate 55 gallons every 24 hours . "Maxie" currently has
1000 gallon storage capacity. This would not require an annual
fee or regular NPDES permit, only a General Permit would be
required.
1-15-98 Talked to Ricky Miller. They would like to order the oil
and water evaporator discussed back in July ' 97. He will send us
a letter and manufacturer' s specifications and diagram. The
evaporator will allow them to decrease their requirement for
pumping (by Holston) to only 5 gallons of oil generated per year.
1-19-98 (2 : 05 PM) Talked to Ricky Miller. Told him what Roy
Davis had to say about it . Gave him the OR to order and install .

It has recently come to my attention that P&L' s Marshall Da has an
individual NPDES Permit and all other dams are ffiS:• d" neral
permit . It doesn' t matter much to me, but I thought you'd like to
know since the FRB basin is up for renewal. This was brought up
because CP&L requested renewal for their old NPDES permit at Walters .
Ricky Miller received a letter from DEM informing him that they no longer had
an individual permit. He was quite surprised to find this out !

Identification of Terms Used in Flow Diagram
Upper Packing Leakoff River water flowing through the turbine that escapes
around the runner shaft.
Lower Bearing Water to the lower bearing provides a separation between
the bearing and bearing sleeve.
Emergency Water Reservoir Tank This tank provides a gravity feed water supply that would
protect the lower bearing in the event of a loss of power
shut down.
Draft Tube Drain Pump This pump is used to drain river water from the unit so
- maintenance can be performed.
Inactive North Filter Present plans call for removal of this filter.
