Dear Mr. Kichefski,
Please reference the letter dated May 15, 2020 sent by the US Army Corps of Engineers (Corps)
regarding the status of the mitigation compliance for the Tryon International Equestrian Center
(TIEC). The mitigation project known as the Harmon Dairy Mitigation to the permit application
submitted by C1earWater Environmental Consultants, Inc. (CEC), on behalf of Tryon Equestrian
Partners, LLC represented by Mr. Jeff Brown. The Corps requested information on the following
six items.
1. Provide an As -built report
Clearwater has completed portions of the As -built report; however, CEC has only received
survey data from Patton Surveying the last week of May. The As -built report will be
submitted by June 30, 2020.
2. Details for completion of any required corrective actions on the site
The As -built report will detail remaining corrective actions. This report and necessary
corrective actions will be provided by June 30,2020.
3. An explanation for TIEC's permit non-compliance and how non-compliance will be
prevented during the remaining phases of the mitigation project.
TIEC was limited on all construction, infrastructure, planning costs including the Harmon
Dairy Mitigation project for much of 2019-20. On or about May 7, 2020 TIEC secured the
necessary funding to complete the mitigation project and continue with development
operations at TIEC. This funding includes the necessary means to follow through with the
required corrective actions, seven years of mitigation monitoring, invasive species
treatment as needed for the successful completion of the project.

4. Updated timeline for the completion of the remaining components of the mitigation
plan.
Following the submittal of the as -built report, CEC is scheduled to conducted MYl
monitoring of the streams in July and vegetation monitoring in August. The MY01 report
will be submitted by December 31, 2020. If necessary, a separate report will be submitted
that documents any corrective actions that are necessary.
5. Details regarding the project stability to include whether adaptive management is
necessary to ensure success.
This data is still being assessed and will be included in the As -built report. The As -built
report will be submitted by June 30, 2020.
6. A Copy of executed Financial assurance
TIEC is working on finalizing their financial assurances for the Harmon Dairy Mitigation
Project. TIEC will submit a copy of the executed assurances by June 30, 2020.
