PROJECT SUMMARY: The applicant proposes to deepen an existing man-made canal, create and bulkhead a high ground boat basin, and construct one jet-ski lift and one boathouse with a boatlift. FIELD INVES'TIUATION REPORT: SHIRLE GRAY PAGE 2 9. NARRATIVE DESCRIPTION: Project Setting The applicant, Shirle Gray, owns two tracts of land located at the terminus of Brices Court (SR1909) at 921 Brices Court, which are adjacent to a man-made canal off Brices Creek near New Bern, Craven County. The lots have a combined total of 1.074 acres.and are approximately 4' to 5' above the NWL. Ms. Gray currently resides in asingle-Family brick dwelling, which is centrally. located on the project property. Ms. Gray has. also constructed a concrete drive to the residence and a storage shed on the east side of the property. An on-site septic system is located to the south of the residence. The property is predominantly vegetated with sod grass and a few cypress trees. The property has 2391inear feet of shoreline, of which, 69 feet on the north side of the property has been stabilized with a wooden bulkhead. Presently there are no docks or slips within the canal adjacent to the applicant's property. There is a 40' wide x 100' long area of Section 404 Wetlands along the southeastern shoreline adjacent to the manmade canal, which forms the eastern property boundary. The property to the immediate north has asingle-family residence on it and is protected along the entire shoreline with a wooden bulkhead that connects with the applicant's bulkhead. The property to the south of the project site is currently. undeveloped. The canal adjacent to the project currently has a depth of -2' to -2.5' below NWL and connects into Brices Creek where the water depths are in the range of -6' to -10' below NWL. The canal is approximately 24' wide and 175' long. Evidence.from the site visit indicates the canal was man- made, however, the applicant was unable to provide documentation to substantiate the field evidence. The canal bottom consists of silty sand. Brices Creek is classified by the EMC as C; Sw, NSW. The creek is not classified by the Division of Marine Fisheries or the Wildlife Resources Commission either as a primary or secondary nursery area. No submerged aquatic vegetation was observed in the project vicinity during the site, visit. The creek has been listed as closed to the harvesting of shellfish by the Division of Environmental Health's Shellfish Sanitation Branch. The Craven County Land Use Plan categorizes this area of the county as Residential, with all AEC's classified as Conservation. Project Proposal The applicant proposes to excavate and deepen the existing canal, create and bulkhead a boat basin out of high ground, construct a boathouse with a lift, and construct ajet-ski lift. To accomplish this the applicant proposes to excavate a 10' long x 7.5' wide area at the mouth of the canal and a 175' long x 24' wide section of the canal to a final depth of -6' NWL. This would result in an average of 3' of silty sand being removed from the bottom of the canal. The sides of the excavated area would be sloped to meet the surrounding canal bottom at a ratio of 1:1. The excavation would be performed by abarge-mounted excavator and would result in a total of 469 cubic yards of spoil material. To create the boat basin adj acent to the canal, a 32' long x 16' wide area of high ground would be excavated. The basin would also be excavated to a final depth of -6' NWL to allow for the dockage of a boat that draws approximately 5' of water. A total of 190 cubic yards of silty sand would be excavated from high ground for the basin construction. No Coastal Wetlands or Section 404 Wetlands would have to be excavated to construct the basin. FIELD INVESTIGATION REPORT: SHIRLE GRAY PAGE 3 A,11 spoil material resulting from the project would be stored on the property. A 48' x 48' spoil disposal site is proposed between the northern property line and the applicant's residence. The spoil material would be built up to a maximum height of 10' above the existing grade and would accommodate 713 cubic yards of spoil. The spoil would be contained with a 3' high silt fence. The spoils would be allowed to dry and ultimately leveled and stabilized on the property. Since the high . ground excavation is to be performed with a.barge-mounted backhoe, no effluent discharge is proposed. • To stabilize the sides of the basin and the shoreline, 221 linear feet of wooden bulkhead is ~: proposed. The bulkhead would begin on the nortli side of the basin, follow the proposed perimeter of the basin to its southwest corner; head in asoutherly direction along the landward edge of the Section 404 Wetlands and finally terminate on the north. side of the existing shed. ~ . Two boat slips are proposed in conjunction with the boat basin. A 12'6" x 12'6" boatlift is . proposed on the southwest side of the boat basin. This boatlift would be covered with a pitched roof to create a 16' x 24' boathouse. The boathouse would extend 4' out into the 24' wide existing canal. Also in the proposed boat basin, a 4' wide x 7' long uncovered jet-ski lift is planned immediately to the north of the proposed boathouse. The boat basin and slips are proposed a minimum of 21' .from the northern riparian line and 177' from the southern riparian line. Anticipated Impacts • The excavation would disturb 4,275 sq. ft. of shallow water bottom within the man-made canal adjacent to Brices Creek. This will result in 469 cubic yards of silty sand being removed from the • canal and deposited in the on-site high ground spoil disposal area. The boat basin construction will result in 190 cubic yards of silty sand being excavated from high ground. Approximately 512 sq. ft. of high ground will be excavated for the construction of the basin, which would not impact any Coastal Wetlands or Section 404 Wetlands. This will result in the creation of 512 square feet of public trust area and inland waters. The spoil disposal area as proposed will contain approximately 713 cubic yards of material and will result in the disturbance of 2,304 sq. ft. of high ground for drying, and ultimately spread over 16,635 sq. ft. of high ground. • The bulkhead is proposed to be built landward of the normal water level and will not result in any fill being placed within Public Trust Waters. The boathouse and jet-ski lift would usurp 332 sq. ft. of Public Trust Waters and Public Trust Area, which will be created from high ground by the excavation of the boat basin. The proposal as submitted would add two slips in an area currently closed to the harvest of shellfish, and will therefore not result in any additional closure of shellfishing waters. The boathouse would extend out 4' beyond the existing normal water line, but would not be expected to cause any negative navigational impacts. The roof overhang of the boathouse will project into the Division of Water Quality's Neuse River Riparian Buffer Zone and will increase the amount of impervious surface on the project site and within the NC Division of Coastal Management's 30' Public Trust Shoreline AEC by 80 sq. ft. to approximately 16% for the lot, and 1% within the Public Trust Shoreline. A localized and temporary increase in turbidity can be expected during the in-water portions of the construction of the piers, bulkhead, and dredging.
