This is to inform you that the Division has not received your monthly discharge monitoring reports
(DMR) for October 2014, December 2014, and January 2015.
This is in violation of Part II D. (2) of your NPDES permit, as well as 15A NCAC 2B.0506 (a),
which requires the submittal of DMRs no later than thirty calendar days following the reporting
period. You will be considered noncompliant with your NPDES permit until the reports are
submitted.
To prevent the assessment of civil penalties, please submit the missing reports to Charles Weaver
of my staff at the address listed below within fifteen (15) days of your receipt of this notice.
PLEASE NOTE: this letter provides notice that this office will recommend the assessment of civil
penalties if future reports are not received within the required time frame during the next twelve
(12) reporting months. Timely submittal of DMRs is essential to the efficient operation of the
NPDES program. We appreciate your assistance in this matter. If you have any questions about
this letter or discharge monitoring reports, please contact Mr. Weaver at the telephone number or

Per the terms of your NPDES permit, you were required to register for and begin using the Division of
Water Resources' electronic Discharge Monitoring Report (eDMR) system by 1/26/2015. Our records indicate
that as of the date of this letter, the subject facility has not submitted any data using the eDMR system.
Failure to register and begin submitting reports electronically is a violation of the terms of your permit,
subjecting you to a possible Notice of Violation and/or the assessment of civil penalties. In order to reduce
the risk of receiving additional enforcement action, you must complete your registration within 30 days of
receipt of this notice.
The Division has prepared a website devoted to all aspects of eDMR, including registration for its use,
obtaining an eDMR user account, and answers to frequently asked questions. You are encouraged to visit

Town of Denton Water Treatment Plant (WTP)

A compliance Evaluation Inspection was performed at the Town of Denton's WTP on March 3, 2015 by
Jenifer Carter of the Winston-Salem Regional Office. Ms. Tammie B. Melton, Operator in Responsible
Charge (ORC), was present for the inspection. This inspection consisted of a review of self -monitoring data
and an on -site inspection of the facility. The following observations were noted during the inspection:
• A review of self -monitoring data for the last two years did not reveal any NPDES permit limits violations.
All monitoring was performed and recorded per the frequencies specified in the permit.
• Upgrades to the plant are ongoing, and will include a new larger lined lagoon and new drying beds. With
regards to the ongoing construction, two preventative action items are noted:
o The new larger lagoon should have silt fencing installed during ongoing site work so that it does not
received a sediment load and, therefore, reduced settling capacity.
o Silt fencing was installed to keep sediment off of the temporary sludge storage area, but is still needed
on the back side of the stock piles in order to keep sediment on the site and out of nearby surface
waters. Although sites with land disturbance areas that are less than 1 acre do not require pre -approval
of Erosion & Sedimentation Control Plans, the requirement to keep sediment on site, as well as other
associated requirements, still apply.
As the Town knows, the town will be losing Ms. Melton, and will be designating a new ORC. Please make
sure the new ORC is able to work closely with onsite building contractors to ensure that proper operation of
the treatment systems continues to be possible during the ongoing construction.

Because putting the clear water in the bearmed area would leave no room to put the sludge from the #2 lagoon. They
are doing all they can do to get this runny mess cleared out, it is very challenging but it is working.

A compliance Evaluation Inspection was performed at the Town of Denton's WTP on May 20, 2014 by
Jenifer Carter of the Winston-Salem Regional Office. Ms. Tammie B. Melton, Operator in Responsible
Charge (ORC), was present for the inspection. This inspection consisted of a review of self -monitoring data
and an on -site inspection of the facility. The following observations were noted during the inspection:
The NPDES permit was recently renewed and became effective May 1, 2014. Continuous flow monitoring
is no longer required. Instead, instantaneous or estimated flow can be reported, along with duration of
discharge.
• A review of self -monitoring data for the last two years did not reveal any NPDES permit limits violations.

only lagoon in use that it does not received a sediment load and, therefore, further reduced capacity.

on the site, and out of nearby surface waters. Although sites with land disturbance areas that are less
than 1 acre do not require pre -approval of Erosion & Sedimentation Control Plans, the requirement to
keep sediment on site, as well as other associated requirements, still apply.
Ms. Melton continues to maintain optimal treatment conditions given the ongoing construction at the site,
and should continue to work with the contractor(s) on site to make sure their work does not impede her
ability to keep the WTP in compliance with all environmental permits and regulations.

I did observe this and I don't see a problem with it.
I haven't written my report yet, but I was planning to mention the need to keep sediment from running into the old
settling basin from the ongoing construction work (even if it less than one acre, which I don't think the contractors
realized). They are replacing one of two old lagoons with a bigger one, among other things. The old lagoon cannot afford
a sediment load, as it is already lacking capacity (they hit bedrock when digging the two old lagoons, so they never had
the capacity they were supposed to have, which is why they are replacing one now).
They also need silt fencing outside of the dirt berms around the stockpiled sludge. There were no problem during my
visit, but there is a stream through the woods from where the berms are.
With the precautions taken, I don't see a problem with approving their request.

The plant is currently under construction, but the work is not being done near any creek. I spoke with the wastewater
ORC of the Water Treatment Plant to see if she knew of anything in particular that was happening on or before May 5`h
when the complaint came in. She wondered out loud if it might coincide with the removal of a manhole along the
discharge line. Flow from the creek does backflow up the line during heavy rain events, and the contractors noted heavy
sediment blockage in the line during the removal of the manhole.
The ORC walked the site after talking to me and just reported that she did not observe anything getting into the creek at
the discharge pipe, nor anything leaving the construction site that might drain to it or any other creek. She plans to talk
to Project Manager to see if he knows of anything in particular that happened, and to make sure he educates those
working under him to report anything unusual.
For your information, the person referred to as Genie is the Town Clerk, and is at Town Hall, not the Water Treatment
Plant. The ORC does not believe the complaint was ever passed on to plant personnel. I have left a message for Genie to
call me tomorrow morning to see if she has any further information than what you received.
I also have a planned inspection at the plant next week, so will have the opportunity to look around myself.
Considering the call came in 10 days ago, and that more specific information was not provided (i.e. where exactly the
'dumping' was observed) the case is considered closed unless something new arises.

Water Treatment Plant and needed to stock pile the alum sludge residuals from the waste lagoon so
that construction could begin.
The new alum sludge storage area is behind the #2 basin so the new berm area can drain into the #2
lagoon so as to keep the water out of the construction area, We had to move quickly so as not to
unduly hold up construction so Town forces completed the new berm area several weeks ago. The
residuals from the alum sludge storage area will be properly disposed of at the Davidson County Landfill.

The Division has included a permit re -opener clause in the permit for Whole Effluent
Toxicity Monitoring [Section A. (4.)]. The Division includes this condition if the
permittee has demonstrated toxicity failures during the past permit cycle. We note that
this facility has failed 5 of 8 quarterly tests during the past 2 years.
Proposed federal regulations require electronic submittal of all discharge monitoring reports

A. (2.) CHRONIC TOXICITY PASS/FAIL MONITORING (QUARTERLY)
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent
versions.
The effluent concentration defined as treatment two in the procedure document is 90%. The testing shall
be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the
months of January, April, July and October. These months signify the first month of each three
month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained
during representative effluent discharge and shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code

Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid
for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the permittee re -applies for and is granted a new temporary
waiver by the Division.

Facility Summary
This facility is a Conventional water treatment plant with discharge of wastewaters from media filter
backwash and sedimentation basins with a design potable flowrate of 2.25 MGD and a maximum monthly
average wastewater discharge of 0.0186 MGD. Because the waste flow is <50k gpd, continuous flow
monitoring is not required. Phosphorous (TP) and Total Nitrogen (TN) is not required because flow is <50k
gpd and not discharging to Nutrient Sensitive Waters (NSW) . The facility consists of the following water
and wastewater treatment units:
• filters,
• settling basins,
• two (2) 100,000 gallon decant lagoons and
• dechlorination.
In July 2011 DWR issued an Authorization to Construct (A to Z No. 082949A01). A start date in March
2014 is anticipated but construct is not under contract. This authorization was awarded for the following
modifications:
• Installation of a new 200,000 gallon backwash lagoon [one (1) existing 100,000 gallon decant
lagoon will remain];
• (one (1) existing decant lagoons will remain);
• a new sludge pump station with two (2) 225 gpm submersible pumps;
• two (2) 1,200 ft2 sludge drying beds; and
• an effluent flow meter.

Toxicity — With an IWC >0.25%, this permit requires Chronic Whole Effluent Toxicity (WET) testing

January, April, July and October [TGP3B]. Five (5) out of the eight (8) toxicity tests over the past two
years were reported as "fail'. Therefore, DWR had inserted a toxicity re -opener clause [Section A. (4.)].
Renewal Summary — This permit reflects discharge at Outfall 001. DWR updated the facility description
and Map; added parameter codes to Section A. (L); added Electronic Reporting - Discharge Monitoring
Reports page. Added Permit Re -Opener for Whole Effluent Toxicity Monitoring [Section A. (4.)]
because of TOX test failure within three years; removed Fluoride monitoring; and removed Total
Phosphorous (TP) and Total Nitrogen (TN).
Stream — Discharge from WTP for Outfall 001 is into an unnamed tributary (UT) to the Yadkin River
[Stream Segment 12-(124.5)]. The segment from High Rock Dam to mouth of Cabin Creek [12-(124.5)a]
is currently listed as impaired in the 2012 North Carolina 303(d) List -Category 5 for Aquatic Life for the
parameters Chlorophyll a and Low Dissolved Oxygen.
RPA — A Reasonable Potential Analysis (RPA) was conducted on Copper, Fluoride, Zinc, Aluminum, Iron
and Manganese effluent parameters data because Discharge Monitoring Reports (DMRs) reported
concentration above method -detection levels (MDLs) for the past four and one half (4 1/2) years (May 2009-
Oct 2013). (The new 2014 Freshwater RPA - 95% Probability/95% Confidence was conducted prior to the
Draft permit with no changes to the following parameters.) [See attached RPA summary sheets.]
• Copper showed reasonable potential to violate state water quality standards (WQS). Since Copper
has an action level standard, quarterly monitoring will be maintained in conjunction with toxicity
testing.
• Fluoride did not show reasonable potential to violate state WQS; however, since the predicted
maximum effluent concentration was less than 50% of the allowable concentration no monitoring
will be required.
• Zinc showed reasonable potential to violate state water quality standards (WQS). Since Zinc has an
action level standard, quarterly monitoring will be maintained in conjunction with toxicity testing.
• Aluminum effluent data suggest reasonable potential to exceed the EPA Human Health standard of
8000 µg /L. Renewal requires monthly monitoring of Aluminum with a Monthly Average Limit of
8.0 mg/L. This limit will become active three (3) years from the effective date. Note: Looking at
sources for the high concentration of Aluminum in the effluent, there were no violations for TSS
noted in the data. The greatest value reported for TSS was 21 mg/L in August 2008. One reported
value of 12 mg/L of Aluminum exceeds the Human Health standard on 05/19/11. The reported
concentration of Aluminum may need to be verified with the laboratory.
Iron showed reasonable potential to exceed state water quality standards (WQS). Since Iron has an
action level standard, quarterly monitoring will be maintained in conjunction with toxicity testing.
Manganese effluent data suggest reasonable potential to exceed its standard of 200 µg /L. Renewal
will require monthly monitoring of Manganese with a Monthly Average Limit of 0.2 mg/L. This
limit will become active three (3) years from the effective date.

Facility Summary
This facility is a Conventional water treatment plant with discharge of wastewaters from media filter
backwash and sedimentation basins with a design potable flowrate of 2.25 MGD and a maximum monthly
average wastewater discharge of 0.0186 MGD. Because the waste flow is <50k gpd, continuous flow
monitoring is not required. The facility consists of the following water and wastewater treatment units:
• filters,
• settling basins,
• two (2) 100,000 gallon decant lagoons and
• dechlorination.
In July 2011 DWR issued an Authorization to Construct (A to Z No. 082949AO1). A start date in March
2014 is anticipated but construct is not under contract. This authorization was awarded for the following
modifications:
• Installation of a new 200,000 gallon backwash lagoon [one (1) existing 100,000 gallon decant
lagoon will remain];
• (one (1) existing decant lagoons will remain);
• a new sludge pump station with two (2) 225 gpm submersible pumps;
• two (2) 1,200 ft2 sludge drying beds; and
• an effluent flow meter.

Toxicity — With an IWC >0.25%, this permit requires Chronic Whole Effluent Toxicity (WET) testing
using Ceriodaphnia dubia to be performed as a 7-day pass/fail test at 90% effluent concentration, during
January, April, July and October [TGP3B]. Five (5) out of the eight (8) toxicity tests over the past two
years were reported as "fail". Therefore, DWR had inserted a toxicity re -opener clause [Section A. (4.)].
Renewal Summary — This permit reflects discharge at Outfall 001. DWR updated the facility description
and Map; added parameter codes to Section A. (L); added Electronic Reporting - Discharge Monitoring
Reports page. Added Permit Re -Opener for Whole Effluent Toxicity Monitoring [Section A. (4.)]
because of TOX test failure within three years; and removed Fluoride monitoring.
Stream — Discharge from WTP for Outfall 001 is into an unnamed tributary (UT) to the Yadkin River
[Stream Segment 12-(124.5)]. The segment from High Rock Dam to mouth of Cabin Creek [12-(124.5)a]
is currently listed as impaired in the 2012 North Carolina 303(d) List -Category 5 for Aquatic Life for the,
parameters Chlorophyll a and Low Dissolved Oxygen.
RPA — A Reasonable Potential Analysis (RPA) was conducted on Copper, Fluoride, Zinc, Aluminum, Iron
and Manganese effluent parameters data because Discharge Monitoring Reports (DMRs) reported
concentration above method -detection levels (MDLs) for the past four and one half (4 1/2) years (May 2009-
Oct 2013). [See attached RPA summary sheets.]
• Copper showed reasonable potential to violate state water quality standards (WQS). Since Copper
has an action level standard, quarterly monitoring will be maintained in conjunction with toxicity
testing.
• Fluoride did not show reasonable potential to violate state WQS; however, since the predicted
maximum effluent concentration was less than 50% of the allowable concentration no monitoring
will be required.
• Zinc showed reasonable potential to violate state water quality standards (WQS). Since Zinc has an
action level standard, quarterly monitoring will be maintained in conjunction with toxicity tasting.
• Aluminum effluent data suggest reasonable potential to exceed the EPA Human Health standard of
8000 µg /L. Renewal requires monthly monitoring of Aluminum with a Monthly Average Limit of
8.0 mg/L. This limit will become active three (3) years from the effective date. Note: Looking at
sources for the high concentration of Aluminum in the effluent, there were no violations for TSS
noted in the data. The greatest value reported for TSS was 21 mg/L in August 2008. One reported
value of 12 mg/L of Aluminum exceeds the Human Health standard on 05/19/11. The reported
concentration of Aluminum may need to be verified with the laboratory.
• Iron showed reasonable potential to exceed state water quality standards (WQS). Since Iron has an
action level standard, quarterly monitoring will be maintained in conjunction with toxicity testing.
• Manganese effluent data suggest reasonable potential to exceed its standard of 200 µg /L. Renewal
will require monthly monitoring of Manganese with a Monthly Average Limit of 0.2 mg/L. This
limit will become active three (3) years from the effective date.
Decant basins may not provide enough settling detention time resulting in higher effluent concentrations for
Aluminum and Manganese. The facility will undergo improvements including a new 200,000 gallon
backwash lagoon. This new lagoon may improve the concentrations of Aluminum and Manganese in the
long run.

The Town of Denton continues to move forward towards construction of the proposed
improvements to address the temporary storage of alum sludge residuals on site. The proposed
improvements include:
Construction of a new 200,000 gallon backwash lagoon, sludge transfer pump station, and drying
beds (2) to improve alum sludge residuals management at the existing Denton WTP. One (1) of
the two (2) existing earthen lagoons will continue to be utilized for extended detention times,
extended settling, and redundancy as necessary for decant water to the NPDES permit. The
subnatant from the drying beds will return to the new backwash lagoon. The dried solids will
continue to be land -filled. The Town has received Authorization to Construct approval from
DWQ and PWS for the proposed upgrades.
This project has been recently delayed as outlined below:
• March. 2012 — NC DENR / PWSS informed the Towit of Denton they were to receive g2.4 M in principal
forgiveness and the remaining S1.204M in 09 loan under the 2011 DWSRF program. We discussed
with Denton and replied to NC DENR / PWSS by e-mail we desired these terms.
• March, 2012 — Denton requested clarification from DWQ on expectations for NPD1S permit compliance
via my e-mail of March 8, 2012
• 3/22/12 —NC DENR / PWSS formally submitted the PROJECT request to LGC for approval with the loan
terms outlined above
• 6/4/12 —NC DENR / PWSS notified the Town of Demon's engineering agent via e-mail "there were
additional documents needed before they could issue the Part A (Offer and Acceptance of the Loan
Agreement)" including an update to the Town's Water System Management Plan (WSMP) and a clear
site certification. Prior to 6/4/12, we had reasonably assumed we had met RTP status based upon the
prior submittals deeming the WSMP complete. We received no indication to the contrary from PWS
between 3/22/12 and 6/4/12. The clear site certification was submitted in August. 2012, with the
updated WSMP. but could have been subnutted at any time prior to 5/31/12 had it been communicated
to us we were not in RT11 status as of 3/22/12 when the project went forward to LGC. As staled, there
were no land acquisition requirements associated with the project.

Prior to 6/4/12, we were operating under the presumption we had already met RTP status based
upon the facts above and the 3/22/12 correspondence by NC DENR/PWSS to LGC.
• 10/25/ 12 —Town of Denton supplied NC DENR / PWSS with a timeline of events and submittals
demonstrating we had previously met the terms of RTP status by May 31.2012.
• 10/3(1/l2 — Per telephone conversation between NC DENR / PWSS and Denton's engineering
agent. NC DENR / PWSS acknowledged a mistake had been made and they intended to make
the original loan offer whole again
• 12/20/12 — Receipt of Part A Offer of loan Agreement — 12/21/12
• January — February, 2013 — Prepared and Submitted Contract Documents and M13E requirements
for approvals by NC DENR
• March — April. 2013 — Review final MBE: requirements and final project requirements with the
Owner
• May - June 2013 — Proposed Solicitation
*June — August. 2013 — Receive Bids. Award and Approvals by Owner and NCDENR
• September— October 2013 — Start Construction
• December, 2014 — Complete Construction

Hello Tammie and Troy:
I have spoken to my supervisor, Sherri Knight, and would like to provide clarification on the following issues, most of
which will be included in a Notice of Violation (NOV) letter. Thanks in advance for your attention to these matters:
1) Town Manager on file; I was able to update our database to reflect Victor Pizzurro as Town Manager and no
further action is required;
2) Our database does list Troy Branch as the primary ORC, however, a back-up ORC is required. The Town of
Denton will need to designate a back-up ORC. This may be accomplished either by having Tammie complete the
training and/or designating an operator from Southern Soil Builders;
3) The 'Signature of Preparer' on Annual Land Application Certification Form (DENR FORM ACF) is the signature of
the ORC that prepares the residual to meet pathogen/vector attraction reduction as defined in 40 CFR Part
503.9. It is my understanding that Troy Branch currently prepares the residual and therefore is correctly signing
the certification form. However, no 'land applier' signature was provided on 2011 or 2012 Annual Reports;
4) Annual Reports for 2011 and 2012 submitted to DWQ were incomplete. I have received some data from Zach
Key (Southern Soil Builders) and will be requesting in the NOV letter both reports be resubmitted;
5) Three issues noted from review of 2011 and 2012 annual reports -
a. Not all land application events were documented (both in 2011 and 2012)
b. pH temperature correction calculations were incorrect
c. Lime stabilization for the December 14, 2012 event illustrated a failure to stabilize prior to land applying
d. Field 5 pH is 5.3 and the permit requires pH>6. For fields where lime stabilized residual is applied this
typically is a non -issue, however, additional lime will need to be added if future soils analyses
demonstrate this deficiency;
6) Nuisance conditions at land application site, Field 4; countless feminine hygiene plastics were observed on Field
4 and require removal;
7) All records associated with the Friday, May 3, 2013 land application event will need to be submitted. Please
send hauling records, lime stabilization calculations, field summary form, an estimate of how many acres were
utilized (i.e. percentage of Field 4's 16.60 wettable acres that received residuals) AND verification of land
application equipment calibration;
8) Records of all WTP residuals (Oct. 2012 and April 2013?) transported by Newsome Grading will need to be
submitted. This should include dry tons removed/disposed/applied as well as location of where residuals were
land applied or disposed;
9) The NOV letter will request a realistic timeline to ending the temporary storage of WTP residuals. Brad Bucy of
Hobbs & Upchurch contacted me last week and stated he would send a letter outlining a timeline for
construction to commence at the WTP. I will notify both of you if/when I receive his letter; your assistance in
assuring DWQ receives this letter is greatly appreciated. Additionally, filter media stored (outside of fenced
area) at WTP is a residual as defined by 15 NCAC 2T .0103(30) (ref., Attachment). The recommendation will be
removal of this residual as the temporary storage provision expires. This residual could be analyzed and land
applied according to the permit or disposed of properly in a landfill. And,
10) Due to the number of issues identified during this inspection and to alleviate concerns about how the Town of
Denton is managing its residuals, please notify me, at a minimum of 24 hours, prior to your next land application
event (June 2013?).
I expect the NOV letter to be sent this week and the Town of Denton will have 30 days from receipt to submit a
complete response. If any questions arise, please contact me.

The Division of Water Quality (DWQ) has received your e-mail correspondence of March 8, 2012,
requesting clarification regarding DWQ's expectations with regard to operations at the Town's water
treatment plant (WTP). The primary concern expressed by the Town was DWQ's determination of
compliance with NPDES permit conditions, specifically how potential delays in completion of the WTP
upgrade project (which includes improvements to wastewater treatment infrastructure) may affect the
WTP's compliance status.
As you know, the State implemented a new strategy in 2007 for the regulation of wastewater discharges
from WTPs. The strategy's goal is to better protect surface waters through the identification of
pollutants characteristic of WTP wastewater discharges. The strategy was implemented for the Town of
Denton WTP during its 2009 permit renewal. The renewed permit required new or modified monitoring
for a number of parameters, most notably flow and whole effluent toxicity. The permit called for flow
to be monitored continuously, but provided an eighteen month compliance schedule for the installation
of an adequate flow measurement device. The compliance schedule was modified in 2011 to extend the
deadline for installation of the flow meter until January 1, 2013, in accommodation to the schedule of
the overall WTP construction project. The whole effluent toxicity requirement within the permit called
for monitoring only, but was to be reported as "pass" or "fail" with regard to the toxic effects of the
discharge on aquatic life. Since the monitoring requirement was instituted the WTP has reported
failures on seven of eight whole effluent toxicity tests.
Inherent in the issuance of NPDES permits is DWQ's firm expectation that permittees can and will
comply with the conditions contained therein. DWQ is required to enforce compliance of the permits it
issues. In the case of the Town of Denton WTP, DWQ feels that the extension of the compliance
schedule granted in the 2011 permit modification has provided the Town adequate time to install a
suitable flow measurement device. Documentation of all volumes of flow discharged by the facility is a
very important issue in determining its potential impact on water quality. As such, we will not grant any
additional extension of time in this matter. Therefore, if the flow meter is not installed and continuous

flow measurements are not being reported by the January 1, 2013 deadline, the facility will be
noncompliant with the terms of the NPDES permit and may be subject to appropriate enforcement
action.
While there is currently no compliance evaluation in the matter of whole effluent toxicity testing, the
facility's reported failures of toxicity tests are of concern to DWQ. It is possible that future permits will
have requirements to identify and eliminate the causes of the toxicity failures. Therefore, the Town is
encouraged to complete its wastewater treatment upgrades at the WTP as soon as possible.
A final matter of concern to DWQ involves the facility's long term strategy for management of waste
solids generated by the facility. Too high accumulations of solids in the lagoons at the site have been
cited in past inspections as the cause of solids escaping the treatment works and entering the receiving
stream. This matter was initially resolved by the facility depositing excess solids within a bermed area
adjacent to the lagoons. However, this arrangement was approved only as a temporary means for the
storage of solids. The facility upgrade calls for improvements in the facility's ability to manage its
solids inventory. These improvements have the potential to resolve a long standing problem at the
facility, and to enhance the quality of the wastewater it discharges. DWQ finds these to be compelling
reasons for the Town to complete the project as soon as possible.

A letter of request for an Authorization to Construct was received July 26, 2011, by the
Division of Water Quality (Division), and final plans and specifications for the subject project
have been reviewed and found to be satisfactory. Authorization is hereby granted for the
construction of modifications to the existing Water Treatment Plant, with discharge of treated
wastewater into an unnamed tributary to the Yadkin River in the Yadkin -Pee Dee River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a new 200,000 gallon backwash lagoon; a new sludge pump station
with two (2) 225 gpm submersible pumps; two (2) 1,200 ft2 sludge drying beds;
and an effluent flow meter, in conformity with the project plans, specifications,
and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NCO082949 issued November 2, 2009, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0082949.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S. 143-215.1 and in a manner approved by the Division.

In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by the Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Winston-Salem Regional Office, telephone number (336) 771-5000, shall be notified
at least forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to: Construction Grants & Loans,
DWQ/DENR, 1633 Mail Service Center, Raleigh, NC 27699-1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class 11, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Prior to entering into any contract(s) for construction, the recipient must have obtained all
applicable permits from the State.

Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division in accordance with North
Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

We at the Town of Denton spectfully request an extension on one item on our permit
issued November 2, 2009, permit number NC0082949. We are asking for a minor
modification.
We are requesting a longer time frame for the installation of flow monitoring equipment
for our lagoons discharge. Specifically we are requesting that we be allowed to collect
grab flows weekly as we were doing prior to the March 2011 deadline, given by your
office. This is due to the extended submittal of the plans and the funding time frames.
Plans were submitted to your office on May 26`h, 2011 by Brad Bucy with Hobbs and
Upchurch, for your review. (This has the time frames on it) Part of the request is
extending the deadline to Dec. 31, 2012. This should allow for everything that needs to
be done. We will contact your office when it completed.
It would be a hardship for the Town of Denton, if something were to be put in at this
point, as funding for this is included in the upgrade. If something were to be put in now,
it would still have to be approved by your office, and it would have to be taken out during
the upgrade. We at The Town of Denton want this project to be done so that we are
incompliance with our permit, and done so that it will serve as an effective means of flow
determination for years to come, and not be piece milled with possible problems in the
future. We have a limited staff at the Water Treatment plant and safety issues could result
in collecting daily flow samples as we have killed snakes at the outfall site. Two people
need to collect samples due to this. Some days there is only one operator here at the plant.
Our schedule now is set so that we can have two operators on duty the day that we
collect.
We ask for any and all consideration and discretion that DWQ would allow on this
project. We have been diligent in making sure, through sheer dedication of operators and
myself; that we comply with all directives given by your office. Please consider our
request.

Additional information was requested on January 8, 2010 in addition to Annual Report Review conducted on January 8,
2010. The request was to follow up on a Permission for Temporary Storage of Alum Residuals issued on August 28,
2006. The additional information was received on February 10, 2010.
Upon review of the additional information it was noted that an engineering firm was hired to make design improvements,
which includes expanded sludge backwash lagoons. These lagoons will include geotexile or concrete liners, sludge
transfer pumps, and on site drying beds with an appropriate underdrain system. The design will also evaluate the use of a
sludge removal system either for existing basins and/or the proposed improvements. It is our understanding that the Town
of Denton is budgeting funds through a Loan Application currently filed with USDA Rural Development. These
improvements to the water plant are anticipated to be completed by the end of 2011. In addition, hauling records and
receipts were provided that indicated proper disposal of the residual solids.
This additional information satisfies the requirements to find an ultimate solution for treatment and proper disposal of the
Alum Residuals that were outlined in the August 28, 2006 letter.
Upon review of the information the Winston-Salem Regional Office of the Division of Water Quality Aquifer Protection
Section grants an extension to the permission for the temporary storage of alum sludge in the trenched area adjacent to the
lagoon provided that any runoff would flow into the lagoons. Please notify the Aquifer Protection Section Winston-Salem
Regional Office when construction for the improvements begins and are completed. A permit modification application
with proposed plans will need to be submitted to the Surface Water Protection Section when prepared.

A compliance Evaluation Inspection was performed at the Town of Denton's WWTP on December 11,
2009 by Jenifer Carter of the Winston-Salem Regional Office. Ms. Tammie B. Melton, Operator in
Responsible Charge (ORC), was present for the inspection. This type of inspection consists of two basic
parts: an in office review of facility files and self -monitoring data, and an on -site inspection of the facility.
A review of self -monitoring data for the period of November 2007 through October 2009 revealed no
limits violations. All monitoring was performed and recorded per the frequencies specified in the permit.
The two lagoons on site were originally designed to be much deeper than they are because bedrock was
exposed during construction. The Aquifer Protection (AP) Section of the Division of Water Quality
granted temporary permission to store alum sludge in drying beds next to the lagoons in a letter dated
August 24, 2006, while alternatives to increasing treatment capacity and sludge removal were
investigated. Plans for upgrades, drafted by Hobbs & Upchurch include two new lined lagoons, back
flow prevention, continuous flow monitoring equipment and a new drying bed.
The plant was operating properly at the time of the inspection. Ms. Melton has done a good job
maintaining optimal treatment conditions given the limited sludge storage available.

As noted in the previous inspection report, the WTP does not have the sludge capacity in the lagoons that
they were designed to have due to rock being struck during their construction. This has presented a
challenge, especially during wet weather. As a result, they have been given temporary permission by the
Aquifer Protection Section to store alum sludge in drying beds next to the lagoons while alternatives are
investigated.
Hobbs & Upchurch have been hired to help out with the upgrades, which may begin sometime in 2010. In
the DRAFT plans, improvements include two more lagoons with liners, back flow prevention, continuous
flow monitoring equipment and a drying bed.

carefully to ensure thorough understanding of the conditions and requirements it contains.
The draft permit a number of changes in the monitoring requirements from those found in your current
permit. These changes were made as part of the NPDES strategies for wastewater discharges from
potable water treatment plants, which are being implemented throughout the state as permits are issued
and/or renewed. Some of these changes are:
• The facility has been given a flow limit based on the highest reported flow that occurred over the
past three years.
• Monitoring requirements for Settleable Solids and Turbidity have been removed from the permit.
• Monitoring requirements for Calcium, Magnesium, Manganese, Fluoride, Copper, and pH have been
added based upon studies of discharges from conventional water treatment facilities. Please note the
permit contains provision for reduction or removal of monitoring for particular parameters if it can
be shown there is no reasonable potential for their presence in the effluent.
• Monitoring requirements for Total Zinc and Ammonia Nitrogen have been added to the draft permit.
If the facility does not use and does not plan to use either zinc orthophosphate as a corrosion
inhibitor or chloramines as an alternate form of disinfection, these parameters may be removed from
the final version of the permit.
• The monitoring frequency for Aluminum has been reduced to quarterly; monitoring for Total Iron
has been reduced to monthly.

A. (2.) CHRONIC TOXICITY MONITORING (QUARTERLY)
The permittee shall conduct quarterl chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent
versions.
The effluent concentration defined as treatment two in the procedure document is 90 %. The testing
shall be performed as a Ceriodaphnia dubia 7day pass/fail test. The tests will be performed during
the months of February, May, August and November. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the

to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT
Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.

On June 22, 2005 Shannon Thornburg with the Central Office gave a verbal agreement to Chris Alexander with Precision
Land Application, Inc. for the Town of Denton WTP granting approval for a temporary one-time stockpiling of the WTP
residuals within the bermed area. This agreement required that the material had to be solid and there would be a time
limit on the stockpiling and that a formal request letter should be submitted to the Central Office so that a written approval
could be issued. Chris Alexander submitted a formal letter to the Central Office on July 27, 2005. This letter sought
permission "to store, on a temporary basis, dried alum sludge from their Water Treatment Facility". Specifically, the
letter sought permission "to store dried alum sludge adjacent to the two alum sludge lagoons on the WTP's property". It
was indicated in the letter that "the two alum lagoons are surrounded by an earthen berm that provides adequate storage
area within the berm for the dried alum sludge" and that "all surface runoff from rain water would be contained with the
berm and drained into the two alum lagoons".
An inspection on August 4, 2005, by Steve Mauney with the Winston-Salem Regional Office Division of Water Quality,
for NPDES Permit No. NCO082949 found the Town of Denton WTP to be in violation for the following:
That the treatment basins at the Denton Water Treatment Plant need to be cleaned out so that they can properly
settle the solids generated in the water purification process. Solids have escaped the treatment facility and
reached the receiving stream. (There appears to be adequate room to store the solids within the earthern-diked
area at the facility.)
A permit renewal and modification was received on October 10, 2005 for the Town of Denton's Land Application of
Residual Solids Permit No. WQ0016966, which included the addition of the Town of Denton WTP as an approved
residual source -generating facility for 160 maximum dry tons per year. On May 26, 2006, the permit renewal and
modification was issued with the Town of Denton WTP listed in Attachment A.

From a phone conversation with Tammy Melton, ORC, with the Town of Denton WTP, it is our understanding that the
Town of Denton seeks permission to continue to store alum sludge in a trenched area adjacent to the lagoon where any
runoff would flow into the lagoons under Non -discharge Permit No. WQ0016966. It was also understood that there were
concerns about the lining of the present lagoons in reference to any requirements needed to be met to be in compliance
with groundwater standards.
Upon review of this information the Winston-Salem Regional Office of the Division of Water Quality Aquifer Protection
Section grants permission for the temporary storage of alum sludge in the trenched area adjacent to the lagoon provided
that any runoff would flow into the lagoons and that a permanent storage method would be constructed such as additional
lagoons and/or drying bed. Operation of this method of storage should be in compliance with performance standards in
Condition 1. Land 3. of Non -discharge Permit WQ0016966 and in compliance with NPDES Permit No. NC0082949.
Previous inspections indicated that saprolitic material or weather bedrock has been exposed in the lagoons. Maintenance
of the lagoons should be implemented to prevent further erosion and rock exposure. Minimum design requirements that
apply to the present lagoons, any proposed lagoon, and trenches such as the ones that are being used temporary to store
alum sludge are found in North Carolina Administrative Code 15A NCAC 02H.
Carefully review all permit conditions and design requirements addressed in this letter and respond in writing to this
office within thirty (30) working days of receipt of this letter. If you should have any questions, please do not hesitate to

A letter of request for an Authorization to Construct was received May 15, 1995 by the Division
and final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of two underdrained alum sludge lagoons with
discharge of treated wastewater into an unnamed tributary to the Yadkin River which is classified Class
WS-III and B CA waters in the Yadkin -Pee Dee River Basin.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES
Permit No. NCO082949 issued October 24, 1994, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0082949.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Winston-Salem Regional Office, telephone number (910)771-4600, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and

Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment
facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. The
Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
