PART III - EVALUATION AID RECOMMENDATIONS : Mrs . George Jones has made applicationfor a permit to discharge domestic wastewater into an unnamed tributary to the Linville River from a house located at G.F. Company Development. The Avery County Health Department has denied approval of a conven- tional septic tank nitrification field due to high groundwater and pro- ximity to several small streams. Also, the house is located in an area of the development not sewered. Two small streams join together just below the property line and the dilution ratio is estimated to be greater than 50 to 1 . Division of Water Resources North Carolina Environmental Quality and Water Resources Asheville Regional Operations Center 2090 US 70 Highway Swannanoa, North Carolina 28778 Dear Mr. Topolski, This letter serves as an addendum to my letter of April 26, 2016 (copy enclosed) concerning the Single Family Residence Wastewater Treatment System at my home on 314 Hillside Drive, Linville, North Carolina. Several weeks after my April 26 letter to you, I received information from the daughter of the former homeowner confirming that there was, in fact, a chlorinator somewhere on the property. Subsequent to speaking with Mr.:Mike Garlock,.Owner of Triple T Pumping, Ihad them come out again on Monday, May 23 to put a camera in the septic system to locate the chlorinator, which was found in optimal condition and with ample chlorine tablets in the two chlorinator tubes. Since previous NCDENR inspection reports sent to me since ownership in 2005, along with your latest NCDENR inspection report of April 14, 2016, do not reference the locations of the systems inspected, please make note in your files of the exact locations of the septic system and chlorinator on my property at 314 Hillside Drive, Linville, NC, as follows: Septic System—As you face the front of the house, the septic system is to the left in the landscape bed adjacent to the stone wall approximately 15 feet from the stone walkway. There is a small green Triple T Pumping flag in this area, although soil currently covers the top of the system. Chlorinator—As you face the front of the house, the chlorinator is to the right in the landscape bed adjacent to the generator. There is a very large,.heavy round concrete top covering the chlorinator and upon:opening you will find two white chlorinator tubes, which are currently filled with an ample supply chlorine tablets. Again, I trust this extra effort satisfies any questions of compliance you might have. The wastewater treatment system referenced above was installed by the previous owner, Mrs. George Jones. During the months of October-April,the home is winterized and the water cut off by Grandfather Golf and Country Club's dedicated licensed plumber. Unfortunately, I have no previous maintenance documentation to provide, as my husband routinely handled all household upkeep and he is now deceased. To ensure compliancy and satisfy that everything is In optimal working order, I contracted the services of Triple T Pumping, Boone, North Carolina,to inspect the septic system. Box 785 Linville NC 28646 Subject: Certified Operator Requirements Single Family Treatment Systems NPDES Permit No. NCG550192 Avery County Dear Jones:. During February of this year, public hearings were held on proposed changes to modify the operator certification rules. The proposed rules included a requirement that single-family discharge systems would be classified wastewater treatment facilities, which would require an annual inspection by a certified operator. The intent of the rule was to insure that the systems are being properly operated and maintained. During the public comment period, a significant amount of comments, statements and additional information was submitted. As a result, the Water Pollution Control System Operators Certification Commission amended the proposed rules. The rule, as adopted and effective July 1, 1993, now requires single-family discharging systems to be classified only if they are permitted after July 1, 1993 or if upon inspection by the Division of Environmental Management (DEM) it is found that the system is not being adequately operated and maintained. Systems can be inspected by DEM during routine compliance inspections, permit renewals, or complaint investigations. Once a system is classified, it will be required to have at a minimum, an annual inspection by a certified operator. It is important to remember that the NPDES permit is part of a Federal program administered by the State of North Carolina and that violations of the permit are enforceable by Federal and State laws. Although your system will not be required to have a certified operator at this time, proper operation and maintenance is needed for the system to function .satisfactorily. In as much as.each system must be individually designed and sited, special maintenance requirements may apply to a specific installation. The attached maintenance schedule should however be applicable to most systems. The frequencies suggested are considered to be the minimum necessary. More frequent attention may be needed for a specific system and may be required by conditions of the permit. P.O. North Carolina General Statute (NCGS) 143-215. 1(c) requires that an application for permit renewal, be filed at least 180 days prior to the expiration date. As of the date of this letter, the Division of Environmental Management had not received an application for renewal_ If operation of a discharge or waste treatment facility is to occur after the permit's expiration date, or if continuation of the permit is desired, it must not be allowed to expire. A renewal request must be submitted no later than 180 days prior to the permit's expiration date. Operation of the waste treatment works or continuation of a discharge after the expiration date would constitute a violation of NCGS 143-215. 1 and could result in assessment of civil penalties of up to $10,000 per day. If continuation of the permit is desired, failure to request renewal at least 180 days prior to expiration will result in a civil assessment of at least $300.006 larger penalties may be assessed depending upon the delinquency of the request. A renewal application shall consist of a letter requesting permit renewal along with the appropriate completed and signed application form (copy attached), submitted in triplicate, referenced in Title 15 of the North Carolina Administrative Code (15 NCAC) Subchapter 2H .0105(a). Primary industries listed in Appendix A of Title 40 of the Code of Federal Regulations, Part 122 shall also submit a priority pollutant analysis in accordance with Part 122.21. A processing fee must be submitted with the application. In addition to penalties referenced above, a permit renewal request received after the expiration date will be considered as a new application and will require the higher application fee. Attached is a copy of the fee schedule from 15 NCAC 2B.0105(b). The application processing fee is based on the design or permitted flow, whichever is appropriate, listed in the first five categories of facilities. Presently, no facility is allowed to submit a fee for the general permits listed in the schedule since the Environmental Protection Agency has not approved the State of North Carolina's general permit. If the facility covered by this permit contains some type of treatment works, a narrative description of the sludge management plan must be submitted with the application for renewal. The Environmental Management Commission adopted revised rules on October 1, 1990 (attached), requiring the payment of an annual .fee for most permitted facilities. You will be billed separately for that fee (if applicable), after your permit is approved. The letter requesting renewal, the completed Permit application, and appropriate fee should be sent to: Permits and Engineering Unit Division of Environmental Management Post Office Box 29535 Raleigh, North Carolina 27626-0535 The check should be made payable to the North Carolina Department of Environment, Health, and Natural Resources which may be abbreviated as DEHNR. If there are questions or a need for additional information regarding the permit renewal procedure, please contact me at telephone number (919) 733-5083. Sincerely f1ce^//,, I/nnJJ, At M.
