March 13, 2000 FINDINGS AND DISCUSSION Soil Characterization A total of four hand auger borings were made in the proposed area to characterize the underlying soils (see Attachment II). The borings were made to a depth of 7 feet below the land surface and were terminated in the "C" horizon. A profile description of one representative boring has been included (see Attachment III). Field observations confirmed preliminary information available from the Yancey County Soil Survey that the Dillard soil series was encountered. The Dillard soil is typically found on Mountain valleys formed from low stream terraces and colluvial fans throughout the mountainous areas of Georgia, Tennessee, Virginia, South Carolina and North Carolina. This soil is deep, moderately well drained, and slowly permeable. The soil does have a seasonal water table that is within 36 inches of the soil's surface. Application should be not be performed during the wetter periods of the year (December through March) when the actual water table is within 36 inches of the soil's surface. Hydraulic Conductivity The hydraulic conductivity for this soil ranges from 0.02 to 0.6 inches per hour (in/hr) in the most limiting horizon. EPA guidelines recommend that the design drainage rate be a portion (4 to 10 percent) of the minimum soil hydraulic conductivity. This design factor accounts for such site conditions as slope, depth to seasonal high water table,thickness and texture of the surface horizons and vegetation. Using a conservation design safety factor of 7 percent was chosen for this site. Using a conservative value of the hydraulic conductivity found on the site and with the minimum design safety factor of 7 percent, the minimum drainage rate can be estimated as: i Soil Scientist Evaluation S&ME Project No. 1411-00-025 Cavanaugh & Associates, P.A. March 13, 2000 0.02 in/hr X 24 hours/day X 30 days/month X 7%= 1.0 inches/month A water balance was performed for this soil based on it's drainage, precipitation for the area, and potential evapotranspiration (combined term for evaporation and plant transpiration) (see Attachment IV). The water balance yielded a maximum application rate of 12 inches per year. A weekly. value of 0.3 inches should be used as a maximum application rate during applicable periods for this site. Based on the exclusion of application during December through March, a separate application rate for wet and dry months are not necessary. A total of 9 inches of liquid is viewed as a maximum for total application on the site. Soil Fertility Sampling A composite surface soil sample was collected and analyzed for Cation Exchange Capacity and soil pH (See Attachment V). Soil fertility recommendations indicate no additional lime is needed for this fescue field. Fertilizer should be applied as recommendations indicate. These recommendations should promote fescue growth and proper runoff control. PERFORMANCE STANDARDS 1. The spray irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately absorb the wastewater,the Permittee shall take such immediate corrective action to correct the problem, including actions as may be required by the Division of Environmental Management. 2. . The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 3. ' The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. = ' 4. Diversion or bypassing of the untreated wastewater 'from'the treatment facilities is prohibited. 1 f 5. The following buffers shaW-be maintained: - a) 400 feet between wetted area and any residence or places of public assembly under separate ownership, b) 150 feet between wetted area and property lines, c) 100 feet between wetted area and wells, d) 100 feet between wetted area and drainageways or surface water bodies, "e) 50 feet between wetted area and public right of ways, f) 10afeet between wastewater treatment units and wells, g) 50 feet between wastewater treatment units and property lines. Some of the buffers specified above may not have been included in previous permits for this waste treatment and disposal system. These buffers are not intended to prohibit or prevent modifications,which are required by the Division,to improve performance of the existing treatment facility. These buffers do, however, apply to modifications of the treatment and disposal facilities which are for the purpose of increasing the flow that is tributary to the facility. These buffers do apply to any expansion or modification of the • spray irrigation areas and apply in instances in which the sale of property would cause any of the buffers now complied with, for the treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the existing facilities will require a permit modification. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge(ORC)of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A,Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. • 3. A suitable vegetative cover of the wastewater irrigation field shall be maintained. 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 5., Adequate measures shall be taken to prevent wastewater runoff from the spray field. 6. The facilities shall be effectively maintained and operated as a non-discharge system to • prevent the discharge of any wastewater resulting from the operation of this facility. 7. The average annual weekly application rate shall not exceed 1.0 inches per acre at a daily application rate not to exceed 0.25 inches per acre. 8. No type of wastewater other than that from Burnsville Car Wash's wash bays shall be sprayed onto the irrigation area. 9. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 2 • 10. Public access to the land application sits shall be controlled during active site use. Such controls may include the posting of"signs showing the activities being conducted at each site. III. MONITORING AND REPORTING REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Adequate records shall be maintained by the Permittee tracking the amount of wastewater disposed. These records shall include, but are not necessarily limited to the following information: a) date of irrigation, b) volume of wastewater irrigated, c) field irrigated, d) length of time field is irrigated, e) continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each field, 0weather conditions,and g) maintenance of cover crops.. 3. Three copies of all operation and disposal records (as specified in condition III 2), any required effluent monitoring data and any other data as may be required shall be submitted on or before the last day of the following month to the following address: NC Division of Environmental Management Water Quality Section Facility Assessment Unit PO Box 29535 Raleigh, NC 27626-0535 4. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office,telephone no.704/ 251-6208 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester, the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. a . b. Any process unit failure, due to known or unknown reasons,that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by- pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self-monitoring information indicates that the facility has gone out of compliance with its permit limitations. -3 Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the-occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. No land application of waste activities shall be undertaken when the seasonal high water table is less than three(3)feet below land surface. 2. - . Oil drained from engine crankcases or degreasing solvents wastes shall not be discharged into the disposal system., 3. : Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS 1. Adequate inspection, maintenance,-and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration,operator errors and discharges which may cause. or lead to the release of wastes to the environment,a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee: This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority., 3. Any duly authorized officer,employee,or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site and facility,at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water,or leachate. VI. GENERAL CONDITIONS - 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans, specifications, and other supporting data: a 2. This permit is effective only with respect to the nature and volume of f wastes described in the application and other supporting data 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will-be considered on its merits and may or may not be approved. • 4.• Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,regulations, or ordinances which may be imposed by other government agencies (local, state,and federal)which have jurisdiction. 6. A set of approved plans and.specifications for the subject project must be retained by the Permittee for the life of the project,if available at this time. • 7. The annual administering and compliance fee must be paid by the Permittee-within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H.0205 (c)(4). 8. The Permittee,at least six(6)months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein,and if warranted,will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 9. The subject wastewater treatment and disposal facilities shall be connected to an operational publicly owned wastewater collection system within 180 days of its availability to the subject facilities, if the subject wastewater.treatment or disposal•facilities are in noncompliance with the terms and conditions of this non-discharge permit or the governing statutes or regulations. Prior to the initiation of these connection activities, appropriate , approval must be received from this Division.- 10. This Permit shall be effective from the date of issuance until August 31, 1989, shall void Permit No. 4934 dated June 14, 1978, and shall be subject to the following specified conditions and limitations: 1. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 2. The facilities shall be properly maintained and operated at all times. 3. This permit is not transferable. • 4. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes, and may be rescinded unless the facilities are installed, maintained and operated in a manner which will protect the assigned water quality standards of the surface waters and ground waters. ermii No. 4834R Page Two 5. In event the facilities fail to perform satisfactorily including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater treatment or disposal facilities. 6. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will,be established and an acceptable sampling reporting schedule shall be followed. 7. The wastewater treatment shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In event the facilities fail to perform satisfactorily, including the creation of nuisance conditions, or failure of the irrigation area to adequately absorb the wastewater, the Permittee, shall take such immediate corrective action as may be required by the Division of Environmental Management. 8. A suitable year round vegetative cover shall be maintained. 9. There shall be no spray irrigation when the ground is frozen or the wind exceeds 15 mph. 10. Soil tests shall be taken on an annual basis and remedial action taken in accordance with the results of the soil tests if needed. 11. Dikes shall be constructed so as to prevent surface water runoff from the spray field. 12. Diversion or bypassing of the untreated wastewater from the treatment facility is prohibited. 13. The Permittee, at least six (6) months prior to the expiration of this Permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if indicated, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 14. The application rates shall not exceed It inch/acre/day with a total accumulation not to exceed 1 inch/acre/week. 15. The sludge generated from these treatment facilities must be disposed of in accordance with General Statutes 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 16. The Permittee shall employ a certified wastewater treatment plant operator in responsible charge of the wastewater treatment facilities. Such operator must hold a certificate of the grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission. • `.Permit No. 4834R Page Three 17. Freeboard in- the storage lagoon shall 'not be less than two (2) feet at any time. • 18. The issuance of this permit shall not relieve Burnsville Car Wash of the responsibility for damages to surface'or ground waters resulting from the operation of this facility. 19. The facilities shall be effectively maintained and operated as a non-discharge system to prevent the discharge of any wastewater into the surface waters of the State. • 20. No type of wastewater other than that from Burnsville Car Wash shall be sprayed onto the irrigation area. • 21. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. • 22. The discharge is to ' a holding pond from which theeleaches into the ground. When necessary the wastewater is pumped from the °pond onto a one acre irrigation field for disposal. Recent inspections have found the pond to be overflowing or leaking onto adjacent property but this problem has been corrected by .Mr. Austin and the pond pumped for maintenace. The facility now. appears to be operating properly with no discharge to surface waters. The nearest' residence is approximately 200 feet northwest of the car wash and no odor problems have been received or detected. After complying with Groundwater Section requirements, it is recommended that the permit be reissued. METHODS AND PROCEDURES The area evaluated was approximately 0.5 acres in size located to the west of the current retention pond (see Attachment II). The evaluation consisted of two components: 1) hand auger borings to a depth of 7 feet to characterize soils in the proposed application area 2) estimation of soil hydraulic conductivity, and 3) collection of a composite surface soil sample to be analyzed for soil fertility with fertilizer and liming recommendations. March 13, 2000 FINDINGS AND DISCUSSION Soil Characterization A total of four hand auger borings were made in the proposed area to characterize the underlying soils (see Attachment II). The borings were made to a depth of 7 feet below the land surface and were terminated in the "C" horizon. A profile description of one representative boring has been included (see Attachment III). Field observations.confirmed preliminary information available from the Yancey County Soil Survey that the Dillard soil series was encountered. The Dillard soil is typically found on Mountain valleys formed from low stream terraces and colluvial fans throughout the mountainous areas of Georgia, Tennessee, Virginia, South Carolina and North Carolina. This soil is deep, moderately well drained, and slowly permeable. The soil does have a seasonal water table that is within 36 inches of the soil's surface. Application should be not be performed during the wetter periods of the year (December through March) when the actual water table is within 36 inches of the soil's surface. Hydraulic Conductivity , The hydraulic conductivity for this soil ranges from 0.02 to 0.6 inches per hour (in/hr) in the most limiting horizon. EPA guidelines recommend that the design drainage rate be a portion (4 to 10 percent) of the minimum soil hydraulic conductivity. This design factor accounts for such site conditions as slope, depth to seasonal high water table, thickness and texture of the surface horizons and vegetation. Using a conservation design safety factor of 7 percent was chosen for this site. Using a conservative value of the hydraulic conductivity found on the site and with the minimum design safety factor of 7 percent, the minimum drainage rate can be estimated as: 2 Soil Scientist Evaluation S&ME Project No. 1411-00-025 Cavanaugh& Associates, P.A. March 13, 2000 0.02 in/hr X 24 hours/day X 30 days/month X 7%= 1.0 inches/month A water balance was performed for this soil based on it's drainage, precipitation for the area, and potential evapotranspiration (combined term for evaporation and plant transpiration) (see Attachment IV). The water balance yielded a maximum application rate of 12 inches per year. A weekly. value of 0.3 inches should be used as a maximum application rate during applicable periods for this site. Based on the exclusion of application during December through March, a separate application rate for wet and dry months are not necessary. A total of 9 inches of liquid is viewed as a maximum for total application on the site. Soil Fertility Sampling A composite surface soil sample was collected and analyzed for Cation Exchange Capacity and soil pH (See Attachment V). Soil fertility recommendations indicate no additional lime is needed for this fescue field. Fertilizer should be applied as recommendations indicate. These recommendations should promote fescue growth and proper runoff control. Although certain portions of this required submittal must be developed by - '• other professionals, inclusion of these materials under the signature and seal of a NC Professional Engineer signifies that he has reviewed this material and has judged it to be consistent with his proposed design. • - E Five (5) copies of the existing permit if a renewal or modification. F. For Distribution/Infiltration Disposal Systems: . 1 A water balance analysis showing annual amount of wastewater that will need to be applied and the amount of land necessary to receive the wastewater at the given loading rate. Storage • requirements must be addressed and supporting calculations provided. 2 A soils scientist report (signed) which includes texture, color, and structure of soils down to a depth of seven feet, depth, thickness and type.of any restrictive horizons, hydraulic conductivity in the most restrictive horizon, Cation Exchange Capacity (CEC), depth of seasonal high water table, soil pH, and soils map (if available). Subject: Permit Renewal Request for Burnsville Car Wash Wastewater Spray Irrigation System Permit No. WQ0002525/GW00111 Yancey County Susan Cauley,Review Engineer The Groundwater Section has reviewed the subject permit request for the continued operation and disposal of 1000 GPD of wastewater from the car wash facility via spray irrigation onto the existing one acre site. Groundwater monitoring is not necessary at this time, since no water supply wells are located downgradient of the spray disposal area and the site is located adjacent to a flood plain(which is an area of groundwater discharge). Based upon the Groundwater Section's review of the subject permit application and supporting documentation, the Groundwater Section makes the following recommendations. *1. No crank case oil, antifreeze, solvents, de-greasers, or any hazardous waste shall not be allowed to enter the disposal system. 2: No land application of waste activities shall be undertaken when the seasonal high water table water table is less than three (3) feet below land surface. 3. • The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAA 2L, Groundwater Classifications and Standards. The Compliance Boundary for the disposal system individually permitted prior to December 31, 1983 is established at either(1) 500 feet from the waste disposal area, or(2) at the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under General Statute 143- 215.6A(a)(1). 5 " In accordance with IDA NCAA 2L, a REVIEW BOUNDAR .-is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. 4.
