Salisbury Street Suite 105 Raleigh, NC 27604 Wake Forest, NC 27587 Re: Eagle Rise Subdivision (formerly Eagle Rock Rd Property) Request for NWP 29 Sage Project #2019.62 USACE (SAW-2019-01092) NCDWR (RRO #19-258) On behalf of G&H Properties, LLC (applicant and owner), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the Eagle Rock Road Site (Site) may proceed under Nationwide Permit (NWP) 29 and corresponding Water Quality Certification (4139). A Neuse Basin Buffer Rules authorization is also requested. Project Summary and Purpose The purpose of the proposed project includes the construction of a single-family residential subdivision with associated roads and utilities which will connect to existing adjacent infrastructure in the area. The +/-38.99-acre Site is located approximately 0.25-mile NE of the intersection of Eagle Rock Road and Wendell Falls Parkway in Wendell, Wake County, NC. Wake County lists the parcel PIN as #1773-88-6927. The approximate center of the Site is located at Latitude: 35.7787°N; Longitude: 78.3977°W. Project Detail The overall project consists of a single-family residential subdivision with homes and associated utilities. Access to the subdivision will be provided off of Eagle Rock Road and will include at least two cul-de-sacs branching from the main subdivision road. Three Stormwater Control Devices (SCM)’s located in the northern portion of the Site are proposed to treat stormwater. Proposed impacts from road construction, lot fill, utility line construction, and culverting will result in temporary and permanent impacts to streams, wetlands, and buffers. Utilities for the proposed Eagle Rise Subdivision Page 2 of 3 project will connect to existing utility lines adjacent to the proposed project boundaries. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull-dozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the Project according to the NC Natural Heritage Program (NHP) Database (see attached report dated July 30, 2019). The Site is not listed as a historic property or within a historic district. There are five historic structures within 0.5 mile of the Site, however none are directly adjacent to the property boundaries based on a query of the North Carolina State Historic Preservation Office (NCSHPO) database. Other than two dilapidated barns (one with an attached lean-to), no structures are located on the Site. Project History The Site contains agriculture (~35%) and undeveloped wooded areas (~65%). The vegetative composition of the Site is made up of hardwoods interspersed with pines, except for the NW corner of the Site, which is pine dominated. A small powerline easement in the western portion of the Site parallels Eagle Rock Rd. General land use in the vicinity includes rural residential, agricultural and pastureland, and undeveloped, forested land. Mr. David Gainey and Mr. Sean Clark of Sage Ecological completed a wetland, stream, and riparian buffer determination and submitted a preliminary jurisdictional determination package to USACE. Ms. Samantha Dailey concurred with this delineation in an email dated August 14, 2019 (SAW-2019-01092). A riparian buffer determination was made by the NCDWR on 8/19/201 (see attached copy). Avoidance and Minimization The proposed subdivision roads and lots were aligned so as to avoid and minimize impacts to wetlands, streams, and riparian buffers. Specific measures utilized during the design phase included realigning the greenway trail crossing (Impact 6) closer to the proposed aerial sewer crossing impact (Impact 7) so as to disrupt less overall buffer area by utilizing the same construction corridor as well as crossing a smaller section of wetland with the bridge. A bridge was used for the greenway crossing (Impact 6) in order to avoid the need for stream and wetland fill. The Bratton Rock Lane crossing was placed at a location where the wetland being crossed is the most narrow (old farm drainage). Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to provide additional protection from runoff. Project Impacts Proposed permanent stream impacts total 144 Linear Feet (LF) as a result of culverting for a road crossing (Impact 1). Road construction will also result in permanent wetland impacts of 0.078- acre (Impacts 1 and 5). Permanent riparian buffer impacts from the construction of a road, sanitary sewer, and bridge will result in Zone 1 impacts totaling 16,036 square feet, and Zone 2 impacts Eagle Rise Subdivision Page 3 of 3 totaling 12,842 square feet. Proposed impacts 3, 8, 9, 11, 13, and 15 are temporary Zone 2 impacts that will be revegetated and are considered “Exempt” but are calculated and identified in the attached application. Mitigation Permanent stream impacts have been minimized to less than 150 LF and avoided using an aerial utility crossing and a bridged pedestrian crossing, therefore no stream mitigation is proposed. Permanent wetland impacts have been minimized to less than 0.1-acre and avoided using a bridge, therefore, no wetland mitigation is proposed. Riparian buffer impacts are either “Exempt” or “Allowable” per the Table of Uses; therefore, no riparian buffer mitigation is proposed. If you have any questions, please call me at (919) 244-0623. An aerial sewer crossing and a pedestrian bridge were utilized to reduce overall buffer impacts and avoid stream and wetland impacts. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to provide additional protection from runoff. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: General techniques include the use of construction fencing to define the construction corridor and prevent any accidental additional impacts.
