Therefore, in accordance with your request, NCG500634 is rescinded, effective immediately.

must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day.

be clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
➢ Authorization for representatives. If this application will be submitted by a consulting
engineer(or engineering firm),include documentation from the Permitted showing that the
consultant submitting the application has been designated an Authorized Representative of the
applicant.

This inspection was performed as the result of a complaint. The complaint was from an anonymous citizen
stating , Tar Heel Mica was dumping chemicals into the North Toe River. The chemicals identified were
toululene, lye and water treatment chemicals.
No evidence was found that the Plant had been dumping chemicals.The noncontact cooling water
discharge from the presses has recently been permitted and even more recently has been redirected to a
holding basin to prevent hydraulic fluid from reaching the river.The holding basin had a few inches of water
and fluid mixture in it and the plant intents to pump the basin as it becomes full.
VOA samples were taken at the discharge of the small stream that passes under the road. The results of
the sampling will be forwarded when they become available.

requirements of North Carolina General Statue 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated May 9, 1994(or as subsequently amended).

PART IV - EVALUATION AND RECOMMENDATIONS
This discharge is for non-contact cooling water. The facility cools it's presses with spring water,
which collects in a sump and is discharged by way of a sump pump to a storm drain to the River.
To ensure there is no contamination of this discharge the facility must maintain the presses in a
manner to prevent hydraulic fluid from reaching the discharge and eliminate any spills in the plant
that may reach the discharge sump.
The regional office recommends the issuance of the permit.

requirements of 15A NCAC 2H .0138. I1 construction applies to this discharge, include the three
sets of plans and specifications with this application.

The alternatives to discharge analysis should include boring logs and/or other information indicating that a
subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as
outlined in the Division's "Guidance For the Evaluation of Wastewater Disposal Alternatives".

For new or proposed discharges,the following information MUST BE INCLUDED in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic(quad)map(or a photocopied portion thereof)with discharge
location clearly indicated.
b) Site map. If the discharge is not directly to a stream,the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer(or engineering firm), include
documentation from the applicant showing that the engineer(Or firm)submitting the application has
been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a North
Carolina registered Professional Engineer and stamped."Final Design-Not released for construction".

The facility listed above is covered under NPDES General Permit NCG500000. NCG500000 expires
on July 31,2007. Federal(40 CFR 122.41)and North Carolina(15A NCAC 2H.0105(e))regulations require
that permit renewal applications must be filed at least 180 days prior to expiration of the current permit. If
you have already mailed a renewal request,you may disregard this notice.
To satisfy this requirement,the Division must receive a renewal request postmarked no later than
February 1.2007. Failure to request renewal by this date may result in a civil penalty assessment. Larger
penalties may be assessed depending upon the delinquency of the request. This renewal notice is being sent
