The Project Development and Environmental Analysis Branch has begun studying the proposed
improvements to U-3437. The project is included in the 2002-2008 North Carolina Transportation
Improvement Program and is scheduled for right of way in fiscal year 2006 and construction in fiscal year
2008.
The subject project proposes to provide a new connector on new location from the SR 1159
(Pleasant Hill Road)/US 321 Alternate (Main Street) intersection to SR 1160 (Mount Herman Road).
We would appreciate any information you might have that would be helpful in evaluating
potential environmental impacts of the project. If applicable, please identify any permits or approvals
which may be required by your agency. Your comments will be used in the preparation of a federally
funded Environmental Assessment. This document will be prepared in accordance with the National
Environmental Policy Act. It is desirable that your agency respond by March 24, 2003 so that your
comments can be used in the preparation of this document.

On-Site Determination for Applicability to the Mitigation Rules (15A NCAC 211.0506(h)
Dear Ms. Willis:
On September 19, 2006, Sue Homewood from the Division of Water Quality (Division) conducted an on-site
visit with representatives of NCDOT - PDEA and the US Army Corps of Engineers (USACE) to review
streams and a wetland feature located along the project corridor for the above referenced project, for
applicability to the mitigation rules (15A NCAC 2H.0506(h)). The drainage features are approximated on the
attached map.
¦ UT1 and UT2 were determined to be perennial streams within the project corridor and therefore subject
to the mitigation rules
¦ UT3 was determined to be an ephemeral channel coming from the apartment complex adjacent to the
project corridor and therefore not subject to the mitigation rules.
¦ UT4 was determined to be a strong intermittent stream along the south-east portion of the project and
therefore not subject to the mitigation rules.
¦ Wetland 1 was determined to be a jurisdictional wetland by John Thomas of the USACE during this
site visit. The outer wetland boundary is beyond the project corridor and therefore not defined. There
is a small linear portion of this wetland that connects to larger portions and should be defined on future
maps and drawings as one wetland feature.

Landowners or affected parties that dispute a determination made by the Division or Delegated Local
Authority that a surface water exists and that it is subject to the mitigation rules may request a determination by
the Director. A request for a determination by the Director shall be referred to the Director in writing c/o John
Dorney, Division of Water Quality, Wetlands/401 Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650.
Individuals that dispute a determination by the Division or Delegated Local Authority that "exempts" a surface
water from the mitigation rules may ask for an adjudicatory hearing. You must act within 60 days of the date
that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision. The
Division recommends that the applicant conduct this notification in order to be certain that third party appeals
are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing within 60
days.
This letter only addresses the applicability to the mitigation requirements and does not approve any activity
within Waters of the United States or Waters of the State. If you have any additional questions or require

SUBJECT: Review of Scoping Sheets for New Connector on new location from SR 1159 (Pleasant
Hill Road and US 321 Alternate (Main Street) to SR 1160 (Mount Herman Road) in the
town of Hudson in Caldwell County. F.A. Project No. STP-1159(1), State Project
8.2733301, TIP Project U-3437. State Clearinghouse Project No. 03-0248.
In reply to your correspondence dated February 11, 2003 (received March 10, 2003) in which you
requested comments for the referenced project, preliminary analysis of the project indicates that
Gunpowder Creek (index number 11-55, class WS-IV Critical Area) in Hydrologic Unit 030832 will be
impacted. The NC Division of Water Quality has the following comments:
Environmental Documentation
1. The environmental documention pertaining to this project should provide a detailed and itemized
presentation of the proposed impacts to wetlands and streams with corresponding mapping. There
should be a discussion on mitigation plans for unavoidable impacts. If mitigation is required, it is
preferable to present a conceptual (if not finalized) mitigation plan with the environmental
documentation. While the NCDWQ realizes that this may not always be practical, it should be noted
that for projects requiring mitigation, appropriate mitigation plans will be required prior to issuance of
a 401 Water Quality Certification.
2. DWQ recommends that the environmental document include a detailed and itemized presentation of
the proposed project's impacts to wetlands and streams with corresponding mapping as well as the
cumulative and secondary impacts anticipated as a result of this project.
Design & Construction
1. In addition to the current NPDES stormwater permitting, DWQ is developing a permitting and
program strategy to address the EPA proposed Phase II stormwater permitting program requirements.
The Phase II program will be directed towards smaller municipalities and construction sites. Phase II
could potentially bring an additional 60 cities and 24 counties statewide into the NPDES permitting
process. At present, Phase II requirements will be handled with existing state staff. The proposed
rules were published in November 1999. About 20 local and four county governments within the
Catawba River basin will fall within the Phase II requirements. For more information on the state

2. The project shall incorporate the requirements for WS-IV Waters within a critical area as specified in
15A NCAC 2B .0215 (i.e., stormwater management, sedimentation and erosion control, and buffers).
3. Hazardous spill catch basins will be required for this project.
4. The DWQ requests that DOT strictly adhere to Best Management Practices for the Protection of
Surface Waters (March 1997) throughout design and construction of the project.

5. Where practicable, storm water should be directed to buffer areas or retention basins and must not be
routed directly into streams. Instead, storm water should be designed to drain to a properly designed
storm water detention facility/apparatus.
6. Sediment and erosion control measures should not be placed in wetlands. Sediment should be
removed from any water pumped from behind a cofferdam before the water is returned to the stream.
7. Do not use any machinery in the stream channels unless absolutely necessary. Additionally, do not
remove vegetation from the stream bank unless it is absolutely necessary. Especially avoid removing
large trees and undercut banks. If large, undercut trees must be removed, then. cut the trunks and
leave the stumps and root systems in place to minimize damage to stream banks.
Borrow/waste areas should not be located in wetlands. It is likely that compensatory mitigation will
be required if wetlands are impacted by waste or borrow.
9. Wetland and stream impacts should be avoided to the maximum extent practical. If this is not
possible, alternatives that minimize wetland impacts should be chosen. In accordance with the
NCDWQ Wetlands Rules 115A NCAC 2H.0506(b)(6)1, mitigation will be required for impacts of
greater than 150 linear feet to any single perennial stream. In the event that mitigation becomes
required, the mitigation plan should be designed to replace appropriate lost functions and values. In
accordance with the NCDWQ Wetlands Rules 115A NCAC 2H.0506 (h)(3)), the Wetland
Restoration Program may be available for use as stream mitigation.
10. Qualified personnel should perform onsite wetland delineations prior to permit approval.
11. DWQ prefers replacement of bridges with bridges, particularly in higher quality waters (i.e. trout
streams, water supply watersheds, high quality and outstanding resource waters).
12. When practical, the DWQ requests that bridges be replaced on the existing location with road closure.
If a detour proves necessary, remediation measures in accordance with the NCDWQ requirements for
General 401 Certification 2726/Nationwide Permit No. 33 (Temporary Construction, Access and
Dewatering) must be followed.
Thank you for requesting our input at this time. The DOT is reminded that issuance of a 401 Water
Quality Certification requires that appropriate measures be instituted to ensure that water quality
standards are met and designated uses are not degraded or lost. If you have any questions or require

Staff biologists with the North Carolina Wildlife Resources Commission (NCWRC) have
reviewed the information provided by North Carolina Department of Transportation (NCDOT)
and have the following preliminary comments regarding impacts to fish and wildlife resources
resulting from the subject project. These comments are provided in accordance with the
provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The NCDOT proposes to provide a new connector on new location from SR 1159
(Pleasant Hill Road) and US 321 Alternate (Main Street) to SR 1160 (Mount Herman Road) in
the Town of Hudson for a project length of approximately 0.8 miles. NCDOT indicates that no
stream crossings are involved in the project, however a sizable wetland occurs within the study
corridor. The project ends just before Bridge No. 94, over Gunpowder Creek on SR 1160. No
control of access is proposed. The NCWRC is concerned about adverse impacts to existing
wetlands and natural areas, which are important for water quality protection and wildlife habitat.
The environmental document should clearly indicate the purpose and need for this
project, describe measures to avoid and minimize impacts to the wetlands and natural areas,
including storm water treatment and sedimentation and erosion control, and address secondary
development issues. In addition, to help facilitate document preparation and the review process,
our general information needs are outlined below:

1. Description of fishery and wildlife resources within the project area, including a listing of
federally or state designated threatened, endangered, or special concern species. Potential
borrow areas to be used for project construction should be included in the inventories. A

2. Description of any streams or wetlands affected by the project. If applicable, include the
linear feet of stream that will be channelized or relocated.
3. Cover type maps showing wetland acreage impacted by the project. Wetland acreage
should include all project-related areas that may undergo hydrologic change as a result of
ditching, other drainage, or filling for project construction. Wetland identification may
be accomplished through coordination with the U. S. Army Corps of Engineers
(USAGE). If the USACE is not consulted, the person delineating wetlands should be
identified and criteria listed.
4. Cover type maps showing acreage of upland wildlife habitat impacted by the proposed
project. Potential borrow sites should be included.
5. Show the extent to which the project will result in loss, degradation, or fragmentation of
wildlife habitat (wetlands or uplands).
6. Include the mitigation plan for avoiding, minimizing or compensating for direct and
indirect degradation in habitat quality as well as quantitative losses.
7. Address the overall environmental effects of the project construction and quantify the
contribution of this individual project to environmental degradation.
8. Provide a discussion of the probable impacts on natural resources, which will result from
secondary development, facilitated by the improved road access.

9. If construction of this facility is to be coordinated with other state, municipal, or private
development projects, a description of these projects should be included in the
environmental document, and all project sponsors should be identified.

SUBJECT: Review of Scoping Sheets for New Connector on new location from SR 1159 (Pleasant
Hill Road and US 321 Alternate (Main Street) to SR 1160 (Mount Herman Road) in the
town of Hudson in Caldwell County. F.A. Project No. STP-1159(1), State Project
8.2733301, TIP Project U-3437. State Clearinghouse Project No. 03-0248.
In reply to your correspondence dated February 11, 2003 (received March 10, 2003) in which you
requested comments for the referenced project, preliminary analysis of the project indicates that
Gunpowder Creek (index number 11-55, class WS-IV Critical Area) in Hydrologic Unit 030832 will be
impacted. The NC Division of Water Quality has the following comments:
Environmental Documentation
1. The environmental documention pertaining to this project should provide a detailed and itemized
presentation of the proposed impacts to wetlands and streams with corresponding mapping. There
should be a discussion on mitigation plans for unavoidable impacts. If mitigation is required, it is
preferable to present a conceptual (if not finalized) mitigation plan with the environmental
documentation. While the NCDWQ realizes that this may not always be practical, it should be noted
that for projects requiring mitigation, appropriate mitigation plans will be required prior to issuance of
a 401 Water Quality Certification.
2. DWQ recommends that the environmental document include a detailed and itemized presentation of
the proposed project's impacts to wetlands and streams with corresponding mapping as well as the
cumulative and secondary impacts anticipated as a result of this project.
Design & Construction
1. In addition to the current NPDES stormwater permitting, DWQ is developing a permitting and
program strategy to address the EPA proposed Phase II stormwater permitting program requirements.
The Phase II program will be directed towards smaller municipalities and construction sites. Phase II
could potentially bring an additional 60 cities and 24 counties statewide into the NPDES permitting
process. At present, Phase II requirements will be handled with existing state staff. The proposed
rules were published in November 1999. About 20 local and four county governments within the
Catawba River basin will fall within the Phase II requirements. For more information on the state

2. The project shall incorporate the requirements for WS-IV Waters within a critical area as specified in
15A NCAC 2B .0215 (i.e., stormwater management, sedimentation and erosion control, and buffers).
3. Hazardous spill catch basins will be required for this project.
4. The DWQ requests that DOT strictly adhere to Best Management Practices for the Protection of
Surface Waters (March 1997) throughout design and construction of the project.

5. Where practicable, storm water should be directed to buffer areas or retention basins and must not be
routed directly into streams. Instead, storm water should be designed to drain to a properly designed
storm water detention facility/apparatus.
6. Sediment and erosion control measures should not be placed in wetlands. Sediment should be
removed from any water pumped from behind a cofferdam before the water is returned to the stream.
7. Do not use any machinery in the stream channels unless absolutely necessary. Additionally, do not
remove vegetation from the stream bank unless it is absolutely necessary. Especially avoid removing
large trees and undercut banks. If large, undercut trees must be removed, then cut the trunks and
leave the stumps and root systems in place to minimize damage to stream banks.
8. Borrow/waste areas should not be located in wetlands. It is likely that compensatory mitigation will
be required if wetlands are impacted by waste or borrow.
9. Wetland and stream impacts should be avoided to the maximum extent practical. If this is not
possible, alternatives that minimize wetland impacts should be chosen. In accordance with the
NCDWQ Wetlands Rules 115A NCAC 2H.0506(b)(6) ), mitigation will be required for impacts of
greater than 150 linear feet to any single perennial stream. In the event that mitigation becomes
required, the mitigation plan should be designed to replace appropriate lost functions and values. In
accordance with the NCDWQ Wetlands Rules 115A NCAC 2H.0506 (h)(3))-, the Wetland
Restoration Program may be available for use as stream mitigation.
10. Qualified personnel should perform onsite wetland delineations prior to permit approval.
11. DWQ prefers replacement of bridges with bridges, particularly in higher quality waters (i.e. trout
streams., water supply watersheds, high quality and outstanding resource waters).
12. When practical, the DWQ requests that bridges be replaced on the existing location with road closure.
If a detour proves necessary, remediation measures in accordance with the NCDWQ requirements for
General 401 Certification 2726/Nationwide Permit No. 33 (Temporary Construction, Access and
Dewatering) must be followed.

Quality Certification requires that appropriate measures be instituted to ensure that water quality
