Center Street Lexington, NC 27292 SUBJECT: Compliance Evaluation Inspection Lexington Regional WWTP NPDES Permit No. NCO055786 Davidson County Dear Ms. Comer: Donald R. van der Vaart Secretary On July 21, 2015, Jenifer Carter of the Winston-Salem Regional Office conducted a Compliance Evaluation Inspection at the City of Lexington Regional Wastewater Treatment Plant. Mr. Joseph C. Shaffer, ORC, was present during the inspection. The inspection consisted of two parts: an on -site inspection of the treatment facility and a review of facility files and self -monitoring data. A review of the self -monitoring data revealed no NPDES limits violations. Lab data correlated correctly with data on the submitted Discharge Monitoring Reports. Facility records were well organized and current. ORC visitation and maintenance records were sufficient. Overall the plant appears to be well maintained and operated, a great improvement over last year's inspection. No deficiencies or violations were noted during the inspection of the WWTP. Earlier I reported that our final clarifiers would be bypassed one at a time while rehab work was being done on the concrete at the overflowsw. This work is now complete. The last tank can be put into service at any time if necessary; however, the contractor asked us to hold it out of service until Monday, May 25 if possible to allow the new concrete to cure. The only problem that was incurred was a spike in phosphorous concentrations in the effluent when we switched clarifiers. This should not result in non-compliance with this limit. Skvarla, III Secretary A Pretreatment Compliance Inspection was performed by Jenifer Carter of the Winston-Salem Regional Office, on the subject facility on June 24, 2014. You were present for the inspection. The purpose of this inspection was to determine the effectiveness of the pretreatment program and included a review of pretreatment program elements, POTW plant performance, industry monitoring data, adherence to the enforcement response plan (ERP), and an Industry Inspection. The City currently has five (5) Significant Industrial Users (SIU), four (4) of which are categorical. There were no SIUs in significant non-compliance (SNC) during for the second half of 2012 for permit limits or reporting violations. The plant had Ammonia permit limits violations in July 2013 due to a leak at the plant. This was previously addressed during the Division's regular monthly enforcement program. Ms. Comer has correctly identified Atrium Windows as a Significant Industrial User and is in the process of issuing them an Industrial User Permit. They will most likely be brought under the Federal Code of Federal Regulations, Part 463 — Plastics Molding and Forming Point Source Category. A follow-up Compliance Evaluation was also performed to determine the effectiveness of stepped up efforts to reduce trash throughout the plant since the last Compliance Evaluation Inspection in February 2014. It appeared that improvements have made a vast difference, with no trash being observed in the secondary clarifiers, the chlorine contact chamber, past aeration nor, most importantly, the effluent discharge pipe and surface waters. It is the hope of the Division that these efforts are maintained indefinitely. Overall, the inspections showed the pretreatment program, and the plant to be well maintained. Lexington Regional WWTP has a permitted flow that is 6.5 million gallons per day (MGD) discharging into the Abbott's Creek arm of High Rock Lake (7Q10 of 6.70 CFS). Whole effluent samples were collected on February 4 and February 6 by Jenifer Carter and facility representative Tamika Wardlow for use in a chronic Ceriodaphnia dubia pass/fail toxicity test. The test using these samples resulted in a pass. Toxicity information follows. Skvarla, III Secretary On February 25, 2014, Jenifer Carter of the Winston-Salem Regional Office conducted a Compliance Evaluation Inspection at the City of Lexington Regional Wastewater Treatment Plant. Mr. Joseph C. Shaffer, ORC, was present during the inspection. The inspection consisted of two parts: an on -site inspection of the treatment facility and a review of facility files and self -monitoring data. The following is a summary of the findings from the inspection: • Lab data correlates correctly with data on the submitted Discharge Monitoring Reports. • ORC visitation and maintenance logs were available for review. • The primary clarifiers, trickling filters and anaerobic digesters are no longer used. The digesters are utilized for sludge storage only. • Trash is insufficiently screened at the head of the plant and, because of this, the City has plans to install a new finer bar screen. • Due to insufficient screening of trash, plant staff had installed screens throughout the plant to catch the floating debris, and to prevent it from reaching surface waters. Staff is supposed to remove the debris caught by these screens regularly. Unfortunately, during the inspection, heavy trash build-up was observed at all the designated clean -out points, as well as being discharged into surface waters. Due to these observations, the Lexington WWTP is in violation for the following: l . Discharge of floating solids to Abbotts Creek (Class WS-V & B) a violation of the permit section Part I Section A(D. 2. Failure to properly operate and maintain all facilities and systems of treatment and control which are installed or used by the Permittee to achieve compliance with the condition of the permit as per the permit Part II Section C (2). Please reply to this letter within thirty (30) days, stating what corrective actions have been taken to ensure that proper operations & maintenance be performed in the future. Include a timeline for the installation of the new bar screen. These violations and any future violations can be subject to a civil penalty assessment of up to $25,000.00 per day per violation. I'm going to retire in the next year or so and am using this as a learning experience for Joe. He's just too laid back. If Cupp was still in charge, this would not have happened. Joe does a lot of things right, but this is his Achilles heel. Cupp did a lot of things right, but working with employees was his downfall. Joe is issuing, in writing, to each of his folks assigned areas to take care of. These areas are to be inspected by him weekly (at first) and the employees will receive a rating on this inspection. He was supposed to do this several months ago and being laid back or lazy hadn't got around to it. This was one of the best things that Cupp did. They hated him for it, but there was no challenge at evaluation time. Joe tends to backslide, but I'll stay in his butt for a while. I'll forward your letter to Joe (without these comments). I've already told him to expect white glove inspections and unannounced inspections for some time in the future. (When you showed up with the camera unannounced, that put the fear of God in him.) The floating stuff has been a concern since we put the BNR system into operation and bypassed the primary clarifiers. It's taken me this long to get the money together (about $200,000) to get a fine screen. I'm going to scrounge up about another $20K in this budget instead of waiting until the next budget like I planned to get some of the things that go with the installation (backwash pump, concrete work, etc) and have as much stuff in place when the thing finally arrives. Since the trash was under control during the last inspection (even though three years ago it was not), Corey decided he wants to send a Notice of Violation only, with no intent to enforce (i.e. no penalties) at this time. I think he is being kind. The NOV will be for failure to maintain/operate the plant properly and for floating solids in the creek, a violation of the permit. We would like to see cleaning efforts become proactive vs. reactive... in other words, operators should not be waiting until trash builds up to anywhere near the point of getting in the creek before it is scooped out. Every two weeks-ish is clearly not enough. I see no reason why it could not be a part of the daily routine, with special attention being paid to the plant during/after high flows (assuming it is safe, of course). High flows alone are not an excuse for trash getting in the stream, barring an unusually large rain event... maybe. Until the new mechanical screen is installed, every effort needs to be made to keep trash out of the creek. Record keeping also needs to improve. If trash is observed in the final clarifiers, the chlorine contact chambers or, heaven forbid, beyond that, then that should be noted, every day if necessary. I looked at two months of records, and saw only one notation about trash being cleaned out anywhere other than rags being removed from the conveyer, at the head of the plant. The outfall should be a part of the daily checklist of things to observe, if it isn't already. Hopefully, this will serve as a wake-up call. Corey might not be so forgiving if I or another inspector observes the same trash problem during a future inspection or unannounced visit. Let me know if you have any questions. The inspection consisted of two parts: an on -site inspection of the treatment facility and a review of facility files and self -monitoring data. A review of the self -monitoring data for the period of June 2010 through May 2012 revealed no NPDES limits violations. Lab data correlated correctly with data on the submitted Discharge Monitoring Reports. Facility records were well organized and current. ORC visitation and maintenance records were sufficient. Overall the plant appears to be well maintained and operated. The anaerobic digesters are currently being used for sludge storage only, with solids being sent to the belt press. Mr. Joseph C. Shaffer, ORC, was present during the inspection. The inspection consisted of two parts: an on -site inspection of the treatment facility and a review of facility files and self -monitoring data. A review of the self -monitoring data for the period of October 2008 through September 2010 revealed a few minor NPDES limits violations, which have been previously addressed through the Division's regular monthly enforcement program. Lab data correlates correctly with data on the submitted Discharge Monitoring Reports. Facility records were well organized and current. Overall the plant appears to be well maintained and operated. Due to ongoing repairs to the mechanical bar screen, the manual bar screen was being used during the inspection. The spacing on this bar screen was not sufficient to keep trash from passing through to the plant. Staff was successfully raking out the trash at several points to prevent any from reaching surface waters. Please notify Ms. Carter upon completion of the repairs and cleanup of trash throughout the plant so she can perform a follow-up inspection before June 9, 2011. Presently, the City is using potable water to operate the belt press at its compost facility. This unit uses 750,000 gallons or more per month of water. It is our intention to install a pump at the overflow of the chlorine contact tank to pump effluent to the compost facility for use on the belt press. This is a water conservation issue and will have no impact on the operation of the wastewater treat treatment plant other than to replace the potable wafer used U11 the oelt press. Installed on a pad adjacent to the compost facility so that overflows will go into a drain and be returned to the wastewater plant. There will be an emergency potable water line to feed the tank with an air gap. Water will be pumped from the tank to the belt press from the existing washwater pump. Drawings appropriate to this installation are attached. Per my phone conversation with Ms. Carter, an ATC will not need to be issued for this installation.
