SUBJECT: Request for Modification of Existing 404 and 401 Permits for the extension of SR
1357 (Smith Ave.) from west of US 17 Business to NC 130 (Holden Beach Rd. ) in
Shallotte, Brunswick County; TIP U-3462; Federal Aid Project STP-1357 (2); State
Project 8.2231601; WBS 8 34953.1.1.
Dear Mr. Shaver:
The North Carolina Department of Transportation would like to request a modification to the U.S.
Army Corps of Engineers Nationwide 14/33 (Action ID 1998 2173) and the corresponding Division
of Water Quality Certification (DWQ Project No. 20081177 v.l) for the extension of Smith Avenue
in Brunswick County, TIP U-3462. The requested modification for each site is described below.
SITE 2 -L- Sta. 32+77 to 34+19 Lt. & Rt.
The Department is constructing a double 9' x 7' barrel box culvert at this site. The original permit
application listed the culvert length and permanent stream at 112 ft feet. After reviewing the structure
plans the actual culvert length to be constructed at this site is 119 ft 5 inches. Therefore, an additional
7.5 ft of permanent stream impacts will occur at this site. In addition, the permit drawings show 15 ft
of rip rap along both banks of the stream on the outlet end of the pipe. The rip rap is included in the
0.02 acre of permanent surface water impact listed in the original permit application, but not clearly
identified as bank stabilization as proposed. This has now been noted in the modified impact
summary as requested.
SITE 2a -Drive3- 11+32
The original permit application listed permanent stream impacts for the installation twin 48" pipes at
this site at 34 ft. The length of pipe listed in the Summary of Quantities for this site was 36 ft which
has been installed by the contractor. Therefore, there is an additional 2 ft of permanent stream
impacts at this site.
SITE 3 -Y- Sta. 15+47 to 17+98 Lt.
A double 6' x 5' barrel box culvert extension is proposed at this site. The original permit application
lists the permanent steam impacts at this site at 19 ft. After reviewing the structure plans the actual

culvert extension length and permanent stream impacts is 26 It 9 inches. Therefore an additional 8 It
of permanent stream impacts will occur at this site. In addition, the permit drawing for Site 3 shows
fill in the adjacent wetlands however, since the impacts were less than one hundredth of an acre, no
impacts for fill were listed on impact summary sheet. In order to more accurately quantify the
impacts depicted on the permit drawing, the modified summary of impact sheet will list this fill in
wetlands as less than one hundredth of an acre(<0.01), as requested.
SITE 4 -Ir Sta. 55+56
A 72" reinforced concrete pipe has been installed at this location. The original permit application
listed the permanent stream impacts at this site at 140 ft. Based upon the slope stake line the
contractor installed 144 ft of pipe at this location in order to keep a consistent slope in this area.
Therefore an additional 4 ft of permanent stream impacts occurred at this site. In addition, the permit
drawings show 20 ft of rip rap along both banks of the stream on the outlet end of the pipe. The rip
rap is included in the 0.03 acre of permanent surface water impact listed in the original permit
application, but not clearly identified as bank stabilization as noted before in the discussion of Site 2.
After reviewing the project in the field it was determined that bank stabilization is also required on
the inlet end of the pipe, therefore < 0.01 acre of permanent surface water impact (20 ft of bank
stabilization) is requested for the inlet end of pipe as well.
All other impacts identified in the original permit application are correct. The only other change in
the modified impact summary sheet will be the enumeration of the temporary surface water impacts
depicted on the permit drawings for Sites 1, 2, 2a and 3 that are less than one hundredth of an acre.
These impacts will be shown as <0.01 rather than 0.00, as requested.
Therefore by submittal of this letter and attached modified impact summary sheet, NCDOT is hereby
requesting a modification of U.S. Army Corps of Engineers Nationwide 14/33 (Action ID 1998 2173)
and the corresponding Division of Water Quality Certification (DWQ Project No. 20081177 v.]) to
include the modified impacts described above and listed in the attached summary of impact sheet.
The Department feels that the mitigation proposal submitted with original permit application dated
July 18, 2008, is sufficient for the minor modifications included in this request.
