Otto Engineering Incorporated P.O. Box 497 Otto, NC 28763 Subject: Additional Information Request NPDES Permit No. NCO086746 Tennessee River RV Park W WiP Macon County Dear Mr. Judernatz: A letter of request for an NPDES permit along with the new permit fee was received July 22, 1999 by the Division of Water Quality. The NPDES permit is proposed for an RV park and campsite along the Tennessee River in Macon County. This letter is submitted in follow-up to our conversation October 13, 1999. The following Items will be needed in order to continue processing the application: • The Divisions "Guidance for the Evaluation of Wastewater Disposal Alternatives" Is enclosed with this letter. Please read and follow this guidance prior to submitting a revised evaluation. • Initial review of the soils report indicates that the soil scientist evaluated the site for potential individual subsurface systems. Evaluation of a potential community subsurface system, connection to a publicly owned treatment works or existing privately owned treatment works, drip irrigation, as well as spray irrigation should also be investigated. The soil scientist should be able to provide information on potential loading rates for a community drip or spray irrigation system. • If land is not available at the existing site, determine if additional land could be acquired to accommodate another treatment scenario (as outlined in Part B.2. of the guidance). • The engineering proposal submitted indicates that the project may be built in phases of 10,000 gpd each. Please provide information regarding how many RV sites will be proposed for each phase and what the time frame will be for bulk-out of each phase. • Please provide additional treatment information for the proposed Cromaglass sequencing batch reactor. Specifically, provide effluent data for similar wastewater flows at similar temperate zones. Also, explain how the treatment system will remain functional during the off-season months. • Local Government sign-off should be provided indicating that the area has been zoned for the purposes of an RV Park/ campsite (the form has been attached). • Please inform the owner that the permit, if approved, will be issued to him(and he personally will be legally responsible for the permit). If the owner wishes to have the permit issued to an incorporated entity, please provide this information. 1617 Mail Service Center,Raleigh,North Carolina 276994617 919733-5093,extension 510 (fu)919733-0719 An Equal Opportunity Allirmative Action Employer Susan.A..Wilson6ncmail.net Page 2 of 2 The NPDES Unit is aware that treatment system options may be limited In mountain terrain, however, please address the requested Items as best as practicable. Carstensen 4901 Shoreline Drive Polk City, Florida 33863 Subject: Permit Name Change Permit Number COC NCG550364 Macon County Dear Mr. and Mrs . Carstensen: In regard to our phone conversation on January 18, 1994, I am sending this letter to augment the discussion. Accompanying this letter is the original letter I sent you. in November of 1993, informing you of your responsibilities regarding the discharge system serving your mountain home in Otto, North Carolina. Your home requires a sand filter septic system because in 1985 when the Macon County Health Department evaluated the soils for accepting a conventional septic system the soil characteristics were unsuitable. When this occurs the owner can apply with the State for a discharging system such as yours. The reason your land requires a special system, where your next door neighbor may not, is due to the way the soils formed on your property and the way the river traversed the land for years . The sand filter septic systems are effective in treating domestic waste. Since these systems are designed to discharge to waters of the State, a legal document, in your case a General Permit, is issued to regulate the discharge and protect the environment. . The previous owners permit is not transferable to you upon purchase of the property. Therefore, by having this system in the ground at your new residence, whether it is discharging or not, and not having the permit in your name, you are operating illegally. Consequently, it is important that you act accordingly in order to avoid enforcement. As discussed during our phone conversation, you will need to have the permit in your name prior reuse of the system. Therefore, it is requested that within thirty days of the date on this letter Interchange Building,59 Woodfin Place,Asheville,N.C.28801 Telephone 704-251-6208 FAX 704-251-6452 An Equal Opportunity Affirmofive Action Employer 50%recycled/10%owl-consumer paper . and Mrs . Refer to the November 29, 1993, letter for what is required by you to complete this process . Once Raleigh receives these items they will request a report from me verifying that everything is in order, once they have received my approval they will start the permitting process . Hence, I can aid you in this process if you will call me or leave word with my secretary when you send the copy of the Deed, the check and the note requesting the name change to Raleigh so I can avoid delay and send out my approval. Preston Howard, Jr., P.E., Director November 29, 1993 Frank Fargo 12378 Gleahaven Drive Spring Hill FL 34609 Subject: Certified Operator Requirements Single Family Treatment Systems NPDES Permit No. NCG550364 Macon County Dear Mr.Fargo: During February of this year, public hearings were held on proposed changes to modify the operator certification rules. The proposed rules included a requirement that single-family discharge systems would be classified wastewater treatment facilities, which would require an annual inspection by a certified operator. The intent of the rule was to insure that the systems are being properly operated and maintained. During the public comment period, a significant amount of comments, statements and additional information was submitted. As a result, the Water Pollution Control System .Operators Certification Commission amended the proposed rules. The mle, as adopted and effective July 1, 1993, now requires single-family discharging systems to be classified only if they are permitted after July 1, 1993 or if upon inspection by the Division of Environmental Management (DEM) it is found that the system is not being adequately operated and maintained. Systems can be inspected by DEM during routine compliance inspections, permit renewals, or complaint investigations. Once a system is classified, it. will be required to have at a minimum, an annual inspection by a certified operator. It is important to remember that the NPDES permit is part of a Federal program administered by the State of North Carolina and that violations of the permit are enforceable by Federal and State laws. Although your system will not be required to have a certified operator at this time, proper operation and maintenance is needed for the system to function satisfactorily. In as much as each system must be individually designed and sited, special maintenance requirements may apply to a specific installation. The attached maintenance schedule should however be applicable to most systems. The frequencies suggested are considered to be the minimum necessary. More frequent attention may be needed for a specific system and may be required by conditions of the permit. P.O. North Carolina General Statute (NCGS) 143-215. 1(c) requires that an application for permit renewal be filed at least 180 days prior to the expiration date. As of the date of this letter, the Division of Environmental Management had not received an application for renewal. If operation of a discharge or waste treatment facility is to occur after the permit's expiration date, or if continuation of the .permit is desired, it must not be allowed to expire. A renewal request must be submitted no later than 180 days prior to the permit's expiration date. Operation of the waste treatment works or continuation of a discharge after the expiration date would constitute a violation of NCGS 143-215. 1 and could result in assessment of civil penalties of up to $10,000 per day. If continuation of the permit is desired, failure to request renewal at least 180 days prior to expiration will result in a civil assessment of at least $300.00; larger penalties may be assessed depending upon the delinquency of the request. A renewal application shall consist of a letter requesting permit renewal along with the appropriate completed and signed application form (copy attached), submitted in triplicate, referenced in Title 15 of the North Carolina Administrative Code (15 NCAC) Subchapter 2H .0105(a). Primary industries listed in Appendix A of Title 40 of the Code of Federal Regulations, Part 122 shall also submit a priority pollutant analysis in accordance with Part 122.21. A processing fee must be submitted with the application. In addition to penalties referenced above, a permit renewal request received after the expiration date will be considered as a new application and will require the higher application fee. Presently, no facility is allowed to submit a fee for the general permits listed in the schedule since the Environmental Protection Agency has not approved the State of North Carolina's general permit. If the facility covered by this permit contains some type of treatment works, a narrative description of the sludge management plan must be submitted with the application for renewal. The Environmental Management Commission adopted revised rules on October 1, 1990 (attached), requiring the payment of an annual fee for most permitted facilities. The lot lies in the floodplain of Coweeta Creek. Approximately 24 to 30 inches of fill material has been placed over the alluvial floodplain soils. There are indications of a perched groundwater table in the fill material, and the underlying alluvium appears to be saturated. The alluvium encountered in auger borings directly under the fill. material had textures ranging from loam to silt loam. In accordance withthe North Carolina Laws and Rules for Sanitary Sewage Collection, Treatment and Disposal, this property is unsuitable for a ground absorption sewage system. Reasons for the unsuitable classification are as follows: (1) The naturally occurring soils are poorly drained, with indications of a ground- water table at or near the original ground surface (Paragraph .1942). (2) The nitrification lines cannot be installed in fill material on this lot due to the lack of one foot of naturally occurring soil with suitable or provisionally suitable soil characteristics (Paragraphs .1942, .1950(b), and .1950(c) (1)). Arguelles proposes to construct a three bedroom residence on a lot he purchased in the development known as Coweeta Lands in Macon County some 11 - 12 years ago. The Macon County Health Department has denied issuance of an improvements permit fora conventional septic tank drainfield system. Therefore he proposes to construct a septic tank sandfilter trench wastewater treatment system and discharge treated effluent into Coweeta Creek, a Class °C-Trout" stream in the Little Tennessee River Basin. PROPOSED TREATMENT WORKS The wastewater treatment system will consist of a 1,000 gallon septic tank, 300 square feet of sand filtration trench and aRip Rap gravel outfall ditch.
